Mayor Paul Rosenberg welcomed everyone to the September 26, 2013 Meeting of
the Board of Trustees. He noted that the Board came from an Executive Session
on Non-Union Compensation, and would need to continue the Executive Session
at the end of the meeting. He also noted that Trustee Heiser was excused from the
meeting. The Board congratulated him on his move back into his house, almost
one year after Hurricane Sandy.
PUBLIC HEARINGS:
1. Public hearing on an amended site plan application by Rye King
Associates, LLC for property located at 900 King Street
On a motion made by Trustee Klein, and seconded by Trustee Epstein, the
public hearing was declared open.
Mr. Christopher Bradbury, Village Administrator, called the roll:

Mr. Parisi, representative for the applicant, addressed the Board. He
presented the Board with an aerial photograph of the proposed signage that
would be replaced. It was noted that one of the signs, on the side of the

building facing the Hutch, may never be installed, but the applicant would
like that opportunity.
Marilyn Timpone Mohamed, Village Consultant, noted that the lighting
plan was back in the application and a negative declaration was added.
Mayor Rosenberg called for questions from members of the public and
Board members. Trustee Epstein questioned the size of the proposed
signage on the building. Mr. Bradbury noted that the Architectural Review
Board will review and approve a sample of the typestyle for the sign.
On a motion made by Trustee Rednick, and seconded by Trustee Epstein,
the public hearing was declared closed.

RESOLUTIONS:
1) Considering setting a Public hearing on an amended site plan
application by Rye King Associates, LLC for property located at
900 King Street
Mr. Bradbury read the following resolution:
CONSIDERING AN APPLICATION FOR A SITE PLAN AMENDMENT
FOR PROPERTY LOCATED AT 900 KING STREET
WHEREAS, the Board of Trustees is in receipt of an application by Rye King
Associates, LLC for approval of an amended site plan to replace existing freestanding signs,
install additional wall signage on the existing building at the east bulkhead wall, replace
parking lot lighting, and install three flagpoles on the northwest lawn for property located at
900 King Street, designated as Parcel ID 129.68-1-13 on the Town of Rye Tax Map and
located in the Planned Unit Development Zoning District and the Scenic Roads Overlay
District; and

WHEREAS, the Board of Trustees has final site plan approval authority
pursuant to Village Code §§ 209-1(A)(1), 209-1(B)(7), and 209-1(B)(8); and
WHEREAS, the Village Board of Trustees has received and reviewed the
information submitted by the Applicant in connection with the application, as
follows:

WHEREAS, during the course of review the Applicant decided to omit from
the application its proposal to install three flagpoles on the northwest lawn and
reduced the size of the proposed freestanding sign at the entry drive to the property
from Arbor Drive; and
WHEREAS, on April 23, 2013 the Board of Trustees, pursuant to the State
Environmental Quality Review Act (SEQRA) and after review of the Short
Environmental Assessment Form (EAF) prepared by the Applicant, determined the
proposed action to be an Unlisted Action pursuant to SEQRA which will undergo an
uncoordinated review; and
WHEREAS, on April 23, 2013 the Board of Trustees referred the application
to the Village of Rye Brook Planning Board for Report and Recommendation and to
the Village of Rye Brook Zoning Board of Appeals for consideration of any necessary
variances; and

WHEREAS, the Planning Board of the Village of Rye Brook submitted a
Report and Recommendation to the Board of Trustees dated May 9, 2013; and
WHEREAS, on July 2, 2013, the Zoning Board of Appeals granted a variance
for the proposed wall signage; and
WHEREAS, on July 19, 2013 the application was referred to the Westchester
County Planning Board for notification purposes pursuant to New York State
General Municipal Law and the Westchester County Administrative Code; and
WHEREAS, on July 26, 2013 and September 4, 2013 the application was
referred to the Town of Greenwich pursuant to New York State General Municipal
Law §239-nn and Westchester County Administrative Code §277.71; and
WHEREAS, on September 4, 2013 the application was referred to the Blind
Brook-Rye Union Free School District pursuant to Westchester County
Administrative Code §277.71; and
WHEREAS, on September 26, 2013 the Board of Trustees opened a public
hearing on the subject application, at which time all persons interested were given an
opportunity to speak on behalf of or in opposition to said application and the public
hearing was closed on September 26, 2013; and
WHEREAS, the Board of Trustees reviewed the Report and
Recommendations of the Village Planning Board, and comments the Village Planning
Consultant and Village Staff, and
WHEREAS, the Applicant has requested a waiver from certain site plan
application submission requirements and the Superintendent of Public Works/Village
Engineer has recommended such waiver be granted; and
WHEREAS, the Board of Trustees is familiar with the site and all aspects of
the project.
NOW, THEREFORE, BE IT RESOLVED, that the Village of Rye Brook
Board of Trustees, in accordance with Article 8 of the State Environmental
Conservation Law and 6 NYCRR Part 617, and upon review of the EAF and all
other application materials that were prepared for this action, hereby adopts the
attached Negative Declaration; and
BE IT FURTHER RESOLVED, that on the recommendation of the
Village Engineer and the Village Planning Board, the Village of Rye Brook Board of
Trustees hereby grants the Applicant's request for a waiver from certain site plan
application submission requirements as set forth on the Site Plan Submittal Review
Checklist, dated March 25, 2013; and

BE IT FURTHER RESOLVED, the application submitted by Rye King
Associates, LLC for an amended site plan to replace existing freestanding signs, install
additional wall signage and replace parking lot lighting, as shown on the set of plans listed
above, at property located at 900 King Street, is hereby approved, subject to the
following conditions:
1. Any stockpiled soil shall be protected with a silt fence or removed offsite.
2. Lighting for freestanding signs shall be low intensity and carefully directed
to avoid visual impacts on the King Street Scenic Road and the adjacent
residential areas; and
BE IT FURTHER RESOLVED, that no permits shall be issued until the
Applicant has paid to the Village all applicable fees and professional review fees
incurred in connection with review of this Application.
Mayor Rosenberg called for a correction to a typo in the Resolution.
On a motion made by Trustee Rednick, and seconded by Trustee Epstein,
the resolution was adopted, as amended.

RESOLUTIONS:
1) Considering setting a public hearing on a proposed local law amending
Chapter 70 of the Village Code regarding alarm systems
Mr. Bradbury read the following resolution:
CONSIDERING SETTING A PUBLIC HEARING ON A PROPOSED LOCAL
LAW AMENDING CHAPTER 70 OF THE VILLAGE CODE REGARDING
ALARM SYSTEMS

NOW THEREFORE BE IT RESOLVED, that the Board of Trustees of the
Village of Rye Brook, shall hold a public hearing on October 22, 2013 at 7:30 p.m. at
Village Hall, 938 King Street, Rye Brook,New York to consider amending Chapter 70 of
the Village Code regarding alarm systems.
Mr. Bradbury noted that the proposed changes will correct some
inconsistencies in the Code. Both fire and police alarms are included.
Mayor Rosenberg noted that the resolution was setting a public hearing,
and it would be scheduled for October 22, 2013.
On a motion made by Trustee Rednick, and seconded by Trustee Epstein,
the resolution was adopted.

Mr. Bradbury noted that there were two transfers involved. He reviewed
the transfers for the Board.
On a motion made by Trustee Epstein, and seconded by Trustee Klein, the
resolution was adopted.

Mayor Rosenberg noted that there was a backlog in the Building Department as a
result of the recent fire at the Rye Ridge Shopping Center. Staff has been working
very hard to get caught up. At this time Applications, Building Permits, and
Certificates of Occupancy are close to being turned around as quickly as they were
before the Rye Ridge fire.
ADMINISTRATOR'S REPORT
Mr. Bradbury began his report by announcing that the road resurfacing project is
coming to an end. The sidewalks are the last step. The Village is happy that the
streets were done before the leaf season. Mayor Rosenberg noted that the
contractor did a nice job.
The deadline for the survey for the comprehensive plan is coming up. He asked
that the residents help the Village by giving their input. Public input is a big part
of the comprehensive process. The deadline is October 1, 2013. The second
workshop has been scheduled and information is on the Village's website. The
survey can be filled out on line.
Mr. Bradbury noted that leaf season starts October 1, 2013. Leaves can be placed
out without any foreign objects such as rocks or sticks. It is a safety hazard and
can lead to equipment failure. The goal is no more than three weeks between
collections. The piles cannot be more than 4' wide and should not spread out.
The goal is to not crowd the road. Information is on the Village's website.

The review of a leaf blower has started. It is now the time to choose the right
piece of equipment for Rye Brook.
Halloween in the Park will be held at Rye Hills Park and it will be two nights this
year.
The Westchester Triathlon is scheduled from 7:30 a.m. to 10:30 a.m. this Sunday.
Mayor Rosenberg noted that the next meetings for the Board of Trustees were
scheduled for October 8 and October 22, 2013.
Mayor Rosenberg called for members of the public wishing to address the Board.
There being no one, and no further business before the Board, he called for a
motion and a second to adjourn to Executive Session.
On a motion made by Trustee Klein, and seconded by Trustee Epstein, the
meeting was adjourned at 8:04 p.m. and the Board went into Executive Session on
non-union compensation.

The Board of Trustees returned from Executive Session at 9:00p.m. and on a
motion made by Trustee Rednick and seconded by Trustee Epstein, the following
resolution was adopted.

AND BE IT FURTHER RESOLVED, that all non-union employees shall receive
one additional floating Personal Day, to be taken on or before May 31, 2014 at an acceptable
time approved by their Supervisor, and which shall not be carried over or cashed-in; and
BE IT FURTHER RESOLVED, that all non-union employees be allowed to cash-
in up to 50% of their vacation days, up to ten (10) days maximum, regardless of their current
vacation day balance, provided they are cashed-in one time between the date of this
resolution and May 31, 2014. It is further noted that for eligible employees, one year must
elapse between the date these days are taken and the next eligible day to cash-in vacation
days.
