APPROVING AN APPLICATION TO AMEND THE SPECIAL USE PERMIT
FOR THE GASOLINE STATION LOCATED AT 79 SOUTH RIDGE STREET
(AKA 93 SOUTH RIDGE STREET)
VILLAGE OF RYE BROOK BOARD OF TRUSTEES
WHEREAS, the Village of Rye Brook Board of Trustees is considering an
application by property owner Ridge Street Rye Brook, LLC for approval of an amendment
to the existing Special Use Permit for 79 South Ridge Street (aka 93 South Ridge Street) to
expand the hours of operation from 8:OOa.m.-9:OOp.m. to 6:OOa.m.-9:OOp.m., seven days a
week, for the gasoline pumps located on the premises, at the intersection of South Ridge
Street and Bowman Avenue, designated as Parcel ID 141.27-1-13 on the Town of Rye Tax
Map and located in the C-1 Zoning District; and
WHEREAS, the Board of Trustees is the Approval Authority for this application;
and
WHEREAS, the Board of Trustees referred the application to the Rye Brook
Planning Board on October 14, 2014, for preparation of a Report and Recommendations
concerning the application; and
WHEREAS, the Planning Board returned a Report and Recommendations to the
Board of Trustees, adopted November 13, 2014, recommending approval of the application
subject to certain proposed conditions; and
WHEREAS, the Board of Trustees previously determined, by resolution adopted
October 14, 2014, that the application is an Unlisted Action pursuant to SEQRA; and
WHEREAS, on January 13, 2015, the Board of Trustees opened a public hearing on
the subject application, at which time all persons interested were given an opportunity to
speak on behalf of or in opposition to said application, and the Board of Trustees closed the
public hearing on January 13, 2015; and
WHEREAS, the Board of Trustees reviewed the Report and Recommendations of
the Planning Board, and comments the Village Planning Consultant and Village Staff, and
WHEREAS, the Board of Trustees is familiar with the site and all aspects of the
application.

NOW, THEREFORE, BE IT RESOLVED, that the Board of Trustees, in
accordance with Article 8 of the State Environmental Conservation Law and 6 NYCRR Part
617, and upon review of the application materials that were prepared for this action, hereby
adopts the attached Negative Declaration; and be it
FURTHER RESOLVED, that the application for an amendment to the existing
Special Use Permit for 79 South Ridge Street (aka 93 South Ridge Street) is hereby granted
subject to the following conditions:
1. The permitted hours of operation Monday through Saturday each week shall be
between 6:00 A.M. and 9:00 P.M. Permissible hours of operation on Sundays
shall be between 8:00 A.M. and 7:00 P.M.
2. Except as set forth in condition (3), there shall be no overnight storage of motor
vehicles, trucks, trailers, recreational vehicles, boats, snow mobiles or personal
watercraft on the premises outside of the building.
3. No vehicle which is waiting for service or which has been serviced in the service
bays on the premises shall be parked on the premises for a period exceeding 48
hours. This restriction shall not apply to vehicles parked inside the service bays.
4. The lease or rental of utility trailers, rental trucks and automobiles on the premises
is prohibited.
5. The washing or detailing of vehicles on the premises is prohibited.
6. Auto-body work on the premises is prohibited.
7. Gasoline tanker trucks making deliveries to the premises shall not obstruct the
public right-of-way or sidewalks.

BE IT RESOLVED, that the Rye Brook Planning Board hereby adopts the
attached Report and Recommendation to the Rye Brook Board of Trustees on a proposed
Special Permit Amendment modifying the hours of operation for the gas station located
at 79 South Ridge Street (aka 93 South Ridge Street).
REPORT AND RECOMMENDATION FROM THE RYE BROOK PLANNING
BOARD TO THE RYE BROOK BOARD OF TRUSTEES ON A PROPOSED
SPECIAL PERMIT AMENDMENT FOR PROPERTY AT 79 SOUTH RIDGE
STREET (AKA 93 SOUTH RISGE STREET)
I. APPLICATION OVERVIEW
The Rye Brook Board of Trustees (the "BOT") is currently considering an
application by Ridge Street Rye Brook, LLC for approval of an amendment to the
existing Special Use Permit for the gas station located at 79 South Ridge Street (aka 93
South Ridge Street) to increase the hours of operation for the property from 8:00a.m.-
9:00p.m. to 6:00a.m.-9:00p.m. seven days a week. On October 15, 2014, the BOT
referred the application to the Planning Board for consideration and for a report and
recommendation thereon.
II. DISCUSSION
The Planning Board members reviewed and discussed the application at the
Planning Board's meeting on November 13, 2014, at which time the Village staff and
Village consultants also provided input.
III. RECOMMENDATIONS
Based on discussions as its November 13, 2014 meeting, the Planning Board
hereby recommends that the BOT approve the application, with the following
recommendations:
1. The Board, in preparation of this Report and Recommendation, has reviewed
the Special Use Permit and the amendment thereto for the gas station formerly
located across the street at 105 South Ridge Street (now TD Bank). That
permit, as amended, granted hours of operation of 6:OOAM to 9PM, Monday
through Saturday, and 8:OOAM to 7:OOPM on Sundays. The Board, therefore,
recommends that the same hours of operation be approved for the instant
Special Use Permit for 79/93 South Ridge Street.
2. The Board recommends that the following additional conditions be imposed
and/or restated on the amended Special Use Permit as these conditions, or
similar conditions, were placed on the original Special Use Permit granted for
the premises:
a. Except as set forth in condition (b.), there shall be no overnight storage
of motor vehicles, trucks, trailers, recreational vehicles, boats, snow
mobiles, or personal watercraft on the premises outside of the building.
b. No vehicle which is waiting for service or which has been serviced in
the service bays on the premises shall be parked there for a period

This application, by Thomas Ceraso, .pertaining to Lot 7
B 1, Block 20, Section 1, in the Town of Rye, is deemed an applica-
t .on fo a variance from the requirements of Section 66-6G (5d) of
the Zoning Ordinance of the Town of Rye which permits parking on
an €; @i st rJ i ct. parr:el of land contiguous to the boundary of a C
district, parcel of land, only if the affected lot "- -is contiguous
of not more than one (1) property line thereof to a side lot line
in an R District, - -", because the affected lot is contiguous to
two (2) side lot lines.

Jurisdiction over the matterbrought before it is vested
in it. by Section 66-13 of the Zoning Ordinances of the Town of
Rve.
The affected .parcel of land is approximately 43 feet in
i
width and 103 feet in depth and the legal objection to the proposed
i
I
use as a parking lot stems from the fact that both the eant and
north 0ounda.ries of the property (i.e. two property lines) are j
i
contiguous to side lot lines of properties lying within an.R district !
as does the property in question. The requested use is a permitter)
i
use. (Ordinance 66-6G (5d) ) , the property is adjacent to a C zone
plot of land and is across the street from property for which a
special use permit has been granted for the construction of a new
gas service station to replace one existing there before.
The proposed use of the property is to alleviate a con-
q(nsted parking condition which resulted in prohibition of parking
on Boww. ;n i1verue upon which the property fronts, which in turn has

resulted in creation of greater congestion on Division Street which

The boundaries of the property in question adjacent to the
' R district parcels of land affected thereby are now separated from
said parcels by a. hedge and chan link fance.

The testimony showed that increased parking facilities were
r�\
required for the increased volume of business done by the applicant
in connection with the servioe station a djacan:t to the property in
question and that the demolition of the existing frame house-would,
because of its deteriorated .condition, be an.improvement benefiting
" the entire neighborhood.
The Board of Appeals, .therefore, finds the following:
1. For the property to be used for the permitted purposes
of parking of motor vehicles, a variance is required from the pro-
visions of 66-6G (5d) because the property is contiguous to more
than one side lot line of an R district lot.
2. The granting of the variance requested will be in
harmony with the general purposes of the ordinance in question,
will not be injurious to the neighborhood or detrimental to the
best interest of the public welfare or the best interest of the
Town of Rye.
3. The granting of the variance will not cause an increase
in traffic hazards in the area unless ingress and egress to, the
property is permitted by means of the existing curb cut on Bowman
Avenue. _

4. To permit the contemplated use will alleviate con-
gestion and resulting traffic hazards on biviasion Street and will,
therefore, benefit the owners of the properties abutting on uai.d
street.
Therefore, the application for a variance is granted by the
unanimous vote of the Board of Appeals of the Town of Rye, (one member

1< The existing structure on the premises is to be demolish-
ed and the entire property covered with: black-top in accordance with j
all rules and regulations and requirements of the ordinances of tom_

of passenger vehicles (a) of employee's during the hours of their em-
ployment, and (b) which are waiting to be serviced or returned after

commercial vehicles, parking of vehicles for a fee, nor for the 1
servicing, repair or washing of vehicles in any manner. No vehiries

The matter of the application of Thomas Ceraso for the
issuance of a Special Use permit for the erection of a gasoline '
t station was taken up by the members of the Town gpard.
After a complete review of the testimony as offered at
the hearing, and after several of the members ha expressed their :j
p11 ersonal opinions with respect to the application and the erection�i
of a gas station on the property in question, it was decided that
t
before coming to a definite conclusion, several cjuastions would
be asked of Mr. Ceraso and his attorney so that is full and com-
ple to understanding could be had by the members 'f the Town Board
with respect to Mr. Cerisso's operation, and thaC he, Mr. Ceraso,
would have a full and complete understanding of knot only the
definition of °gasoline station° as contained inithe Code, but,

with respect to said permission.
Mr. Lerner, answering on behalf of 11ri Ceraso, who was
in the room, as was Mr. David Kahn, his other a'torney, answered
that the type of operation contemplated by leis client was the use
as defined in the Code under "Gasoline Service Station"; that the

only work that would be done would be as follows: (1) the sell-
ing of gasoline; (2) tuning up of motors, if requested by custo-
mers; (3) possibly a brake relining job; that certainly his
client would not and did not contemplate, and knew he could not
take apart an automobile and completely rebuild it or fix a car
i ' that had been in a smash up, or in any way shape or manner do an
body work or fender work or painting. lIe understood fully that
9 + he could not put in a minute wash in the garage, but asked the
j members if they felt there would be any objection to washing a car
of a customer occasionally, but told the members of the Board that
!, his client frowned upon the washing of cars and discouraged his
��. customers from requesting the same.
He further informed the Board that there would be ab-
? solutely no storaf;e of automobiles in the garage proper and he
I:
was using the building because it was there; that if permission
,r
were granted to operate a gas station and if he was successful
in his business, he hoped eventually to tear down the present
building and erect a modern gasoline station.
He further assured the members of the Board that if
perniission were granted that he would run a good, clean station
that would be a credit to the community and would certainly run
` it in conformance with the rules and regulations as outlined by
+ i the Planning Board.

Dir. Lerner, in answer to a question, and Mr. Ceraso,
both informed the Supervisor that they understood definitely that
{`I1 if this Special Use Permit were granted it would be a revokable
i
permit and should the person to which it was granted violate any
of its terms, that the permit could be revoked. Also, tie fully

X understood that if the permit were granted that he was to re-
submit to the Planning Board for their complete approval fully
j completed plans and specifications; that, in addition, he was to
secure from the County once again full and complete approval of
I; his plans and specifications showing the nature of his operation,

He was further informed and said that he fully under-

stood that no building Permit would be ,issued until the aforesaid
Y plans which were to be complete in every detail , had been approvedi
by the Planning Board and any other agency, including the County,
i' which had to make approval of an operation of this type. In ad-

^s dition, the Building Inspector was notified in the presence of Mr.
1 Ceraso and his attorney that no occupancy permit was to be issued i
until every last detail as shown on the approved plans and spec-
ifications

trees, etc.
!, After this full and complete discussion with Mr. Ceraso
i and his attorney, Mr. Perschlce voiced his opinion that he car-
tainly saw no harm in the granting of a Special Use Permit, part- �.
icularly with the restrictions as outlined and recommended by the

issuance of a Special Use Permit for the erection of a gasoline ,
y station was taken rip by the members of the Town Board.
After a complete review of the testimony as offered at
y the hearing, and after several of the members had expressed their
personal opinions with respect to the application and the erection,
of a gas station on the property in question, it was decided that
before coming to a definite conclusion, several questions would
be asked of Mr. Ceraso and iris attorney so that a full and
com-plete understanding could be had by the members of the Town Hoard
with respect to Mr. Cerasors oporation, and that he , Mr. Ceraso,
y, would have a full and complete understanding of not only the

definition of "gasoline station" as contained in t-jle Code, but, I
I` and the members not having yet made up their minds, should they
? decide in favor of the applicanL. what the conditions would be
with respect to said permission.
Mr. Lerner, answoring on behalf of Mr. Ceraso, who was
I in the room, as was Mr. David Icahn, his other attorney, answered

that the type of operation contemplated by his client was the use
1 as defined in the ('ode under "Gasoline Service Station" ; that the

only work that would be done would be as follows: (1) the sell-
ing of gasoline; (2) tuning up of motors, if requested by custo-
mers; (3) possibly a brake relining job; that certainly his
r
client would not and did not contemplate, and knew lie could not
! � take apart an automobile and completely rebuild it or fix a car
� j that had been in a smash up, or in any way shape or manner do an
body work or fender work or painting. 1Ie understood fully that
he could not put in a minute wash in the garage , but asked the
members if they felt there would be any objection to washing a car
of a customer occasionally, but told the members of the Board that 3

his client frowned upon the washing of cars and discouraged his

customers from requesting the same.
He further informed the Board that there would be ab-
i solutely no storage of automobiles in the garage proper and he

�i. was using the building because it was there; that if permission
were granted to operate a gas station and if he was successful
111 in his business , lie hoped eventually to tear down the present
lr, building and erect a modern gasoline station.

He further assured the members of the Board that if

permission were granted that lie would run a good , clean station

f that would be a credit to the community and would certainly run
it in conformance with the rules and regulations as outlined by
the Planning hoard.
r., Mr. Lerner, in answer to a question, and Mr. Ceraso,
+= both informed the Supervisor that they understood definitely tha '
if this Special Use Permit were granted it would be a revokable
sff'� permit and should the person to which it was granted violate any

understood that if the permit were granted that lie was to re-
submit to the Planning Board for their complete approval fully

property which places you in jeopardy of forfeiting the zoning variance granted to the property in
1967; allowing the use of the residential lot for the parking of motor vehicles. I have attached a
copy of the conditional variance dated May 8, 1967 hereto for your convenience.
I call your attention to page 3, condition 4 which requires chain link fencing&dense hemlock
screening along the north& east side of the lot in question. Please note that there is no fencing at
this location whatsoever, and the plantings, some of which have died or been cut down can no
longer be described as dense. Further note condition 6 which restricts the use of the lot for
temporary parking of passenger vehicles of employees and customers awaiting service or
returned after servicing, and expressly forbids the storage or parking of any commercial vehicles.
Clearly the enclosed photos show at least three commercial vehicles parked illegally, as well as
multiple vehicles without license plates, and even a vehicle under a car cover indicating long-
term storage.
By way of this letter&attached Notice of Violation you are hereby directed to remove all zoning
violations and seek to restore the missing fence&plantings immediately as conditioned in the
variance resolution. Be advised that your failure to make all necessary corrections to the
satisfaction of the Building Department by December 12,2014 will result in the issuance of a
summons(s)to appear before a Judge in Rye Town Court and the revocation of the zoning
variance. Upon such revocation you will be required to remove all paving, site lighting,and
anything else that does not comply with the zoning code,then properly crown& seed the lot
effectively returning it to a vacant building lot in the 2-Family Zoning District.

WHEREAS, on December 18, 2014 the Village of Rye Brook received a
request from the Rye Brook Youth Soccer Club Treasurer, on behalf of their
Executive Board, to make a donation in the amount of$5,000 to the Friends of Rye
Brook, Inc., to be set aside and used only to offset the costs related to maintaining
and improving the King Street athletic turf field; and
WHEREAS, the Village Board, as Directors of the Friends of Rye Brook,
Inc. is interested in accepting this generous donation for this important purpose.
NOW THEREFORE BE IT RESOLVED, that the Village Board of the
Village of Rye Brook, as Directors of the Friends of Rye Brook, Inc., hereby accepts
the donation of$5,000 from the Rye Brook Youth Soccer Club; and be it further
RESOLVED, that this generous donation shall be set aside and used only to

Chapter 240. VEHICLES AND TRAFFIC
Article III. Parking, Stopping and Standing
§ 240-20.1. Overnight parking licenses.
[Added 11-26-2002 by L.L. No.11-2002]
A. Ten parking licenses that authorize overnight parking in the parking lot serving Garibaldi Park
(hereinafter"Garibaldi Parking Lot'o shall be available to the residents of the Village of Rye Brook.
Proof of residency is required. No more than two licenses shall be issued to residents who reside at
the same address.The fee for the parking licenses shall be established by the Board of Trustees by
resolution.These licenses shall not be available to park commercial vehicles or taxis.
B. The provisions of this subsection shall apply only to the first 10 parking licenses issued.The Village
Clerk will set a deadline for the filing of an application for a parking license.
(1) If the Village Clerk receives more than 10 applications for a parking license by the application
deadline,he will conduct a lottery to determine who will receive the parking licenses and the
order of the applicants on the waiting list for the parking licenses.The date and location of the
lottery shall be noticed as determined by the Village Administrator,and the lottery shall be
conducted in public.After the lottery,the parking licenses will be issued upon the receipt of the
applicable fee from the selected applicants.
(2) If the Village Clerk receives 10 or less than 10 applications for a parking license by the application
deadline,he will issue the parking licenses on a first-come,first-served basis until 10 licenses have
been issued.After the loth license is issued,the Village Clerk will start a waiting list for the
parking licenses that will be added to on a first-come,first-served basis.
C. The parking licenses may be renewed each year by filing a new application and paying the applicable
fee by October 1. It is the responsibility of the holder of a license to renew it. No renewal will be
processed after October 1.Any parking license that is not renewed by October 1 shall be issued to the
person at the top of the waiting list upon his or her payment of the applicable fee.
D. After the first 10 parking licenses have been issued,the residents of the Village of Rye Brook may be
added to the waiting list on a first-come,first-served basis by filing a parking license application with
the Village Clerk.
E. From November 15 to March 15 each year,the holder of a parking license issued by the Village Clerk
under this section may park his/her vehicle in one of the 10 parking spaces on the western side of the
Garibaldi Parking Lot only between the hours of 10:30 p.m.to 7:30 a.m.The vehicles licensed to use
these parking spaces shall be parked with their headlights directed to the western curb of the parking
lot.
F. The parking licenses shall be revocable at the discretion of the Village Administrator.The holder of a
parking license may not assign,license or otherwise transfer it to another party nor otherwise permit

anyone other than a member of his or her immediate family to use the authorized parking space. By
accepting a parking license,the holder thereof agrees to:
(1) Indemnify and hold harmless the Village of Rye Brook for any injury or property damage he or
she sustains as a result of the use of the Garibaldi Parking Lot pursuant to the license;and
(2) Indemnify the Village for any damages it sustains as a result of the holder's use of the Garibaldi
Parking Lot pursuant to the parking license.
G. The parking licenses shall be subject to the conditions set forth in this section of the Village Code as
well as the conditions set forth in the permit application form adopted by the Village Clerk.
H. All determinations concerning the issuance and/or revocation of a parking license shall be made by
the Village Administrator in his sole discretion,and his determination shall be final.

CONSIDERING APPROVAL OF AN INTERMUNICIPAL AGREEMENT
WITH THE COUNTY OF WESTCHESTER EMPLOYEE ASSISTANCE
PROGRAM AND THE VILLAGE OF RYE BROOK
RESOLVED, that the Village of Rye Brook is authorized to enter into an
Inter-Municipal Agreement with the County of Westchester Employee Assistance
Program for administrative, managerial and referral services for the period of
January 1, 2015 to December 31, 2019 at a rate of forty-five dollars ($45.00) per
employee per year; and
BE IT FURTHER RESOLVED, that the Mayor is hereby authorized to
execute and deliver all necessary documents appropriate to accomplish the purposes
of this resolution; and be it
BE IT FURTHER RESOLVED, that the Village is herby authorized to
release funds totaling three thousand two hundred and forty dollars ($3,240) to honor
the Inter-Municipal Agreement for the 2015 calendar year.

THE COUNTY OF WESTCHESTER, a municipal corporation of the State of
New York having its principal place of business in the Michaelian Office
Building, 148 Martine Avenue, White Plains, New York 10601 (hereinafter
referred to as the "County"),
Acting by and through its Department of Community Mental Health(hereinafter
referred to as the "Department"),
and
VILLAGE OF RYE BROOK, having an office and place of business at 938 King
Street, Rye Brook, New York 10573 (hereinafter referred to as the "Agency")
WITNESSETH
WHEREAS, the County and Agency desire to enter into an agreement to provide
services under Article 25 (Funding For Substances Abuse Services) and Article 41 (Local and
Unified Services) of the New York Mental Hygiene Law; and
WHEREAS pursuant to the provisions of Articles 25 and 41 of the New York Mental
Hygiene Law, the County receives funding from the State and local municipalities, among
others, for preventive, rehabilitative and treatment service programs for the mentally ill, the
mentally retarded, the developmentally disabled and those suffering from alcohol and substance
abuse. Pursuant to Article 41, the County also operates an Employee Assistance Program, which
provides services to various municipalities and school districts within Westchester and Putnam
counties; and

WHEREAS, the Agency has indicated it would like to receive these services.
NOW, THEREFORE, the parties hereto in consideration of the premises and of the
covenants, agreements, terms and conditions herein contained do agree as follows:
Section 1. The Department shall provide services under Article 25 (Funding For
Substances Abuse Services) and Article 41 (Local and Unified Services) of the New York
Mental Hygiene Law to the Agency and shall also render Employee Assistance Program services
(hereinafter collectively the "Services") to the Agency as more particularly described in
Schedule "A" which is attached hereto and made a part hereof.
Section 2. In consideration of the Services to be provided to the Agency by the
Department pursuant to Paragraph"1" above, the Agency shall pay to the County a fee of$45
per employee per year as more fully set forth in Schedule "B" which is attached hereto and made
a part hereof.
Any and all payments to be made, including any partial payment made in proportion
to the provision of Services, shall be made on a monthly basis within 15 days of submission of
an invoice submitted by the Department.
Section 3. All records compiled by the Department in completing the work described
in this Agreement, including but not limited to evaluation, progress notes, written reports,
studies, drawings, computer printouts, graphs, charts, and all other similar recorded data, shall
become and remain the property of the Department.

Section 4. This Agreement shall commence on January 1, 2015 and shall expire on
December 31, 2019.
Section 5. The Agency agrees to procure and maintain insurance naming the County
as additional insured, as provided and described in Schedule "C", entitled "Standard Insurance
Provisions", which is attached hereto and made a part hereof. In addition to, and not in
limitation of the insurance provisions contained in Schedule "C", the Agency agrees:
(a) that except for the amount, if any, of damage contributed to, caused by, or
resulting from the negligence of the County, the Agency shall indemnify and hold harmless the
County, its officers, employees, agents, and elected officials from and against any and all
liability, damage, claims, demands, costs,judgments, fees, attorney's fees or loss arising directly
or indirectly out of the performance or failure to perform hereunder by the Agency or third
parties under the direction or control of the Agency; and
(b) to provide defense for and defend, at its sole expense, any and all claims,
demands or causes of action directly or indirectly arising out of this Agreement and to bear all
other costs and expenses related thereto.
Section 6. Confidentiality of Records:
(a) The Department and the Agency shall observe and require the observance of
applicable Federal and State requirements relating to confidentiality of records and information.
The Department and the Agency agree not to allow examination of records or the disclosure of
information except as herein set forth or as may be required by applicable Law.

(b) The Department and the Agency shall fully inform their own staff members to
observe and require the observance of applicable Federal and State requirements relating to
confidentiality of records and information.
(c) The Department and the Agency shall implement the following procedures for the
purpose of safeguarding information and ensuring the protection and confidentiality of said
information.
(1) Records containing individually identifiable information shall be marked
"confidential" and kept in locked files or in rooms that are locked when the records
are not in use.
(2) When in use, records shall be maintained in such a manner as to prevent exposure of
individual identifiable information to anyone other than the authorized party directly
utilizing the case record.
(3) Records shall be transmitted from one location to another in a sealed envelope
stamped "confidential" and a receipt shall be obtained documenting delivery of said
records. Records may be removed from Department's work locations only with the
prior written permission of the Commissioner.
(4) Interviews with clients shall be conducted at a location and in a manner which
maximizes privacy.
(5) The Agency consistent with applicable statute and regulation shall have access to the
following:
• All identifiable information released with client's consent.
• Information released is usually within the context of a supervisor's referral.
• Released information normally includes information regarding compliance
with Employee Assistance Program services and treatment and client's
medical clearance to return to work
Section 7. The Agency expressly agrees that neither it nor any contractor,
subcontractor, employee, or any other person acting on its behalf shall discriminate against or
intimidate any employee or other individual on the basis of race, creed, religion, color, gender, age,

national origin, ethnicity, alienage or citizenship status, disability, marital status, sexual
orientation, familial status, genetic predisposition or carrier status during the term of or in
connection with this Agreement, as those terms may be defined in Chapter 700 of the Laws of
Westchester County. The Agency acknowledges and understands that the County maintains a zero
tolerance policy prohibiting all forms of harassment or discrimination against its employees by co-
workers, supervisors, vendors, contractors, or others.
Section 8. Either party may cancel this Agreement upon ten(10) days prior written
notice to the other by certified mail.
Section 9. All notices, requests, demands or other communications required or
permitted to be given hereunder shall be in writing and shall be deemed given when delivered by
hand or mailed postage prepaid, certified mail, return receipt requested, addressed as follows:

Upon contact from a supervisor or a self-referred employee, the local Employee Assistance
Program coordinator will contact the County Employee Assistance Program;
a) County Employee Assistance Program staff will make an appointment for the employee
and assign a counselor for the contact;
b) The Counselor will interview the employee and complete appropriate assessment and
referral services;
c) County Employee Assistance Program staff will monitor the employee's progress in
treatment;
d) The counselor will provide appropriate follow-up to the local Employee Assistance
Program coordinator or other designated supervisory staff.

SCHEDULE "B"
BUDGET
VILLAGE OF RYE BROOK
The Inter-Municipal Agreement ("IMA") will be for a term of five years
commencing on January 1, 2015 and shall expire on December 31, 2019.
Village of Rye Brook shall pay to the County a fee of $45 per employee for
all five years.
For the purpose of this Agreement, Village of Rye Brook represents that as
of the date hereof Village of Rye Brook has 72 employees and the total
amount for 2015 is $3,240. The fee for 2015 shall be paid upon
acceptance of this agreement. The total amount billed by Westchester
County Department of Community Mental Health for years 2016 through
2019 shall be based on a head count supplied by Village of Rye Brook in
December of the preceding year and shall be paid in January of each
subsequent year.

SCHEDULE "C"
STANDARD INSURANCE PROVISIONS
1. Prior to commencing work, the Agency shall obtain at its own cost and expense the required
insurance from insurance companies licensed in the State of New York, carrying a Best's financial
rating of A or better, and shall provide evidence of such insurance to the County of Westchester, as
may be required and approved by the Director of Risk Management of the County. The policies or
certificates thereof shall provide that thirty days prior to cancellation or material change in the
policy, notices of same shall be given to the Director or Risk Management of the County of
Westchester by registered mail, return receipt requested, for all of the following stated insurance
policies. All notices shall name the Agency and identify the Agreement.
If at any time any of the polices required herein shall be or become unsatisfactory to
the County, as to form or substance, or if a company issuing any such policy shall be or become
unsatisfactory to the County, the Agency shall upon notice to that effect from the County, promptly
obtain a new policy, submit the same to the Department of Risk Management of the County of
Westchester for approval and submit a certificate thereof. Upon failure of the Agency to furnish,
deliver and maintain such insurance, the Agreement, at the election of the County, may be declared
suspended, discontinued or terminated. Failure of the Agency to take out, maintain, or the taking
out or maintenance of any required insurance, shall not relieve the Agency from any liability under
the Agreement, nor shall the insurance requirements be construed to conflict with or otherwise limit
the contractual obligations of the Agency concerning indemnification. All property losses shall be
made payable to and adjusted with the County.
In the event that claims, for which the County may be liable, in excess of the insured
amounts provided herein are filed by reason of any operations under the Agreement, the amount of
excess of such claims or any portion thereof, may be withheld from payment due or to become due
the Agency until such time as the Agency shall furnish such additional security covering such
claims in form satisfactory to the County of Westchester.
2. The Agency shall provide proof of the following coverage (if additional
coverage is required for a specific agreement, those requirements will be described in the "Special
Conditions" of the contract specifications):
(a) Workers' Compensation. Certificate form C-105.2 (9/07) or State Fund
Insurance Company form U-26.3 is required for proof of compliance with the New York State
Workers' Compensation Law. State Workers' Compensation Board form D13-120.1 is required for
proof of compliance with the New York State Disability Benefits Law. Location of operation shall
be "All locations in Westchester County,New York."
Where an applicant claims to not be required to carry either a Workers'
Compensation Policy or Disability Benefits Policy, or both, the employer must complete NYS form
CE-200, available to download at: www.wcb.state.ny.us (click on Employers/Businesses, then
Business Permits/Licenses/Contracts to see instruction manual).

If the employer is self-insured for Worker's Compensation, he/she should present
a certificate from the New York State Worker's Compensation Board evidencing that fact (Either
SI-12, Certificate of Workers' Compensation Self-Insurance, or GSI-105.2, Certificate of
Participation in Workers' Compensation Group Self-Insurance).
(b) Employer's Liability with minimum limit of$100,000.00.
(c) Commercial General Liability Insurance with a minimum limit of liability per
occurrence of$1,000,000.00 for bodily injury and $100,000.00 for property damage or a combined
single limit of$1,000,000.00 (c.s.l.), naming the County of Westchester as an additional insured.
This insurance shall include the following coverages:
(i) Premises- Operations
(ii) Broad Form Contractual
(iii)Independent Contractor and Sub-Contractor
(iv)Products and Completed Operations
(d) Automobile Liability Insurance with a minimum limit of liability per occurrence
of $1,000,000.00 per occurrence for bodily injury and a minimum limit of $100,000.00 per
occurrence for property damage or a combined single limit of $1,000,000.00 unless otherwise
indicated in the contract specifications. This insurance shall include for bodily injury and property
damage the following coverages:
(i) Owned automobiles.
(ii) Hired automobiles.
(iii) Non-owned automobiles.
(e) Professional Liability. The Agency shall provide proof of such insurance
(limits of$1,000,000.00 per occurrence/$3,000,000.00 aggregate).
3. All policies of the Agency shall be endorsed to contain the following clauses:
(a) Insurers shall have no right to recovery or subrogation against the County of
Westchester(including its
employees and other agents and agencies), it being the intention of the parties that the insurance
policies so effected shall protect both parties and be primary coverage for any and all losses covered
by the above-described insurance.
(b) The clause "other insurance provisions" in a policy in which the County of
Westchester is named as an insured, shall not apply to the County of Westchester.
(c) The insurance companies issuing the policy or policies shall have no recourse
against the County of Westchester (including its agents and agencies as aforesaid) for payment of
any premiums or for assessments under any form of policy.
(d) Any and all deductibles in the above described insurance policies shall be
assumed by and be for the account of, and at the sole risk of,the Agency

CONSIDERING ENTERING INTO AGREEMENTS FOR THE
2015 RYE BROOK SPRING CARNIVAL EVENT
WHEREAS, the Village of Rye Brook Parks and Recreation Department
desires to hold a carnival featuring amusement rides,games and food May 8, 9 and 10,
2015;and
WHEREAS, Request for Proposal's (RFP) were solicited from carnival
vendors and posted on Empirebids.com and three(3)proposals were submitted;and
WHEREAS, after review of the RFP's by the Parks and Recreation
Superintendent and the Village Administrator it was determined that All Star Midway
of Port Jefferson Station,NY submitted the most desirable proposal.
NOW, THEREFORE BE IT RESOLVED, that the Village of Rye Brook is
hereby authorized to enter into an agreement with All Star Midway of Port Jefferson
Station,NY to run a carnival event for the Village of Rye Brook from May 8th through
May 10,2015;and be it
FURTHER RESOLVED, the agreement is subject to the approval of the
village attorney for insurance and indemnification provisions;and be it
FURTHER RESOLVED, the All Star Midway agreement is subject to
approval of agreements, insurance and indemnification with Rye King Associates, Inc.
(900 King Street) and the Arbors Homeowners Association, Inc. in a form acceptable
to the village attorney;and be it
FURTHER RESOLVED, that the Mayor and Administrator are hereby
authorized to execute and deliver all documents necessary or appropriate to execute the
agreements with All Star Midway, Rye King Associates, Inc. and the Arbors
Homeowners Association.

RESOLUTION
CONSIDERING A TRANSFER OF FUNDS AND AUTHORIZATION FOR
EMERGENCY REPAIRS TO THE RYE BROOK FIRE LADDER
WHEREAS, Rye Brook Fire Ladder 30 (a 1998 "Quint"), one of two primary fire truck
response vehicles for the Village of Rye Brook, was taken to Stewart and Stevenson, an
authorized Atlantic Detroit Diesel repair location in Lodi, NJ in December 2014 where it
was determined that a major overhaul of the engine and possibly a transmission repair
was needed and a quote was provided to the village; and
WHEREAS, this emergency work is necessary for the safe operation and availability of
Ladder 30; and
NOW THEREFORE BE IT RESOLVED, that the Village Board hereby authorizes the
necessary repairs of Ladder 30 on an emergency basis based on the quotes received by
Stewart and Stevenson, an authorized Atlantic Detroit Diesel repair location in Lodi, NJ;
and be it further
RESOLVED, that the following budget modification be hereby approved for these
authorized repairs:
