Feinstein welcomed everyone to the Tuesday, May 10, 2011 Regular Meeting of the Board of Trustees. She called for the first item on the agenda: BLIND BROOK MOCK TRIAL TEAM RECOGNITION: Mayor Joan Feinstein noted that the Blind Brook Mock Trial Team has been very successful for several decades. She noted that she was familiar with the efforts and preparation. This Team is sponsored by the New York State Bar Association. Board of Trustees Meeting May 10,2011 Page 2 of 11 Community members have always volunteered to coach. Blind Brook won the County final a few weeks ago. They competed in the regional finals, and are headed to Albany. She complimented the captains of the team for their effort. She introduced the coaches and thanked them for their many years of service. Mayor Feinstein called the members up of the Team to the podium where she awarded each member a Certificate of Recognition. PUBLIC HEARINGS: 1) PUBLIC HEARING TO CONSIDER A PROPOSED LOCAL LAW AMENDING CHAPTER 6 OF THE VILLAGE CODE REGARDING THE BELLEFAIR MIDDLE INCOME DEVELOPMENT PROGRAM Mayor Feinstein noted that Trustee Michael Brown was excused, and she asked for the permission of the Board to adjourn this public hearing to the June 14, 2011 meeting. On a motion made by Trustee Jeffrey Rednick, and seconded by Trustee Toby Marrow, the public hearing was adjourned. Feinstein Voting Aye RESOLUTIONS: 1) CONSIDERING THE APPOINTMENT OF A POLICE OFFICER Mr. Bradbury read the following resolution: RESOLUTION CONSIDERING THE APPOINTMENT OF A POLICE OFFICER RESOLVED, that David John Cryeski of 38 Queen Anne Lane, Wappingers Falls, New York is hereby appointed to the position of Police Officer with the Village of Rye Brook, subject to approval of the NYS Civil Board of Trustees Meeting May 10,2011 Page 3 of 11 Service procedures by the County of Westchester Department of Human Resources, and the passing of a pre-employment medical exam appropriate for this title; and be it FURTHER RESOLVED, that the annual salary is $46,922 with an effective start date to be determined. Mayor Feinstein noted that two officers have retired. A resolution was passed to change the law and allow the Village of Rye Brook to be able to hire from additional counties. Mr. Christopher Bradbury, Village Administrator, noted that Officer Cryeski has prior officer experience having worked at Purchase College and in Newburg, New York. He has successfully passed the pre- employment medical exam. On a motion made by Trustee Jeffrey Rednick, and seconded by Trustee Rosenberg the resolution was adopted. Feinstein Voting Aye 2) CONSIDERING THE APPOINTMENT OF A POLICE OFFICER Mr. Bradbury read the following resolution: RESOLUTION CONSIDERING THE APPOINTMENT OF A POLICE OFFICER RESOLVED, that Christopher Vincent Ruhe of 902 Main Street, Fishkill, New York, is hereby appointed to the position of Police Officer with the Village of Rye Brook, subject to approval of the NYS Civil Service procedures by the County of Westchester Department of Human Resources, and the passing of a pre-employment medical exam appropriate for this title; and be it Board of Trustees Meeting May 10,2011 Page 4 of 11 FURTHER RESOLVED, that the annual salary is $46,922 with an effective start date to be determined. Mr. Bradbury noted that Officer Ruhc also has experience and has worked for the New York State Parks Department. He also noted that there were two (2) additional vacancies that are being filled. Feinstein Voting Aye 3) CONSIDER AUTHORIZING THE RENEWAL OF A WESTCHESTER COUNTY DEPARTMENT OF HEALTH FOOD SERVICE PERMIT APPLICATION TO OPERATE A FOOD SERVICE ESTABLISHMENT AT THE ANTHONY J. POSILLIPO COMMUNITY CENTER Mr. Bradbury read the following resolution: RESOLUTION CONSIDER AUTHORIZING THE RENEWAL OF A WESTCHESTER COUNTY DEPARTMENT OF HEALTH FOOD SERVICE PERMIT APPLICATION TO OPERATE A FOOD SERVICE ESTABLISHMENT AT THE ANTHONY J. POSILLIPO COMMUNITY CENTER WHEREAS, the Westchester County Department of Health Sanitary Code requires that a food service permit be obtained from the Department of Health to operate a food service establishment; and WHEREAS, the Anthony J. Posillipo Community Center serves and operates a food service establishment and would like to renew their Board of Trustees Meeting May 10,2011 Page 5 of 11 application for such permit in order to comply with all rules and regulations of the Westchester County Department of Health. NOW, THEREFORE, BE IT RESOLVED, that the Village of Rye Brook Board of Trustees hereby authorizes the Deputy Village Clerk and Mayor to apply for a renewal of a food service permit for the Anthony J. Posillipo Community Center and to execute and deliver to the Westchester County Department of Health, for and on behalf of the Village, a renewal application for a permit to operate a food service establishment and to execute and deliver any and all additional documents which may be appropriate or desirable in connection therewith. On a motion made by Trustee Paul Rosenberg, and seconded by Trustee Rednick the resolution was adopted, as amended. It was noted that his is a renewal of the Westchester County permit which allows food to be served at the Senior Center. Mr. Burke called the roll: Trustee Toby S. Feinstein Voting Aye 4) SETTING A PUBLIC HEARING TO CONSIDER A PROPOSED LOCAL LAW AMENDING CHAPTER 186 OF THE VILLAGE CODE REGARDING PROPERTY MAINTENANCE Mr. Bradbury read the following resolution: RESOLUTION SETTING A PUBLIC HEARING TO CONSIDER A PROPOSED LOCAL LAW AMENDING CHAPTER 186 OF THE VILLAGE CODE REGARDING PROPERTY MAINTENANCE WHEREAS, the Board of Trustees is considering a proposed local law amending Chapter 186 of the Village Code regarding property maintenance. Board of Trustees Meeting May 10,2011 Page 6 of 11 NOW, THEREFORE, BE IT RESOLVED, that the Board of Trustees of the Village of Rye Brook, shall hold a public hearing on May 24, 2011 at 7:30 p.m. at the Village Hall, 938 King Street, Rye Brook, New York to consider the proposed amendments to Chapter 186 of the Village code regarding property maintenance. Mr. Bradbury noted that issues with graffiti have come up and this local law will assist the Village in following state law. This resolution will create a law that will allow the Building Department to properly address this issue. On a motion made by Trustee Rednick, and seconded by Trustee Marrow the resolution was adopted. The roll was called: Trustee Toby S. Marrow Voting Aye Trustee Jeffrey B. Feinstein Voting Aye ADMINISTRATOR'S REPORT: Mr. Bradbury noted that starting June 1, 2011 additional plastics will be recycled; plastics 1 through 7. The County has put out information, and the Village has additional information listed on its website. The Environmental Counsel has also discussed this issue. Mr. Bradbury gave an update on the Ridge Street project. He noted that there are still some outstanding items, i.e.: some traffic signalization. It may be fall before some of the items are completed. Rye Brook will not accept Ridge Street until everything has been completed. The next item discussed was the North Castle parking garage which will house 1450 vehicles. The Village's consultant is reviewing the plans to decide whether the Village should or should not be commenting on this project since it will affect King Street. Board of Trustees Meeting May 10,2011 Page 7 of 11 Rye Brook has been once again designated as Tree City USA. This is the 16th year. An Arbor Day ceremony is held annually, at which time trees are planted in memoriam. Mayor Feinstein congratulated Gary Zuckerman who will be honored as a citizen planner. Mr. Zuckerman has been on the Planning Board for six or seven years, and he also sat on the Board of Trustees. He is now being recognized for his efforts on behalf of the community. The ceremony is scheduled for June 2, 2011. Mayor Feinstein called for the Annual Report on the Municipal Separate Storm Sewer System: ANNUAL REPORT — MUNICIPAL SEPARATE STORM SEWER SYSTEM (MS4) Mr. Bradbury called upon Mr. Michal Nowak, Acting Village Engineer, for the report. Mr. Nowak noted that the federal government enacted legislation to aid in storm water management and quality and the Village must file a report annually. The Village must be in compliance with the New York State regulations. Mr. Nowak noted that the storm drains are cleaned and inspections are done looking for illicit discharge. Village staff inspects for signs of paint, abnormal growth, etc. — signs that something is wrong. The Village is being proactive working on storm water management. Mayor Feinstein called for questions or comments from members of the public. There being no one, she thanked Mr. Nowak for his report. Mr. Bradbury noted that the Village is working on the education aspects of the storm sewer system. There is information posted on the Village's website and during events such as the Rye Brook Party information is handed out to attendees. OLD BUSINESS (1) CONSIDERING THE EXTENSION OF THE AMNESTY PROGRAM Mayor Feinstein noted that a letter from the President of the Arbors requesting that the Amnesty Program be extended. She noted that she has been working to promote this program for many years. The Amnesty Program was enacted in 2005. It ran for many years, and then it lapsed. The Arbors has now requested Board of Trustees Meeting May 10,2011 Page 8 of 11 that this program be extended. This program is for everyone in the community and is not limited to the residents of the Arbors. Approximately 50 residents of the Village have taken advantage of this program. The administrative fee is waived, giving residents an incentive to come forward. There has been a loss of revenue, but this is a very important program especially as it relates to the safety of the residents. Mayor Feinstein noted that she was more than happy to extend this program. The Village will continue to educate and get this out to the public. Mr. Bradbury noted that a local law has been prepared extending this program. He requested that a date be set for a public hearing. Mayor Feinstein called for resolution #5. RESOLUTION Mr. Bradbury read the following resolution SETTING A PUBLIC HEARING TO CONSIDER A PROPOSED LOCAL LAW AMENDING THE AMNESTY PROGRAM FOR WORK PERFORMED OR COMPLETED WITHOUT A PERMIT WHEREAS, the Board of Trustees is considering a proposed local law amending the amnesty program for work performed or completed without a permit. NOW, THEREFORE, BE IT RESOLVED, that the Board of Trustees of the Village of Rye Brook, shall hold a public hearing on May 24, 2011 at 7:30 p.m. at the Village Hall, 938 King Street, Rye Brook, New York to consider the proposed amendment to the local law. Feinstein Voting Aye Board of Trustees Meeting May 10,2011 Page 9 of 11 ACTION ON NON-AGENDA MATTERS SUBJECT TO THE CONSENT OF THE TRUSTEES PRESENT AT THE MEETING Mayor Feinstein noted that at the last meeting the Town or Rye Assessor was in attendance with the representative of Vision Appraisal. What was explained was that approximately 65% of the parcels went down in value and 35% stayed constant or went up. Some properties went up a substantial amount. She encouraged those residents whose values have gone up to contact the assessor's office. Residents should come forward and make an appointment with Vision Appraisal. The more formal process will take place before June 1st and June 21st She asked that all residents review their revaluations. Once the values are set, then the bills will be a surprise. There is information on the Village's website and she urged everyone to review the letter and the assessed valuation. Some valuations have gone up because of work done to the home, while other residents have done nothing to their homes and yet their evaluations have gone up. The resident of 99 Brush Hollow Close in the Arbors, Mr. Richard Proper, addressed the Board. He stated that he has begun this process and found that it is not a frightening process. You can go on the internet and find your neighbors' home and their valuation and then present the information to Vision Appraisal in an informal meeting. Mayor Feinstein noted that the Town of Rye has a book of comparable sales in the offices on Pearl Street. Some properties may have something unique about it that should be brought to the Assessor's attention. Anyone who goes thru the informal hearing will receive letters if their value has gone down. Letters will be received by the end of May. Mayor Feinstein noted that the Board would review the minutes from April at the next meeting. She announced that the next Board of Trustee meetings were scheduled for May 24, 2011 and June 14, 2011, and called for questions or comments from members of the community. There being no one wishing to address the Board, and no further business before the Board, Mayor Feinstein called for a motion to adjourn.
