Advisory Council on Environmental Conservation
June 17, 2008 Meeting
A special meeting of the Council was held on June 17, 2008 at 8:05 PM at the Village offices with
Harvey M. Schiller, Chair, presiding.
As it is our custom to rotate the position of our Meeting Secretary, our newest member, David
Bacchioni, was introduced and appointed Meeting Secretary for this meeting. Present were
Council Members: Bacchioni, Schiller, Simon and Veith-Heib. Excused were members: Heller.
and Raphael.
Junior Civil Engineer Michal Nowak was present as our Village liaison representative.
Also present were property owners: Susan Mandel, Jeff Weintraub and Vincent .
Butkiwicz.
The minutes of the previous meeting, Dec. 18, 2007, were unanimously approved as presented.
Purpose of the meeting was Public Hearing on Appeals for the "Denial of Tree Removal Permits"
on the following cases.
A. Vote on proposed removal of Significant Trees (over 30"' DBH). Approval required of this
Council according to Code 235-21A.
1. Mandel residence located at 3 Eagles Bluff, review an application for the removal of a 34"
DBH Oak tree.
Discussion
Porto asked if there were any bird's nests and the response by Susan Mandel was: no.
Veith-Heib questioned the loss of limbs the tree had suffered and the response from Susan
Mandel was there had been significant loss over time but none during recent heavy storms.
Action
Motion by Simon: Approval of removal of said Oak tree with the condition that an oak tree (with at
least a 2" caliper) be planted in close proximity to the removed tree. Motion was seconded by
Porto.
Vote: Schiller yes; Porto yes; Viet-Heib yes; Simon yes; Bacchioni yes
Motion to APPROVE Permit Granted.

2. Wientraub residence located at 11 Latonia Road; review an application for the removal of a
51" DBH Ash tree.
Discussion
Porto asked if there were any bird's nests in the tree and the response by Jeffrey Weintraub was:
no.
Veith-Heib was concerned with the loss of such a large Ash tree and questioned what type and
how many trees would be planted. There was a concern by Weintraub about the type of tree(s)
that could be planted due to the lack of space and the amount of shade on the property.
Action
Motion by Simon: Approval of removal of said Ash tree with the condition that an American Holly
(at least 7-8' tall) and two other trees (with at least a 2" caliper) be planted on the property. Motion
was seconded by Bacchioni.
Vote: Schiller yes; Porto yes; Viet-Heib yes; Simon yes; Bacchioni yes.
Motion to APPROVE Permit Granted
B. Review an appearance ticket issued By the Rye Brook Police Dept. for the property located at
38 Woodland Drive. There were 2 trees removed in the rear and the result was a stump from a
Beech tree 32"wide and an Oak tree stump 40"wide. The matter is on the court calendar for
June 19, 2008. The Court requested a recommendation by our Advisory Council under Section
235-18 for a decision.
Discussion
Most of the discussion dealt with which tree service was used. There was no answer. The
property owner Vincent Butkiewicz, new to the area, admitted his error.
Recommendation to the Court
The property owner Vincent Butkiewicz be fined $500 and plant 3 new trees, a Pin oak, a White
oak and a Black gum, each with at least a 2" caliper.
Vote: Schiller yes; Porto yes; Viet-Heib yes; Simon yes; Bacchioni yes.
Motion to recommendation to Court: APPROVED
New Business
A. Simon proposed that Section 235-14F be changed from a "majority of the total authorized
voting power" to read a "majority vote of the attending quorum". Change of Village Code 235
Trees would be required.
B. Veith-Heib is concerned with the increased flooding problems in the Village. It was agreed
that a separate meeting be held to discuss.
Chair adjourned the meeting at 9:10pm
