RESOLUTION 2. Considering a resolution canceling the December 27, 2007 meeting. MINUTES 3. Approval of the October 11, 2007 meeting minutes. Carosi, P.E., Village Engineer Ms. Shari Melillo, Planning Board Secretary Chairman Zuckerman opened the meeting by asking everyone to join him in the Pledge of Allegiance. He then introduced the Board members and the Village Staff to the audience, explained the rules of procedure for the meeting and made note for the public that the complete set of Planning Board Rules and Procedures can be found on the Village web site. Chairman Zuckerman called for the first item on the agenda: PUBLIC HEARINGS 1. Continuation of a Public Hearing concerning a Site Plan Application by John G. Scarlato Jr., Architect, on behalf of Mr. Richard Montesano to reconstruct the single-family dwelling at 60 Valley Terrace, Rye Brook, Section 135.59, Block 1, Lot 49 in the R7 Zoning District. Mr. Scarlato, addressed the Board and explained that the project had been before the Village Zoning Board of Appeals on November 6, 2007, at which time the Zoning Board approved the requested variances. Mr. Scarlato presented a brief overview of the project for the Public Hearing. He reviewed past recommendations from the Planning Board and demonstrated how the changes were incorporated into the drawings. He mentioned the relocation of the chimney to the interior of the home and removal of a portion of the existing driveway at the front of the property. No changes were required by the Zoning Board and therefore no revisions to the plan were necessary since the last meeting the applicant was before the planning board. Chairman Zuckerman stated there had been some controversy surrounding this application going before the Zoning Board prior to site plan approval, but in his opinion, Page 2 of 7 November 15, 2007 Planning Board Approved the system has shown that it works and he believes it not only worked for the Planning Board,but it has worked for the applicant as well. Chairman Zuckerman asked for a motion to close the Public Hearing and on a motion made by Mrs. Fredman and seconded by Mrs. Schoen, Mr. Carosi called the roll. Chairman Zuckerman asked to advance the approval resolution, which would not require a motion, if all are in agreement. None were opposed. Mrs. Kandel read the resolution into the minutes: Chairman Zuckerman asked for a motion to approve the resolution as read and on a motion made by Mrs. Schoen and seconded by Mr. Agatston, the roll was called by Mr. Carosi. Mr. Agatston agreed with the Chair that the process of referring the applicant to the Zoning Board worked and he would like to continue the process in the future. Mrs. Schoen agreed with Mr. Agatston. Mr. Grzan was not sure if the procedure will apply to every applicant in the future, but agrees that in this particular application,he felt the process did work for everyone. Page 3 of 7 November 15, 2007 Planning Board Approved November 15, 2007 APPROVED RESOLUTION APPROVING A SITE PLAN TO CONSTRUCT A HOME AT 60 VALLEY TERRACE VILLAGE OF RYE BROOK PLANNING BOARD WHEREAS, John G. Scarlato, Jr. has made an application to the Village of Rye Brook pursuant to Chapter 209 of the Village Code on behalf of the owner, Richard Montesano, requesting site plan approval to rebuild and expand the dwelling at 60 Valley Terrace, Rye Brook, New York, designated on the Tax Assessor's Map as Section 135.59, Block 1, Lot 49 in the R-7 zoning district; and WHEREAS, the Planning Board reviewed the following plans and application materials: 1. Revised Site Plan Application 2. Exterior Building Permit Application 3. Short Environmental Assessment Form 4. Topographic Map, not dated, prepared by Contractors' Line and Grade South, LLC, Elmsford, NY 5. Architect's Plans, prepared by John G. Scarlato, Jr., Architect, Armonk, NY: Sheet Number Sheet Title Dated Sheet A-1 Site Plan rev. 11/15/07 Sheet A-2 Exterior Elevations rev. 8/29/07 Sheet A-3 First& Second Floor Plans rev. 8/29/07 Sheet A-4 Basement &Attic Plans rev. 8/29/07 Sheet A-5 First & Second Floor Electrical and Ceiling Plans 7/10/07 Sheet A-6 Tree Preservation and Landscape Plan rev. 8/29/07; and WHEREAS, the Planning Board of the Village of Rye Brook, pursuant to the State Environmental Quality Review Act (SEQRA), determined the proposed action to be a Type II Action requiring no additional review under SEQRA; and Page 4 of 7 November 15, 2007 Planning Board Approved WHEREAS, the Village Planning Consultant, Village staff and the Planning Board reviewed the information, submitted comments and made recommendations regarding the site plan, zoning, impervious surface coverage, gross floor area, storm water management and erosion and sediment control and the plans were revised according to the comments, reducing area variances required for approval; and WHEREAS, the residence and site plan, as proposed, was granted the following variances by the Village Zoning Board of Appeals on November 6, 2007: 1. A 0.5-foot variance from the minimum side yard requirement of 8 feet; 2. A 4-foot variance from the total of two side yards requirement of 20 feet; 3. A 251-foot variance from the maximum allowable gross floor area of 2,361 square feet; 4. A 192 square-foot variance from the maximum allowable total impervious coverage of 3,305 square feet for the increase in impervious surface coverage beyond the existing non-conforming coverage; and WHEREAS, the Planning Board is familiar with the site and all aspects of the project; and WHEREAS, on September 27, 2007, the Planning Board opened a public hearing on the subject application, at which time all persons interested were given an opportunity to speak on behalf of or in opposition to said application and the Planning Board closed the public hearing on November 15, 2007. NOW, THEREFORE, BE IT RESOLVED, for the reasons stated herein, the Village of Rye Brook Planning Board hereby approves the site plans listed herein to rebuild and expand the single-family dwelling at 60 Valley Terrace. BE IT FURTHER RESOLVED, that no permits shall be issued until the Applicant has paid to the Village all applicable fees and professional review fees incurred in connection with review of this Application. Chairman Zuckerman called for the next item on the agenda: RESOLUTION 2. Considering a Resolution cancelling the December 27, 2007 meeting Chairman Zuckerman asked Mrs. Kandel to read the resolution into the minutes. November 15, 2007 APPROVED RESOLUTION VILLAGE OF RYE BROOK PLANNING BOARD BE IT RESOLVED, that the Planning Board hereby cancels its December 27th meeting. Chairman Zuckerman called for the final item on the agenda: MINUTES 3. Approval of October 11, 2007 meeting minutes. Mr. Agatston stated that he is very pleased that the minutes are up to date. Mr. Grzan added that he has reviewed the minutes, was very pleased with them and has no additional comments. Chairman Zuckerman asked for a motion to approve the October 11, 2007 Planning Board minutes and on a motion made by Mr. Agatston and seconded by Mrs. Schoen, Mr. Carosi called the roll.
