Feinstein STAFF: David Burke, Assistant to the Village Administrator Edward Beane, Esq., Village Counsel Michal Nowak, Acting Village Engineer Fred Seifert, Public Access Coordinator Shari Melillo, Meeting Secretary Mayor Feinstein welcomed everyone to tonight's regular meeting of the Village Board. RESOLUTIONS: (1) Considering the use of Village streets for a block party on Valley Terrace Mr. David Burke, Assistant to the Administrator, read the resolution: CONSIDERING THE USE OF VILLAGE STREETS FOR A BLOCK PARTY ON VALLEY TERRACE RESOLVED, that the use of Valley Terrace between Argyle Road and Ridge Blvd. for the Valley Terrace block party on Saturday, September 11, 2010 (rain date of Sunday, September 12, 2010) is hereby approved with the terms and conditions to be established by the Rye Brook Police Department. 2 of 7 Board of Trustees July 27, 2010 Mayor Feinstein noted that this is an annual event and a nice tradition for that neighborhood. On a motion made by Trustee Brown and seconded by Trustee Rednick, the resolution was adopted and Mr. Burke called the roll: TRUSTEE BROWN AYE TRUSTEE MARROW AYE TRUSTEE REDNICK AYE TRUSTEE ROSENBERG AYE MAYOR FEINSTEIN AYE (2) Considering the acceptance of planting in the vicinity of the Edgewood Detention Basin by the owners of 15 Edgewood Drive Mr. Burke read the resolution: CONSIDERING THE ACCEPTANCE OF PLANTINGS IN THE VICINITY OF THE EDGEWOOD DETENTION BASIN BY THE OWNERS OF 15 EDGEWOOD DRIVE WHEREAS, Lori and Sam Schwartzman, the owners of 15 Edgewood Drive desire to donate twelve (12) arborvitae to the Friends of Rye Brook to provide additional screening in the vicinity of the Edgewood Detention Basin. NOW, THEREFORE BE IT RESOLVED, the Village Board on behalf of the Friends of Rye Brook hereby accept twelve (12) arborvitae, in the approximate value of $1,200, from Lori and Sam Schwartzman, the owners of 15 Edgewood Drive to be planted on Village property in the vicinity of the Edgewood Detention Basin; and be it FURTHER RESOLVED, the plantings will be coordinated with field conditions in consultation with the Acting Village Engineer; and be it FURTHER RESOLVED, Lori and Sam Schwartzman the owners of 15 Edgewood Drive and/ or their contractor will provide the proper insurance requirements in accordance with the Village's risk manager. Mr. and Mrs. Schwartzman addressed the Board and stated that they are pleased with the outcome of the basin and the construction process. One area overlooks the basin from their bedrooms and they would like to add these plants for additional screening. Their contractor will be doing the work on village property and insurance will be required and provided. The work will be coordinated with Mr. Nowak, Acting Village Engineer. The Board thanked them for their generous donation. 3 of 7 Board of Trustees July 27, 2010 On a motion made by Trustee Rosenberg and seconded by Trustee Brown, the resolution was adopted and Mr. Burke called the roll: TRUSTEE BROWN AYE TRUSTEE MARROW AYE TRUSTEE REDNICK AYE TRUSTEE ROSENBERG AYE MAYOR FEINSTEIN AYE (3) Considering an agreement between the Village of Rye Brook and the Town/Village of Harrison for the use of the Town/ Village's Pistol Firing Range by Rye Brook Police Officers Mr. Burke read the resolution: CONSIDER AN AGREEMENT BETWEEN THE VILLAGE OF RYE BROOK AND THE TOWN/VILLAGE OF HARRISON FOR THE USE OF THE TOWN/ VILLAGE PISTOL FIRING RANGE BY RYE BROOK POLICE OFFICERS RESOLVED, that Mayor Joan L. Feinstein is hereby authorized to execute and deliver all necessary documents for the purpose of entering into an agreement with the Town/ Village of Harrison for use of the Town/ Village Pistol Firing Range by Rye Brook Police Officers Mayor Feinstein explained that while the Police Department now has the ability to use the County facility as well, the range in Harrison can be used to offset for training of the officers at no cost to the Village. On a motion made by Trustee Rednick and seconded by Trustee Marrow, the resolution was adopted and Mr. Burke called the roll: TRUSTEE BROWN AYE TRUSTEE MARROW AYE TRUSTEE REDNICK AYE TRUSTEE ROSENBERG AYE MAYOR FEINSTEIN AYE (4) Authorizing a letter demanding compliance with section 186-2 (A) of the Village Code regarding property maintenance Mr. Burke read the resolution: 4 of 7 Board of Trustees July 27, 2010 AUTHORIZING A LETTER DEMANDING COMPLIANCE WITH §186-2(A) OF THE VILLAGE CODE REGARDING PROPERTY MAINTENANCE WHEREAS, every owner, tenant, occupant or person legally in possession of land in the Village of Rye Brook, is obligated to maintain such property in accordance with §186-2(A) of the Village Code so as to keep such property clear of unsightly or objectionable materials which are or might tend to become health, safety or fire hazards removed from such land and to maintain the growth of grasses and shrubs; and WHEREAS, the Building Inspector has advised the Board of Trustees that the property located at 117 '/2 North Ridge Street within the Village of Rye Brook is currently in violation of§186-2(A) of the Village Code. NOW, THEREFORE, BE IT RESOLVED, that in accordance with Village Code §186-2(B), the Board of Trustees of the Village of Rye Brook shall cause to be serve the owners of 117 '/2 North Ridge Street by mail a written notice requiring such owner to comply with the provisions of Village Code §186-2(A); and be it FURTHER RESOLVED, that if such owner fails, neglects or refuses to comply within five days after service of such notice, the Director of Public Works shall cause the violation to be corrected and the owner shall pay to the Village all costs in connection with such correction within 30 days after the completion thereof. If the Owner does not remit payment within the thirty (30) day period, the costs incurred by the Village to correct the violation shall become a lien on the premises located at 117 �/2 North Ridge Street in accordance with the provisions of section §186-2(B) of the Village Code. Mayor Feinstein explained that the Village had dealt with this before and legally the Village has to go through this process to be able to go on the site and clean up the site. She also noted that this is a vacant home. Trustee Rednick asked if there was a court proceeding as well to which Mr. Beane responded that there is not and that this is the short way of doing it as a court proceeding is prolonged and the remedy is not necessarily automatic. On a motion made by Trustee Brown and seconded by Trustee Rednick, the resolution was adopted and Mr. Burke called the roll: TRUSTEE BROWN AYE TRUSTEE MARROW AYE TRUSTEE REDNICK AYE TRUSTEE ROSENBERG AYE MAYOR FEINSTEIN AYE 5 of 7 Board of Trustees July 27, 2010 (5) Setting a public hearing to consider a proposed local law to amend Chapter 240 of the Village of Rye Brook Village Code regarding stop signs On a motion made by Trustee Rosenberg and seconded by Trustee Rednick, the resolution was amended referring this item to the Traffic Commission as it is within their jurisdiction. REFERRING A PROPOSED LOCAL LAW TO AMEND CHAPTER 240 OF THE VILLAGE OF RYE BROOK VILLAGE CODE REGARDING STOP SIGNS TO THE TRAFFIC COMMISSION FOR REPORT AND RECOMMENDATION WHEREAS, the Board of Trustees is considering an amendment of Chapter 240, Section 11 of the Village Code regarding stop signs. NOW, THEREFORE, BE IT RESOLVED, that the Board of Trustees of the Village of Rye Brook herby refers the proposed local law to the Traffic Commission regarding stop signs to the Traffic Commission for report and recommendation. TRUSTEE BROWN AYE TRUSTEE MARROW AYE TRUSTEE REDNICK AYE TRUSTEE ROSENBERG AYE MAYOR FEINSTEIN AYE (6) Considering an agreement between the Village of Rye Brook and SAS Bulfamante for the operation of the Village's compost and leaf removal facility Mayor Feinstein advised the Board that this item has been withdrawn by the contractor. (7) Considering the approval of Minutes: May 25, 2010; June 8, 2010; June 22, 2010 As not everyone has had an opportunity to review the minutes, this will be held over to the next Board meeting. ADMINISTRATOR'S REPORT In Administrator Bradbury's absence, Assistant to the Administrator, David Burke, gave an update on the Ridge Street construction project advising that it is moving ahead well with the paving almost complete. The signals at Betsy Brown Road and additional topsoil and seeding are a couple of the items that remain and possibly another 2 months left of work before completion. He also advised homeowners that they are responsible for cutting the grass between the sidewalk and the curbing. 6 of 7 Board of Trustees July 27, 2010 The Administration and the Police Department are working together continuously in regard to the coyote activity in Rye Brook. The coyotes are not going away and we need to adapt to be able to live with them and will accomplish that through public education. The Village will be trapping for a defined period of time and will be working on a long term regional plan with some other municipalities as well. Mayor Feinstein added that she attended a coyote summit in the City of Rye with the New York State DEC to obtain more information on what to tell our residents and that information has been posted on the web site. The coyotes cannot be eradicated and there needs to be a balance between humans and coyotes so that we can live together with them as they are not going to disappear. The Village will be starting a trapping program on municipal property and before that happens, we will be alerting the public to where that will take place. Trustee Rosenberg wants to make sure that once we decide when this is beginning that homeowners are notified especially in the area of the trapping. Mayor Feinstein thanked Chief Austin and his department for their work on investigating the sightings that are being called in by the residents Chief Austin advised that the trapper will also distribute notices where the traps are as well. Ms. Lina Accurso, 52 Rock Ridge Drive, addressed the Board and advised them that she has decided not to speak tonight but will just give the Mayor a letter she has written with the help of the US Constitution. The letter is self explanatory and she will be awaiting a response.
