Clark Associates, Inc.; and WHEREAS, the Board of Trustees separately undertook and considered each of environmental issues identified in the Full Environmental Assessment Form, Parts 1, 2 and 3; and WHEREAS, the public hearing was then closed on July 28, 2015, 2015; and 7 3 73/7 7 0/549683v4 8/74/75 -4- WHEREAS, the Board of Trustees adopted a resolution, dated July 28, 2015, which (i) adopted a Negative Declaration, pursuant to SEQRA, in connection with the Proposed Action; and (ii) approved certain amendments to the text of the PUD zoning regulations set forth in Section 250-7.E.(3) of the Village Code. NOW, THEREFORE, BE IT RESOLVED, that the Board of Trustees hereby adopts the annexed local law amending the Zoning Map of the Village of Rye Brook to change the zoning designation of the aforementioned Parcel from OB-1 to the PUD District for the reasons set forth in such local law and in the record before the Board of Trustees; and BE IT FURTHER RESOLVED, that the Board of Trustees hereby grants PUD Concept Plan approval for the Application, subject to the following conditions: 1. The conditions set forth in the oard of Trustees resolution adopted July 28, 2015 shall be satisfied. 2. Prior to submitting an application to site plan and/or Nsubd* approval as part of Phase II of its Application, the Applicant shalief from the Zoning Board of Appeals from Section 250- .E(2)(c), requiring 150 feet of frontage along a state, county or major Village d for all PUD developments. 3. The Applicants as part of Phase II of its Appli t aft ion, obtain approval for a Wetlands Permit from the Planning Board, if applicable. 4. The Applicant shall submit, as part of Phase II of its Application, a recordable De tion of Termination for review by the Village Attorney which to, rminate e Mutual Access Easement running in a north-south direction ward the ral Arrowwood property as shown on the Resubdivision Plan of yal Executive Park, pr ared by J.A. Kirby Company, filed in the Westchester County Clerk's ffice on October 10, 1986 as Map No. 22473, as it appear such easement is no longer necessary. Approval of the Declaration of Term tion by the Village Attorney and recording in the Office of the Westchester County Clerk shall be conditions precedent to issuance of a building permit for the project. 5. Based on the current and anticipated future need for park and recreational opportunities in the Village of Rye Brook, and the demands of the future population of the proposed residential development, the Board of Trustees hereby finds that additional recreation/parkland should be created as a condition of approval for the Application. The Board of Trustees further determines that a suitable park of adequate size cannot be properly and practically located within the Parcel, nor has the Applicant offered recreation/parkland of suitable size and practical location to adequately address 7 3 73/7 7 0/549683v4 8/74/75 -5- the need for additional recreation/parkland within the Village. Therefore, the Board of Trustees hereby requires that the Applicant shall, as part of Phase II of its Application, pay a Recreation Fee in Lieu of Parkland in accordance with Sections 250-7.E(2)(f)[2] and 209-15 of the Village Code. Payment of said fee, in full, shall be a condition precedent to issuance of a building permit for the project. 6. The Board of Trustees shall not entertain Phase II of the Application until the Applicant has paid to the Village all applicable fees and professional review fees incurred in connection with review of Ph&f the project application. 7. The Board of Trustees, pursuant to Section 250-7.E.(3) of the Village Code, as amended, hereby approves reduction of the 100 foot buffer required pursuant to Section 250-7.E(2)(e) of the Village Code tollo feet in width along the entire length of the eastern side of the Parcel facing the Reckson Executive Park. Said buffer reduction is being granted to accommodate the configuration of the homes and rear yards proposed this side of the Parcel. Notwithstanding the foregoing, the Board of rustees is . fied that the reduced buffer shall' provide adequate screening between the Reckson Executive Park and the Sun Homes development and directs that the buffer shall, to the greatest extent possible, be maintained in accordance with Section 250-7.E.(2)(e) of the Village Code in that the buffer shall remain in common ownership and shall not be disturbed, except for the following, if applicable during Phase II review: permanent entrance/exits utilizing minimum buffer space, signage, passive recreation, landscaping, roads and for the provision of i tilies. 8. accordance with Section 2 4 (a)[5][d] of the Village Code, approval of the PUD Concept Plan and rezoning shall expire at the end of one year from the date of this resolution, and the property shall revert to its prior zoning, unless (a) the Applicant has filed a subdivision and detailed site plan application for the PUD; or (b) such time limit has been extended by the Village V written request by the Applicant. 7 3 73/7 7 0/549683v4 8/74/75 -6- LOCAL LAW AMENDING THE VILLAGE OF RYE BROOK ZONING MAP A LOCAL LAW to amend the Village of Rye Brook Zoning Map BE IT ENACTED, by the Board of Trustees of the Village of Rye Brook, as follows: Section 1: Legislative Intent. 0e The Board of Trustees of the Village of Rye Brook has received and is considering an application from Buckingham Partners/Sun Homes (the "Applicant") for approval of a Planned Unit Development ("PUD") Concept Plan, PUD zone change and zoning text amendment in connection with the propose constructioof a residential development of 110 single-family dwelling units on real property locaiN at 1100 King Street in the Village of Rye Brook; said property being further identifie ts Parcel 129.25-1-1 on the Town of Rye Tax Map (the "Parc$") and located directly behind the Reckson Executive Park in the OB-1 Zoning District. The Board of Trustees referred the application to the Village of Rye Brook Planning Board and the Planning Boa issued a positive report and recommendation on the application, inclusive of the propos PUD zone change and zoning text amendmen ly 11, 2015. After revi of the *appication, comments om the public, comments from Village staff and consultants, and comments from the Westchester County Department of Planning, the Board of Trustees has determined it is appropriate to rezone the property from the OB-1 Zoning District to the PUD Zoning District in connection with the above- described application, and therefore, for the reasons set forth herein and others articulated in the record before the Board of Trustees, the Board of Trustees adopts this Local Law. Sectio 2: The Zoning Map of the Village of Rye Brook is hereby amended to designate the parc of real property located at 1100 King Street and designated on the Town of Rye Taxas ction 129.25, Block 1, Lot 1, as being located in the PUD Zoning District. Likewise, the possession and caning of a cage, trap, snare or similar animal restraining device shall be presumptive evidence of trapping. § 126-9 Trapping restrictions. To Trap, or Trapping, for purposes of this chapter, shall mean the act of setting of a cage, trap, snare or similar restraining device for the purpose of capturing or killing an animal for food or sport. This definition does not include animal capture conducted by a professional trapper, animal control officer, animal control service or humane society for nuisance removal, population control or for any other purpose that is not Trapping for food or sport. All traps used in the Village of Rye Brook shall be fitted with a metal tag featuring the owner's name and address upon it. SECTION 3. Chapter 127 of the Code of the Village of Rve Brook, hereby titled "Fireworks and Pyrotechnics", is enacted as follows: 127-1 Findings and purpose. A. Pursuant to recent revisions to the New York State Penal Law � 405.00, it is now legal for private individuals, organizations and municipalities, to employ the use of professional Pyrotechnics and Fireworks for public displays. The Rve Brook Board of Trustees hereby finds that such activities are extremely dangerous, as they incorporate the use of highly explosive materials and other devices which can pose a serious threat to public health and safety if not conducted in a proper and safe manner. The Board of Trustees, therefore, finds it is necessary to enact a chapter benefiting the health, safetygeneral welfare of the Village of Rye Brook and its residents with 1313/08/54921311 8114115 -3- respect to the storage and use of Fireworks and Py_rotechnics within the Village's jurisdiction. B. This chapter is intended to operate in accordance with and shall not supersede, Sections 405.00 and 270.00 of the New York State Penal Law or the regulations promulgated by the NYS Commissioner of Labor under 12 NYCRR Part 61, as amended from time to time. Where applicable, this chapter shall regulate those areas specificall-y prescribed to the authority of the Village. 127-2 Definitions. AUTHORIZED ASSISTANT An individual who has been authorized by the Certified Operator to work on a show after such operator has confirmed that the individual is either a certified pyrotechnician, or otherwise meets the following qualifications: (1) is at least 18 Years old; (2) has been trained in the performance of the tasks to be assigned; and (3) has been educated with regard to safety hazards. FIREWORKS Any composition or device for the purpose of producing a visible or an audible effect for entertainment purposes by combustion, defla rg ation, or detonation that meets the definition of Consumer Fireworks or Display Fireworks as set forth in NFPA 1123 and NFPA 1126. This definition expressly excludes "Sparkling Devices", as defined in Section 270.00 of the NYS Penal Law. CERTIFIED OPERATOR A person who is certified as a Pyrotechnician through the NYS Department of Labor. PERMIT A permit issued by the Re Brook Building Department, with permission of the Board of Trustees, for the public display and discharge of fireworks and/or pyrotechnics in accordance with the requirements set forth by this chapter. PYROTECHNICIAN An individual who performs any tasks on a p�%rotechnic or fireworks display, including setting up the equipment, fireworks, or pyrotechnics, loading mortars loader), spotting bursting locations (spotter, tending a ready box (ready box tender), igniting the fireworks (shooter, striking the equipment, or cleaning the site. PYROTECHNICS Controlled exothermic chemical reactions that are timed to create the effects of heat, gas, sound, dispersion of aerosols, emission of visible electromagnetic radiation, or a combination of these effects to provide the maximum effect from the least volume. 1313/08/54921311 8114115 -4- SPONSOR Any person or entity applying for a Permit issued pursuant to this chapter. 127-3 General restrictions; permit required. A. It is hereby unlawful to fire or discharge Fireworks or Pyrotechnics indoors or to conduct an indoor Fireworks of Pyrotechnics displays in the Village of Rye Brook. B. No Fireworks or Pyrotechnics display may be conducted in the Village of Rye Brook on a property containing one or more residential dwellings as its principal use. C. No outdoor Fireworks of Pyrotechnics display shall take place in the Village of Rye Brook unless the Sponsor has been granted a Permit issued pursuant to this chapter. D. A Permit issued pursuant to this chapter shall not be transferable under any circumstance. Any attempt to transfer such Permit shall render the Permit null and void. S 127-4 Application procedures. A. A Sponsor seeking a Permit pursuant to this chapter shall submit an application to the Building Inspector upon a form prescribed by the Village. Said application shall include: the name of the Sponsor; the names of the Certified Operator(s) and Authorized Assistant(s) to be in charge of the display; a verified statement from the Sponsor identifying the Certified Operators who are authorized to conduct the display, including their certificate numbers, and stating that such individuals possess a valid certification as a Pyrotechnician; the date and time of day at which the display is to be held; the location planned for the display; the number and kind of Fireworks or Pyrotechnics to be discharged; the manner and place of storage of such Fireworks or Pyrotechnics prior to the dis la T; 1313/08/54921311 8114115 -5- a diagram of the grounds on which the display- is to be held showing the point at which the Fireworks or Pyrotechnics are to be discharged, the location of all buildings, structures, highways and above-ground utilities, the lines behind which the audience will be restrained and the location of all nearby trees or other overhead obstructions; and 44 such other information as the Board of Trustees or the Building Inspector deems necessary. An electronic copy of all submitted materials in a format acceptable to the Building Inspector B. All applications seeking a Permit pursuant to this chapter must be submitted to the Building Inspector for a determination of completeness. If Building Inspector deems the application complete, he shall forward same to the Board of Trustees for review and consideration. C. The Board of Trustees shall review all applications pursuant to this chapter at a regular meeting of the Board. Upon conducting such review, the Board of Trustees shall decide, upon a majority vote, whether the proposed display, is likely- to create an unreasonable risk of danger to the public health, safety or welfare or an unreasonable nuisance to the Village or its residents. If the Board of Trustees approves an application, it shall be sent back to the Building Inspector immediately for further review and consideration in accordance with subsection D. below. D. Building Inspector Approval. Upon receipt of an application approved by the Board of Trustees, the Building Inspector shall conduct a pre-display site visit attended by the Rye Brook Fire Chief, Chief of Police and representatives for the Sponsor, Certified Operator and property owner. The purpose of the site visit shall be to inspect the location of the proposed display; identify potential safety issues determine the specific locations for the display, staging area, viewing distance, in accordance with 127-5, and viewing areae. Said site visit shall be conducted within two (2� weeks after the Board of Trustees' approval of the application unless extenuating circumstances require additional time for the inspection to be conducted. If, following the pre-display site visit, the Building Inspector is satisfied that the proposed display will not create an unreasonable risk of danger to the public health, safety or welfare or an unreasonable nuisance to the Village or its residents, he shall issue a Permit for the proposed display. Such Permit may be issued upon such reasonable conditions and restrictions as the Building Inspector deems necessary or prudent under the circumstances. 1313/08/54921311 8114115 -6- E. Bond or insurance. Before issuance of a Permit pursuant to this chapter, the Sponsor shall post a bond, in an amount determined bl: the Building Inspector, but which shall not be less than $1,000,000, conditioned for the payment of all damages which may be caused to a person or to the property of a person or legal entityby reason of the display permitted and arising from ani acts or omissions of the Sponsor, Operator, or ani agent, employ, contractor, or subcontractor thereof. A certificate evidencing purchase of the bond shall be provided to the Building Inspector prior to the date of an3proposed display (2) The Building Inspector mai accept, in lieu of such bond, an indemnity insurance policy with liability coverage and indemnity protection equivalent to the terms and conditions upon which such bond would be predicated and for the purposes provided in this section. Such indemnity insurance policy shall name the Village of Rye Brook, and its agents, officers, directors and employees, as an additional insured by separate endorsement. A certificate evidencing the purchase of the policy shall be submitted to the Building Inspector prior to the date of any proposed display. F. Denial of an application for a Permit shall be in writing, addressed to the Sponsor. G. There shall be a nonrefundable fee for submission of an application pursuant to this chapter in an amount determined by the Board of Trustees and set forth in the Village fee schedule. 127-5 Viewing distance. The Building Inspector, in consultation with the Certified Operator, Fire Chief and Chief of Police, shall establish the minimum safe viewing distance from which viewers of the display can observe the display without risk of harm or in,juryperimeter shall be established for this purpose, which onlythe Certified Operator, its Authorized Assistants, Building Inspector and members of the Fire Department or Police Department may cross prior to and during the display. 127-6 Revocation of permit. The Building Inspector may deny or revoke .a Permit issued pursuant to this chapter if (sem discovers that the Sponsor has provided intentionally misleading or false information in the application materials or that the Sponsor or Operator have otherwise violated any provision of this chapter. 127-7 Additional requirements. 1313/08/54921311 8114115 -7- A. All displays for which a Permit has been issued shall be conducted in full compliance with NFPA 1123 or NFPA 1126, or both, if applicable, and with the terms of a the Permit granted by the Building Inspector. B. All debris resulting from the display shall be collected and properly disposed of by the Certified Operator within 24 hours after conclusion of a display C. The Village reserves the right to have representatives of the Building Department, Fire Department or Police Department attend an-y display for which a Permit has been issued. D. The Sponsor and Certified Operator shall have copies all Permits available and ready for inspection on site before and during execution of the display 127-5 Penalties for offenses. A. Violation of this chapter shall subject the offending�person or entity to the penalties of Article 270 of the New York State Penal Law and Section 405.05 of the New York. State Penal Law concerning seizure of Fireworks. B. Notwithstanding any State penal law violation, a violation of this chapter shall constitute a separate violation of the Code of the Village of Rye Brook, unishable by a fine of $250 per offense and revocation of any Permit issued pursuant to this chapter. Conviction for a violation of this chapter may also be considered in determining whether future Permit under this chapter should be granted to the same Sponsor and/or Certified Operator. C. The Building Inspector and Assistant Building Inspector, in addition to any other persons or agencies authorized under state law, shall have authority to enforce the provisions of this chapter and issue appearance tickets and summonses for violations hereof. D. The violations and penalties prescribed under this section shall be in addition to any charges and penalties prescribed under state law. 127-9 Severability. If any section, subsection, aragraph, or clause of this chapter is declared invalid by a court of competent Jurisdiction, such finding shall have no effect on the remaining provisions of this chapter or their enforceability 1313/08/54921311 8114115 -g- S 127-10 Conflict with state law. If any section, subsection, paraaraph, or clause of this chapter is in conflict with any State law or regulation, the State law or regulation shall control. SECTION 4. The prices indicated are List Price and the NJPA bid complete package discount is 30%off the suggested List Price. This price list does not include chassis pricing,as many of the customer bid requests that we submit have separately purchased the chassis and we supply the equipment package less chassis. We have separately submitted our price lists to Navistar that should also be submitting our pricing. The snow and ice control equipment installation will be at one of Henderson Product's Installation Centers. Henderson has Installation Centers located in New York,New Jersey, Ohio, Illinois and Iowa. NOW, THEREFORE BE IT RESOLVED, that the Village Board hereby, approves the Adopt-A-Highway Agreement with New York State Department of Transportation and be it FURTHER RESOLVED that the Mayor and Village Administrator are hereby authorized to execute and deliver all documents necessary and appropriate to accomplish the purposes of this resolution. I STATE OF NEW YORK DEPARTMENT OF TRANSPORTATION ADOPT-A-HIGHWAY AGREEMENT The New York State Department of Tranennrtation, having offices at SAW MILL RIVER ROAD VALHALLA, NY 10595 (Residency Office Address), hereafter called the "Department" and the organization known as the following and using the mailing address of hereafter called the GROUP, recognize the need for and desirability of a more attractive and litter free State Highway R.O.W. segment as described in the Highway Work Permit, hereafter known as the segment, and are entering into this Agreement to enable the GROUP to contribute toward the effort of maintaining the appearance for the segment. By signature below, the GROUP acknowledges the hazardous nature of the activity and agrees to the following terms and conditions: 1 . No work of any nature will be performed on the pavement or shoulders of the traveled way. 2. No participants' vehicles may be parked on the travel lanes or shoulders of a highway. 3. Activities permitted are of a roadside maintenance nature including, but not limited to, litter pickup; mowing; brush control and cutting; tree trimming and planting; and maintaining approved vegetation; except as modified by the Regional Director. 4. The GROUP will organize and supervise all activities. 5. The GROUP will organize and conduct a "safety briefing." Each day that work is done in the adopted area, a designated safety person must review the safety checklist and have participants sign the safety signature sheet. The designated safety person's sole responsibility must be assuring the safety of the workers and the traveling public. The Department will provide a representative to present the safety briefing for the first meeting; and after that, a designated person from the GROUP will conduct such briefings. 6. All participants must attend the safety briefing before participating in the field activity. The briefings should be held on-site to ensure that all participants are in attendance. 7. Participants must wear Department approved safety gear, including shirts or vests and approved protective head gear. The Department will provide shirts or vests and head gear. The GROUP may provide to itself, Department approved safety gear. The GROUP will pick up supplies and materials from the Residency during normal working hours. 8. Unused materials and supplies will be returned to the Residency during normal working hours within one week following each field activity. 9. The Department will provide for disposal of collected waste from locations specified in the permit. 10. The GROUP will conduct activities at a frequency which will enhance the attainment of the goal, which is to provide a park-like appearance along the adopted facility. Except as modified by the Regional Director, minimum frequency of pick-up along highways is four (4) times a year with the first pick-up occurring in the April-May "spring cleanup" time period and at rest areas or scenic overlooks, the minimum frequency of pickup is weekly. 11. The GROUP will obtain a Highway Work Permit from the Resident Engineer. The Department will waive the permit fee and each GROUP participant (or parent or guardian if participant is 12 to 18 years old) will sign and date the "Acknowledgment of Statutory Limit on Liability" found in S14(29) of the Transportation Law, to be kept on file in the Residency for the duration of the Highway Work Permit. 12. The Department will publicize the execution of this Agreement and will highlight it at various periods thereafter. 13. The Department will furnish and erect Adopt-A-Highway signs at the beginning of each adopted highway segment, or in each adopted rest area or scenic overlook. 14. This Agreement shall be for a two year period commencing on (starting date), and terminating at 12:01 a.m. on (ending date). Notwithstanding any other provision of this Agreement, if in the sole judgment of the Department, it is determined that the GROUP is not meetina the terms and conditions of this Agreement, upon 30 days notice, or summarily if based upon unsafe activity, the Department may terminate this agreement as otherwise provided herein, and take such other action as it deems appropriate. The Department recognizes the GROUP as the adopting organization for segment, and the GROUP accepts the responsibility of picking up litter on the adopted facility and of promoting a litter-free environment in the community for the term of this agreement. The relationship of the GROUP to the Department arising out of this Agreement shall be that of an independent contractor. Any and all members or employees of the GROUP under this Agreement, shall be considered agents of the GROUP, and all claims arising under the Workers' Compensation Law of the State of New York on behalf of said employees while so engaged, and any act or omission on the part of the GROUP employees while so engaged in any of the work or services provided or rendered herein, shall be the sole obligation and responsibility of the GROUP. The GROUP shall secure workers' compensation insurance, for the benefit of, and keep insured during the life of this agreement, such employees engaged therein as are required to be insured by the provisions of the Workers' Compensation Law. Attached hereto and made a part hereof is "Appendix A" Standard Clauses for All New York State Contracts.
