Mr.Bradbury read the resolution: Page 1 of 9 Board of Trustees September 13,2016 RESOLUTION SETTING A PUBLIC HEARING ON A PROPOSED LOCAL LAW MODIFYING SECTION 240.20.1 OF THE VILLAGE CODE INCREASING THE NUMBER OF WINTER OVERNIGHT PARKING PERMITS AVAILABLE IN THE GARIBALDI PARKING LOT BE IT RESOLVED,that the Village of Rye Brook Board of Trustees hereby sets a public hearing on a proposed local law modifying Section 240- 20.1 of the Village Code increasing the number of winter overnight parking permits available in the Garibaldi Parking Lot for a meeting of the Board of Trustees to be held on September 27,2016. Mayor Rosenberg explained that this program was in place last year but limited to 10 spaces.There was a high demand for the spaces so the Board is glad they are able to increase the spaces to 18 this year.It will help with the overnight parking and making plowing easier as well. Mr.Bradbury read the resolution: RESOLUTION CONSIDERING FOUR(4)APPOINTMENTS TO THE TRAFFIC COMMISSION THEREFORE BE IT RESOLVED,that Steven Klein of 81 Bowman Ave be appointed to the Traffic Commission to fill a vacancy for a term that shall expire on the first Monday of April 2019;and Page 2 of 9 Board of Trustees September 13,2016 BE IT FURTHER RESOLVED,that David Nadasi of 20 Woodland Drive be appointed to the Traffic Commission to fill a vacancy for an unexpired term that shall expire on the first Monday of April 2018;and BE IT FURTHER RESOLVED, that Jeffrey Nadler of 95 Brush Hollow Close be appointed to the Traffic Commission to fill a vacancy for an unexpired term that shall expire on the first Monday of April 2018;and BE IT FURTHER RESOLVED,that Judy Simon of 9 Lawridge Drive be appointed to the Traffic Commission to fill a vacancy for an unexpired term that shall expire on the first Monday of April 2017. Mayor Rosenberg noted that very shortly after sending out an email blast on the openings for this committee,the responses from interested people starting coming in.The Mayor and Board thanked the four appointees for volunteering and showing an interest in the community. C) Considering accepting a donation of Carbon Monoxide detectors for distribution by the Rye Brook Fire Department. Mr.Bradbury read the resolution: RESOLUTION CONSIDERING ACCEPTING A DONATION OF CARBON MONOXIDE DETECTORS FOR DISTRIBUTION BY THE RYE BROOK FIRE DEPARMENT. Page 3 of 9 Board of Trustees September 13,2016 WHEREAS,Michelle DiMiceli contacted the Village of Rye Brook to make a donation of 240 Carbon Monoxide detectors on behalf of the families and friends of Carl Persson and Joseph Pendrak,two Rye Brook residents who passed away from Carbon Monoxide poisoning in 2015;and WHEREAS, Michelle DiMiceli has requested that these detectors be made available for distribution to residents of Rye Brook and Port Chester through the Rye Brook Firehouse;and WHEREAS, Michelle DiMiceli has stated that this donation has an estimated value of$4,000.00 NOW, THEREFORE BE IT RESOLVED, that the Village of Rye Brook hereby accepts the donation of 240 carbon monoxide detectors from Michelle DiMicelli, on behalf of the families and friends of Carl Persson and Joseph Pendrak, for distribution to Rye Brook and Port Chester residents through the Rye Brook Firehouse. Mayor Rosenberg remembers this event and the unfortunate loss of two family members to carbon monoxide poisoning.The Board thanked the family and friends for honoring the loss of their family with such a generous donation. Mr.Bradbury read the resolution: Page 4 of 9 Board of Trustees September 13,2016 RESOLUTION CONSIDERING A SNOW AND ICE AGREEMENT WITH THE NEW YORK STATE DEPARTMENT OF TRANSPORTATION FOR THE 2016/2017 SNOW SEASON RESOLVED,that the Village of Rye Brook is authorized to enter into extensions of the indexed lump sum municipal snow and ice agreement (#D010779)with the State of New York,Department of Transportation until June 30,2017 under which the Village of Rye Brook will receive an estimated payment of$17,674($1,578 per lane mile)for the 2016/17 snow season for snow and ice control on King Street and Westchester Avenue;and be it further RESOLVED,that the Mayor is authorized to execute and deliver all documents necessary or appropriate to accomplish the purpose of this Resolution. Mr.Bradbury explained that this extension included an increase from what the Village received last year and while a small amount,it does help. Moved by CARRIED. Mr.Bradbury read the resolution: Page 5 of 9 Board of Trustees September 13,2016 RESOLUTION CONSIDERING MOVING THE VILLAGE BOARD MEETING FROM OCTOBER 11,2016 TO OCTOBER 13,2016 AT 7:OOPM. NOW THEREFORE BE IT RESOLVED,that due to a scheduling conflict with Yom Kippur, the Village of Rye Brook Board of Trustees hereby approves thatthe Village Board meeting be moved from October 11,2016 to October 13,2016 at TOOPM. Mr.Bradbury read the resolution: RESOLUTION Considering the approval of the minutes for the meetings held on JULY 26, 2016 and August 23,2016. NOW THEREFORE BE IT RESOLVED, that the Viflage of Rye Brook Page 6 of 9 Board of Trustees September 13,2016 Board of Trustees approve the minutes for the meetings held on July 26,2016 and August 23,2016. For Against Susan Epstein(Moved By) x David Heiser(Seconded By) x Jason Klein x Paul Rosenberg x 4 0 Carried. 7 ADMINISTRATOR'S REPORT: Mr.Bradbury stated that the paving is going very well and is almost complete.They are finishing up the curbing on the paved roads and overall have done a very nice job. The basketball resurfacing at Pine Ridge Park will be completed this week. Hawthorne Avenue-In October the Board will need to revisit the striping and speed h ump project that was implemented there.The humps may have to be removed for the winter for plowing purposes and he suggested that the Board add it to the agend for the October 25th meeting for public discussion.Mr.Bradbury's office will send a letter to all the residents of Hawthorne Avenue advising them of the meeting and request feedback from them as well. Mayor Rosenberg would like speed radar information prior to that meeting a well.He assumes traffic has slowed down with the installation of the speed humps as that was the purpose for this.He would like the letter to also advise the residents that while there will be public discussion,there will be not vote that night on whether to make the speed bumps permanent or to remove it all together. 8 OLD BUSINESS: 9 NEW BUSINESS: 10 DISCUSSION ITEM: a) Considering Decks as a Pervious Surface Page 7 of 9 Board of Trustees September 13,2016 Trustee Epstein brought this topic up a couple of months ago and asked for us to discuss the possibility that portions of decks should be considered pervious. Mr.Bradbury advised the Board that his assistant,Alex Frank,had done some research and reached out to General Code and a few other communities and found that it varies a lot depending on the municipality she spoke with and it seems the trend is if done correctly to consider it pervious. There was discussion among the Board and the consensus was to formulate draft legislation and create definition for pervious decks. Mayor Rosenberg would be happy modifying the code giving strict definitions to show we are willing to work with the residents. Trustee Klein would like input from the Planning Board as well. 11 UNFINISHED BUSINESS 12 ADJOURNMENT Mayor Rosenberg advised that residents can now sign up for Rye Brook Recreation classes on line.The next Village Board meeting will be Thursday,October 13th at 7pm.
