He began the meeting with the Pledge of Allegiance led by members of the Rye Brook Police Department and the Austin family. Mayor Rand called for the first order of business: RESOLUTIONS: 1) APPOINTING CHIEF OF POLICE Mr. Christopher Bradbury, Village Administrator, read the following resolution: Board of Trustees August 22, 2006 Page 2 RESOLUTION APPOINTMENT OF POLICE CHIEF RESOLVED, that Gregory Austin of 52 Forest Lane, Brewster, New York, is hereby appointed to the position of Police Chief with the Village of Rye Brook, subject to the Civil Service procedures of the State of New York; and be it FURTHER RESOLVED, that the annual salary is $112,000 with an effective start date of September 10, 2006. Mayor Rand called upon Officer Gregory Austin to pledge his oath. Mrs. Austin was asked to pin Chief Austin's police badge on him. The Board and the Mayor congratulated Chief Austin on his appointment, and members of the public congratulated him with a standing ovation. Chief Austin thanked everyone for coming, and for being given the opportunity to serve the residents of Rye Brook as Police Chief. He thanked Chief Sabato for his guidance over the years, his fellow officers for their support, and the Board members for this opportunity. On a motion made by Trustee Patricia Sanders-Romano, and seconded by Trustee Joan Feinstein, the resolution was adopted. Mr. David Burke, Assistant to the Village Administrator, called the roll: Trustee Joan Feinstein Voting Aye Trustee Paul Rosenberg Voting Aye Trustee Patricia Sanders-Romano Voting Aye Mayor Lawrence Rand Voting Aye 2) SETTING A DATE FOR A PUBLIC HEARING ON AN APPLICATION FOR A CHANGE OF USE BY WIN RIDGE REALITY, LLC AT THE RYE RIDGE SHOPPING CENTER Mr. Bradbury read the following resolution: RESOLUTION Board of Trustees August 22, 2006 Page 3 SETTING A PUBLIC HEARING TO CONSIDER CONVERSION OF 27,000 SQUARE FEET OF SPACE IN THE PLAZA BUILDING OF THE RYE RIDGE SHOPPING CENTER FROM MEDICAL OFFICE TO RETAIL USE WHEREAS, the Board of Trustees is in receipt of an application by Win Ridge Realty, LLC requesting authorization for conversion of up to an additional 27,000 square feet of space in the plaza building from medical office to retail use without further site plan review for the Rye Ridge Shopping Center located at the intersection of South Ridge Street and Bowman Avenue in Section 1, Block 22, Lots 3, 3A and 4A-A of the Town of Rye Tax Map and located in the Cl-P Zoning District; and WHEREAS, the Village Board referred the application to the Planning Board and the Planning Board referred the application back to the Village Board with recommendations on August 10, 2006. NOW, THEREFORE, BE IT RESOLVED, that the Village of Rye Brook Board of Trustees shall conduct a Public Hearing on Tuesday, September 26, 2006 at 7:30 pm at Village Hall, 938 King Street, Rye Brook, New York to consider authorization for the conversion of up to an additional 27,000 square feet of space in the plaza building of the Rye Ridge Shopping Center from medical office to retail use. Mr. Bradbury noted that the public hearing was originally considered for September 12, 2006,but that he would not be in attendance. Mayor Rand stated that he also felt more comfortable setting the public hearing for September 26`h Mr. Peter Staul of Win Ridge addressed the Board. He noted that they were looking forward to starting work on this project, and have been before several Boards. They are looking forward to receiving comments from members of the public, and then hopefully moving ahead on September 26, 2006. On a motion made by Trustee Paul Rosenberg, and seconded by Trustee Patricia Sanders-Romano, the resolution was adopted. Trustee Joan Feinstein Voting Aye Trustee Paul Rosenberg Voting Aye Trustee Patricia Sanders-Romano Voting Aye Mayor Lawrence Rand Voting Aye Board of Trustees August 22, 2006 Page 4 3) AUTHORIZING AN AGREEMENT WITH THE NEW ROCHELLE HUMANE SOCIETY Mr. Bradbury read the following resolution: RESOLUTION AUTHORIZING THE VILLAGE OF RYE BROOK TO ENTER INTO AN ANIMAL SHELTER AGREEMENT WITH THE NEW ROCHELLE HUMANE SOCIETY WHEREAS, the Village of Rye Brook wishes to obtain the services and use the facilities of the New Rochelle Humane Society for shelter and dog control services pursuant to the New York Agricultural and Markets Law; and WHEREAS, the New Rochelle Humane Society has offered to enter into an agreement with the Village of Rye Brook to provide such services at an annual cost of Eleven Thousand Two Hundred Seventy-Four and 00/100 ($11,274.00) Dollars, payable in monthly installments of Nine Hundred Thirty-Nine and 50/100 ($939.50) Dollars; and NOW, THEREFORE, BE IT RESOLVED, that the Board of Trustees of the Village of Rye Brook authorizes the Village of Rye Brook to enter into such an Agreement with the New Rochelle Humane Society; and BE IT FURTHER RESOLVED, that the Mayor is authorized to execute and deliver all necessary documents to accomplish the purpose of this resolution. Mr. Bradbury noted that a site visit was made at the New Rochelle Humane Society. It is very orderly run and very clean. The driving force was better services, but there will also be a cost saving. The law is that services must be provided for dogs, as cats are not licensed. However, the New Rochelle Shelter does have facilities for cats, provided they have room. There are many animals up for adoption at this shelter. All of the dogs are walked every day, and are taken out to the play area. The cats have their own rooms. On a motion made by Trustee Feinstein, and seconded by Trustee Patricia Sanders-Romano, the resolution was adopted. Mayor Rand noted that this appointment fills one (1) of the two (2) open spots that existed. He urged any resident wishing to serve on this council to contact the Administrator's office. He reminded everyone that anyone wishing to serve on a Board is found a position. On a motion made by Trustee Feinstein, and seconded by Trustee Patricia Sanders-Romano, the resolution was adopted. Funds are transferred from one area to another. On a motion made by Trustee Feinstein, and seconded by Trustee Patricia Sanders-Romano, the resolution was adopted. Trustee Joan Feinstein Voting Aye Trustee Paul Rosenberg Voting Aye Trustee Patricia Sanders-Romano Voting Aye Mayor Lawrence Rand Voting Aye ADMINISTRATOR'S REPORT: Mr. Bradbury reminded everyone that the Rye Brook Athletic Fields Grand Opening was scheduled for September 17, 200 at 11:00 a.m. Notices are being sent to all residents, and everyone is welcome. He noted that the field has been used for Blind Brook High School's football practice, and a schedule of use has been completed. Mr. Bradbury addressed recycling, as there has been an issue lately with the types of items to be recycled. It is clear that clarification is needed. Some of the rules have been modified, and the rules have also been strengthened and enforced. All rules must be closely followed. He stated that no plastic bags should be used when putting out newspaper for pick up. Residents will receive an OOPS sticker when they are not following the rules. Clarification of the new rules, and what can and cannot be recycled, will be included in the Village's newsletter which is scheduled to go out in September. The amnesty program is underway. Mr. Bradbury noted that there are many benefits to the residents in this program, and the Board hoped that everyone would take advantage. Board of Trustees August 22, 2006 Page 16 It was noted that Employee Recognition Day took place earlier today. The Village also recognized employees who have reached milestones in their career. Congratulations went out to Police Sgt. Terry Wilson for 15 years of service, Police Officer Greg Nolte for ten years of service, and Police Sgt. Davidson for ten years of service. Mayor Rand noted that there was a report on the Port Chester Public Library in the local newspapers that he wished to briefly address. Editorials in the Journal News and Westmore News have supported adding the name of Rye Brook to the name of the library. He referred to an article in the Journal News noting that the Rye Brook taxpayers have been contributing 30% to the Library for many years. It also noted that Rye Brook's residents equal fewer than 30 % of the Library cardholders. The name change may seem to be a petty issue, but the financial commitment, $5 million over 10 years, being asked of the residents of Rye Brook is not. Mr. Bradbury and Mayor Rand will be meeting with the consultants, and are soliciting comments from the residents in terms of what they will expect out of the library. Mayor Rand noted that the name change is not a recent issue. Former Village Trustee, Jules Harris, has noted that in January of 1984, one and a half years after the Village was founded, the Board of Trustees made a request that the name of the library be changed. It was turned down because Port Chester objected to the name change "under the circumstances". The circumstances have changed. Over the past 22 years the Board of the Port Chester Public Library has supported the name change. At this time the ball is in the court of the Port Chester Board of Trustees. The matter is presently in a "cooling off' phase. In the meantime, the Library is being renovated in an attempt to bring the building up to Code. DISCUSSION ITEMS: 1) VILLAGE NOISE ORDINANCE ON WEEKENDS Trustee Joan Feinstein noted that she has been approached by residents expressing their concern regarding construction work being done over the weekends. Leaf blowers and the like start early, interrupting what should be a quiet time. She noted that the Village's Code prohibits construction noise from 9:00 p.m. to 7:30 a.m. on weekdays. That means that the objectionable types of equipment can be used from 7:30 a.m. Another point of interest is the fact that construction work can begin at 8:00 a.m. on Saturdays, and is prohibited on Sundays unless the residents are doing the work themselves. The concerns that have been raised are valid concerns. People like to sleep late on the weekend, or may be just want to sit outside, relax, and read the newspaper. She asked that this matter be reviewed to see if a balance can be reached between the needs and wishes of the residents with the needs of the landscapers and construction companies. Board of Trustees August 22, 2006 Page 17 Trustee Feinstein noted that the Village does not have jurisdiction regarding school related construction, and that it is important to note that the work on the school must be completed before school commences in September. The Board of Trustees will address this matter with the school to see what can be done. Mayor Rand asked for the status of the Nextel application. Mr. Bradbury noted that Nextel will be re-submitting new plans this week. He will stay on top of this matter, will request payment every month, and will keep the Board apprised of the situation. Trustee Feinstein thanked former Trustee Richard Buzin, who was now a member of the Blind Brook Board of Education, for his work on the PILOT with Reckson Office Park. Mayor Rand called for members of the public wishing to address the Board. There being no comments, he called for an Executive Session of the Board of Trustees, and the meeting was adjourned at 8:15 p.m. The Board of Trustees returned from Executive Session to consider, and pass the following resolution. On a motion made by Trustee Rosenberg and seconded by Trustee Feinstein, the following resolution was adopted: RESOLUTION AUTHORIZING A WAIVER OF POTENTIAL CONFLICT- VILLAGE OF RYE BROOK AND VERIZON BE IT RESOLVED, that the Board of Trustees hereby approves and authorizes the Village of Rye Brook to sign a waiver of potential conflict between the Village of Rye Brook and Verizon, permitting Keane and Beane P.C. to represent Verizon in securing Video Franchise Agreements in the Hudson Valley municipalities other than the Village of Rye Brook; and BE IT FURTHER RESOLVED, that the Mayor is authorized to execute and deliver all necessary documents to accomplish the purpose of this Resolution.
