Bradbury, Village Administrator Gregory Austin, Police Chief David Burke, Assistant Village Administrator Edward Beane, Esq., Village Counsel Michal Nowak, Superintendent of Public Works Fred Seifert, Public Access Coordinator Paula Patafio, Meeting Secretary Mayor Paul Rosenberg welcomed everyone to the July 9, 2013 Regular Meeting of the Board of Trustees. He noted that the Board just came from an Executive Session, and called for the first item on the agenda. 1) Public hearing on an application for approval of a special permit and amended site plan for Reckson Operating Partnership, L.P. at property located at 1100 King Street (Applicant has requested adjournment of the public hearing) Mayor Paul Rosenberg noted that the applicant's counsel had requested an adjournment. A letter was received from the applicant, and it has been posted on the Village's website. The Board of Trustees has asked the applicant some pointed questions. The applicant is working on responses. This matter, with the consensus of the Board, will be placed on the August 19, 2013 agenda for the Board of Trustees. Mr. Christopher Board of Trustees Meeting Amended July 9,2013 Page 2 of 9 Bradbury, Village Administrator, noted that the applicant will be supplying a good amount of information. The applicant should provide all material by August 2, 2013. This will give Village staff and consultants sufficient time to review the material. Mayor Rosenberg noted that there was only one Board meeting in the month of August. On a motion made by Trustee David Heiser, and seconded by Trustee Susan Epstein, the resolution was adopted. Mr. David Burke, Assistant Village Administrator, called the roll: Trustee Susan Epstein Voting Aye Trustee David Heiser Voting Aye Trustee Jason Klein Voting Aye Trustee Jeffrey Rednick Voting Aye Mayor Paul Rosenberg Voting Aye Mayor Rosenberg called for the next matter on the agenda: RESOLUTIONS: 1) Considering a request for the use of Harkness Park by the Blind Brook-Rye Federation of Teachers for an event Mr. Bradbury read the following resolution: WHEREAS, in an email dated July 1, 2013 Robin Willig requested the use of Harkness Park on Tuesday, September 3, 2013 from 6:00pm to 7:30pm to host the "Blind Brook-Rye Federation of Teachers Meet and Greet." NOW THEREFORE BE IT RESOLVED, the Board of Trustees of the Village of Rye Brook hereby approves the use of Harkness Park on Tuesday, September 3, 2013 from 6:00pm to 7:30pm for the "Blind Brook- Rye Federation of Teachers Meet and Greet." Mayor Rosenberg noted that this was done last year, and it was a great opportunity for everyone to meet the teachers. Board of Trustees Meeting Amended July 9,2013 Page 3 of 9 On a motion made by Trustee Jeffrey Rednick, and seconded by Trustee David Heiser, the resolution was adopted. Mr. Burke called the roll: Trustee Susan Epstein Voting Aye Trustee David Heiser Voting Aye Trustee Jason Klein Voting Aye Trustee Jeffrey Rednick Voting Aye Mayor Paul Rosenberg Voting Aye 2) Considering the appointment of a Police Officer Mr. Bradbury read the following resolution: RESOLVED, that Elliot O. Asare of 777 N. MacQuesten Parkway, Mount Vernon,New York is hereby appointed to the position of Police Officer with the Village of Rye Brook, subject to the Civil Service procedures of the State of New York; and be it FURTHER RESOLVED, that the annual salary is $50,406 with an effective start date to be determined. Chief Greg Austin recommended officer Elliot Asare for the position. He is scheduled to start the Police Academy on August 5, 2013. Mr. Bradbury noted that there is paperwork to be completed and then the Village will need approval from the County. On a motion made by Trustee Rednick, and seconded by Trustee Heiser, the resolution was adopted. Mr. Burke called the roll: Trustee Susan Epstein Voting Aye Trustee David Heiser Voting Aye Trustee Jason Klein Voting Aye Trustee Jeffrey Rednick Voting Aye Mayor Paul Rosenberg Voting Aye Board of Trustees Meeting Amended July 9,2013 Page 4 of 9 3) Considering a village contribution to the Columbus Day Celebration Committee and use of Hawthorne Avenue for the annual parade Mr. Bradbury read the following resolution: WHEREAS, the Village of Rye Brook Board of Trustees supports the annual Columbus Day Parade sponsored by the Columbus Day Celebration Committee. NOW, THEREFORE, BE IT RESOLVED, that the Village of Rye Brook Board of Trustees hereby approves that $800.00 be provided to the Columbus Day Celebration Committee for its annual Columbus Day Parade; and be it FURTHER RESOLVED, that the Columbus Day Celebration Committee may use Hawthorne Avenue on Sunday, October 13, 2013 (rain date October 20, 2013) for the Columbus Day Parade in compliance with the terms and/or conditions established by the Village of Rye Brook Police Department. Mayor Rosenberg noted that the Village does this every year. The residents are aware of the Parade, as is the police department. On a motion made by Trustee Jason Klein, and seconded by Trustee Heiser, the resolution was adopted. The roll was called: Trustee Susan Epstein Voting Aye Trustee David Heiser Voting Aye Trustee Jason Klein Voting Aye Trustee Jeffrey Rednick Voting Aye Mayor Paul Rosenberg Voting Aye 4) Referring a proposed local law amending Chapter 250 of the Village Code regarding generators to the Planning Board for report and recommendation Board of Trustees Meeting Amended July 9,2013 Page 5 of 9 Mr. Bradbury read the following resolution: NOW THEREFORE BE IT RESOLVED, the proposed amendments to Chapter 250 of the Village Code regarding generators is hereby referred to the Planning Board for report and recommendation. Mayor Rosenberg noted that this matter was addressed at the previous Board of Trustees meeting. The goal was to make it easier for residents to install permanent generators. If residents can meet the new requirements, then they would not need to go to the Architectural Review Board. The Village has a landscape architect and Village staff that will assist with screening. No generators are allowed in the front of a home. he generators should be co-located with the air conditioning units and be installed closer to the home that they are servicing versus the neighboring home. This matter is on the Planning Board agenda for this Thursday night. On a motion made by Trustee Rednick, and seconded by Trustee Epstein, the resolution was adopted. The roll was called: Trustee Susan Epstein Voting Aye Trustee David Heiser Voting Aye Trustee Jason Klein Voting Aye Trustee Jeffrey Rednick Voting Aye Mayor Paul Rosenberg Voting Aye 5) Considering declaring municipal equipment as surplus for sale Mr. Bradbury read the following resolution: WHEREAS, the Village of Rye Brook has several pieces of municipal furniture and equipment that are no longer of functional value or use to the Village; and WHEREAS, the items may have a nominal resale value. Board of Trustees Meeting Amended July 9,2013 Page 6 of 9 NOW, THEREFORE, BE IT RESOLVED, that the equipment listed below is declared surplus to be sold to the highest qualified bidder through sealed bids solicited through classified advertisement in the official paper of the Village: Palmer Hamilton Tables: Nine (9) Round Six (6) Rectangular KI Folding Chairs: One Hundred Twenty Three (123) Folding Chairs Weiland Furniture: One (1) Sofa Two (2) End Tables One (1) Coffee Table One (1) Sofa Console Table Ten (10) Armchairs; AND BE IT FURTHER RESOLVED, that if no bids are received for a particular item, that the items may be disposed of through appropriate means by the Village Clerk; and BE IT FURTHER RESOLVED, that the Mayor is hereby authorized to execute and deliver all documents necessary or appropriate to accomplish the purposes of this resolution. Mr. Bradbury noted that this resolution was added to the agenda with the consensus of the Board. The resolution deals with equipment and furniture that has been replaced at the Senior Center. The old furniture is being sold. On a motion made by Trustee Rednick, and seconded by Trustee Epstein, the resolution was adopted. Mr. Burke called the roll: Trustee Susan Epstein Voting Aye Trustee David Heiser Voting Aye Trustee Jason Klein Voting Aye Trustee Jeffrey Rednick Voting Aye Mayor Paul Rosenberg Voting Aye Board of Trustees Meeting Amended July 9,2013 Page 7 of 9 ADMINISTRATOR'S REPORT: Mr. Christopher Bradbury, Village Administrator, addressed the Board. He noted that the Village will be hosting Theater in the park again. On Saturday, August 10, 2013, the Taming of the Shrew will be shown. All residents are invited. There is a road resurfacing bid that is now going out and it will be in by Friday. There are some sidewalks included, as well as some curbing. The information will be presented to the Board at the July 23rd meeting. The Ridge Street Bridge is still closed. The State estimates that it will be completed by August 26th. The August 26th dater is a more conservative deadline. We are about four weeks into construction at this point and people have adjusted to the detours. The Village will continue to monitor the area and the traffic, and information will be posted on the Village's website. Mayor Rosenberg called for comments from members of the public. Mr. Ben Miloro of Hillcrest Avenue addressed the Board. He noted that Hillcrest Avenue needs to be resurfaced, there are potholes and an area of the roadway that is now concave. He asked that the Village send someone out to evaluate the area. Mr. Miloro noted that the Journal News did not cover the election for Mayor of Rye Brook. Mayor Rosenberg stated that press releases go out, but the Village has no control over what the Journal News publishes or doesn't cover. The Village posted information on the website about the election, and announcements are made at Village meetings. Mr. Miloro noted that his garbage was not picked up this week. Mr. Bradbury noted that there was an error in the newspaper notice regarding what day garbage pickup would take place (because of the Holiday). Mr. Miloro noted that the sweeper is out early in the morning, when people are sleeping. In addition, at that time of the day there are too many cars on the road to do a good job of cleaning. Mr. Miloro questioned the sale of the Town Garage. He felt that the residents should have had a say in this matter. The garage will be sold to the Village of Rye Brook. Mayor Rosenberg responded that the Town Board voted to sell this property. The Town Board are elected officials; and the law gives the Board the right to sell this property. He suggested that Mr. Miloro should discuss this matter with Supervisor Carvin or Attorney Paul Noto. Board of Trustees Meeting Amended July 9,2013 Page 8 of 9 Mayor Rosenberg updated the public on some of the projects that the Board is working on. Workshops have been held to review the Village Code in order to make things easier for the residents. A creation of a shopping center zone is being considered. He noted that the Village is looking to loosen the Code in the Scenic Roads District to, depending on what you are doing, no site plan review with the Planning Board would be needed. It is also looking at ways to avoid site plan review for single family homes, depending on what type of work is proposed. The final issue is what needs to be referred to the Planning Board by the Village Board. Mr. Bradbury noted that a home on Garibaldi is being removed and a parking lot will be constructed. It is the home adjacent to the current lot on the corner of Garibaldi and Ridge Street. Mayor Rosenberg noted that the next Board of Trustees meetings were scheduled for July 23 & August 19, 2013. There being no further business before the Board, he called for a motion to adjourn.
