MINUTES OF A MEETING VILLAGE OF RYE BROOK BOARD TRUSTEES VILLAGE HALL, 938 KING STREET RYE BROOK, NEW YORK TUESDAY, JULY 11, 2004—'7:30 P.M. CONVENE MEETING: The Meeting was called to order at 7:30 p.m. by Mayor Francis Filipowski in the Meeting Room, and the Pledge of Allegiance followed. The following members of the Board of Trustees were present: Mayor Francis L. Filipowski Trustee Donald E. Degling Trustee Jody H. Brackman Trustee Roger Herman Trustee Lawrence Rand Village Staff attending the meeting were: i Village Administrator, Christopher J. Russo Village Attorney, Kenneth E, Powell Village Consultant, Christian Miller Assistant to the Administrator, Charles Perctz Meeting Secretary, Paula Patafio Mayor Filipowski noted that the Board was going to make a special presentation. He asked Joey Fiscella, and his family, to come up to the podium. The Mayor noted that Joey recently won Stock Division Soap Box Derby was which held on June 11,2000 in White Plains,New York. He competed against residents from the Rockland and Westchester Countries, ranging in ages from 9 to 16, . He will now travel to the Soap Box Derby World Championship in Akron, Ohio which is scheduled for July 22, 2000, Mayor Filipowski presented Joey with a plaque, congratulated him on his accomplishment, and wished him luck for the Championship. Mayor Filipowski then moved to the agenda portion of the meeting. He called for the first item. 1 I RESOLUTIONS: 1. AUTHORIZING TREASURER TO SIGN CIVIL SERVICE DOCUMENTS ON BEHALF OF APPOINTING AUTHORITY. Mr. Christopher Russo, Village Administrator, read the following Resolution: RESOLUTION AUTHORIZING TREASURER TO SIGN CIVIL SERVICE DOCUMENTS ON BEHALF OF APPOINTING AUTHORITY RESOLVED,that Diane DiSanto, Treasurer of the Village of Rye Brook, is authorized to execute and deliver any and all civil service documents on behalf of the Board of Trustees of the Village of Rye Brook, which may be required to be submitted to the Westchester County Personnel Office in connection with Village of Rye Brook personnel matters. On a motion made by Trustee Degling,and seconded by Trustee Brackman, Mr.Russo called the role: ! AUTHORIZING A REIMBURSEMENT TO THE TOWN OFRYE FORPAYMENTS MADE TO AN APPRAISER. Mr. Russo read the following Resolution: RESOLUTION AUTHORIZING PAYMENTS TO TOWN OF RYE FOR SERVICES OF A SPECIAL APPRAISER RESOLVED,that the Board of Trustees of the Village of Rye Brook authorizes the payment in the amount of $2000.00 to the Town of Rye for appraisal services rendered by Elliot Glaser, in connection with the defense of a tax certiorari matter and certain Pfizer/Doral Arrowwood and BelleFair real property valuation matters. 2 On a motion made by Trustee Rand, and seconded by Trustee Degling, Mr, Russo called the role: Trustee Brackman Voting Aye Trustee Degling Voting Aye Trustee Herman Voting Aye Trustee Rand Voting Aye Mayor Filipowski Voting Aye 3. AUTHORIZING USE OF VILLAGE STREETS FOR THANKSGIVING DAY TURKEY TROT. Mr. Russo read the:Resolution. RESOLUTION AUTHORIZING USE OF VILLAGE STREETS FOR THANKSGIVING DAY TURKEY TROT RESOLVED,that the Board of Trustees of the Village of Rye Brook authorizes the use of Village streets on November 23, 2000 from 9:00 a.m. to 11:00 a.m. for the Ninth Annual American Red Cross Thanksgiving Day Turkey Trot along the route described in the letter dated June 22,2000 from Michael 1. Stolrar, Mr. Russo called the role: Trustee Brackman Voting Aye Trustee Degling Voting Aye Trustee Herman Voting Aye Trustee Rand Voting Aye Mayor Filipowski Voting Aye The next item was called before the Board. 4. CREATING POSITION OF DEPUTY VILLAGE CLERK AND APPOINTING CHARLES E. Pii RETZ TO SUCH POSITION. Mr. Russo read the Resolution. REJ,SOLUTION 3 i CREATING POSITION OF DEPUTY VILLAGE CLERK AND APPOINTING CHARLES E. PERETZ TO SUCH POSITION WHEREAS,the Board of Trustees wishes to ensure continuity in the duties of Village Clerk during times the Village Clerk is absent or unavailable. NOW THEREFORE BE IT RESOLVED, that the position of Deputy Village Clerk is hereby created and Charles E. Peretz, 9 Great Hill Farms Road, Bedford, New York is appointed to such position. MINUTES: May 23, 2000 Trustee Degling requested a correction, As corrected, the Minutes were approved. WRITTEN CORRESPONDENCE 1) WILLIAM WENDLAN.DT, VILLAGE ASSESSOR RE: LOCAL LAW ON TAX EXEMPTION TO DISABLED PERSONS. 4 i I Mr, Russo summarized the communication from Mr. Wendlandt. The memo informs the Village that Westchester County recently adopted a local law providing a tax exemption fo'r disabled persons. The exemptions contained within the law are based on the same schedule as the Senior Citizens' tax exemption. Trustee Degling noted that this exemption was not cumulative with the senior citizen exemption. Trustee Rand asked for clarification on the exemption. Trustee Degling noted that it was covered by Section 459C of the Real Property Law. Anyone interested in the remaining items can contact the Treasurer's Department. It was noted that the vehicles will be put out for sealed bids through the newspapers. Mr. Russo called the role: Mayor Filipowski Aye Trustee Brackman Aye Trustee Degling Aye Trustee Herman Aye Trustee Rand Aye The Board called for a five minute recess. Upon their return, Mayor Filipowski read the following Resolution: RESOLUTION APPOINTMENT OF FIREFIGHTERS (2) RESOLVED,that Michael Cyrulik, of 19 Ridge Way, Purdys, New York, is hereby appointed to the position of Firefighter with the Village of Rye Brook on a temporary basis pending agility testing by the Westchester County Personnel Office, and subject to the Civil Service procedures of the State of New York; and be it FURTHER RESOLVED, that the annual salary for the position is $31,790 with an effective state date of 711712000. RESOLVED, that Craig Magrone , of 29B Highview Avenue, Rye Brook, New York, is hereby appointed to the position of Firefighter with the Village of Rye Brook on a temporary basis pending agility testing by the Westchester County Personnel Office, and subject to the Civil Service procedures of the State of New York; and be it FURTHER RESOLVED, that the annual salary for the position is $31,790 with an effective state date of 711712000. Mayor Filipowski introduced Firefighter Michael Cyrulik and Firefighter Craig Magrone to the Board and members of the public, And presented them with their firefighter badges. Mr. Russo stated that both firefighters will be attending the Academy in White 9 1 Plains. He thanked White Plains for their cooperation, and for allowing our firefighters to attend their academy. On a motion made by Trustee Rand, and seconded by Trustee Brackman, Mr. Russo called the role: Trustee Brackman Voting Aye Trustee Degling Voting Aye Trustee Herman Voting Aye Trustee Rand Voting Aye Mayor Filipowski Voting Aye Mayor Filipowski stated that the next Board of Trustees meetings will be held on July 25'and August 8". He asked if there were any members of the public that wished to address the Board. Ms. Debbie Faust noted that she has addressed the Board approximately four or five times on the subject of the construction at the Hutch. She has brought issues before the Board and felt that no one in the Village addressed her concerns. She stated that the residents in the area feel that they are alone in their battle and that the Village has not offered assistance. As the work is almost complete, the DOT and Ecco will be leaving the site within the next three months. Ms. Faust felt that all work, including clean up and work on the wall should be completed before they leave. She asked that members of the Board come and visit the homeowners' property and see what it feels like being on the other,side of the sound barrier. Some of the unresolved issues include the lack of topsoil, no motion light, tress that are falling over, the wall has not been cleaned. In addition to what has not been done, the residents have recently learned that the tree planting will not start until the Spring of 2001. Mayor Filipowski asked that Ms. Faust present the Board with a list of the items that have not been addressed. Mr. Dean Santon addressed the Board. Once again he brought up the issue of the Money Saver which is distributed by the Journal News. He complained to the Board that these flyers should not be thrown onto residents' front lawns. He felt that this is a form of littering and asked that the Board let homeowners know that they can call and the 800 # and complain, He asked that Mr. Ken Powell, Village Attorney,looked into this issue and respond at the August 8"meeting. Mr. Santon also addressed the tree planting on the triangle portion of property located at North Ridge Street/King Street intersection. He noted that the trees which were removed in error were deciduous trees that were 40-50 feet in height. Ecco made this mistake and since it was a blatant error, which they have admitted, he felt that the 10 i Village should not take it easy on them. They should be required to put back trees that are far more attractive then what they have attempted to plant recently. Mayor Filipowski noted that this is not the correct season for tree planting and that Village will follow-up to ensure that the trees are replaced, Mr. David Schwartz of North Ridge asked for additional information regarding construction of a cell tower that was being considered for the area near the Hutch. Mayor Filipowski noted that there was a presentation at the last Board meeting by New York State and the contracting firm. The reasons for their belief of why this was the best area were presented at that meeting, There is a meeting scheduled for next Tuesday, July 18', and after that meeting, the Board will have more information for the community. Mr. Russo noted that there were many unanswered questions that the State will be responding to after they walk the site on the 18"of July.
