Bradbury, Village Administrator David Burke, Assistant to the Village Administrator Susanne Volpe, Esq., Village Counsel Mikal Nowak, Superintendent of Public Works Fred Seifert, Public Access Coordinator Paula Patafio, Meeting Secretary Mayor Paul Rosenberg welcomed everyone to the June 11, 2013 Regular Meeting of the Board of Trustees. He apologized for the late start of the meeting, and noted that the pre- meeting on Shopping Center Regulations and Streamlining Land Use Applications ran a little late, and called for the first item on the agenda: REPORT: 1) Advisory Council on Environmental Conservation regarding the Rye Brook Tree Ordinance Mr. Bradbury gave a brief presentation on this matter. He noted that last year the Village Board asked the Environmental Council to look at the tree ordinance to make it a little bit easier for some of the residents looking to do tree work. Issues arose when the recent storms have knocked over trees. The Village Board now has a report before them with the recommendations from the Environmental Council. He reviewed the recommendations made. The recommendations include additional education for Board of Trustees Meeting June 11, 2013 Page 2 residents on maintenance of trees, replanting information, the tree definition, review of the list of protected trees, the size of the trees that require permits, tree topping and the unauthorized tree removal penalties. The Council also felt that trees near residents should be given additional consideration as a result of trees that have come down and done damage during recent storms. They have also suggested that a restructuring of the tables for tree removal be done, as well as an annual review of the fee schedule for tree removal. Also addressed were the removal of dead or diseased trees and the purpose of the tree code. Mayor Rosenberg thanked the Council for their review and recommendations. The Board discussed the recommendations. Mr. Bradbury asked for clarification on some of the points brought up to see if there would be as-of-right tree removal. Mr. Nowak, Superintendent of Public Works, addressed the Board. He reviewed the areas of hardships for the residents. One area was hiring of an arborist, another area was the tree replanting requirements. Mr. Bradbury noted that some municipalities only manage street trees, and other municipalities manage all trees. We now have to find the right thing for Rye Brook to do. There is also a concern of flooding in Rye Brook and trees help prevent flooding. Mr. Nowak noted that a tree within 10' of a house has an impact to the foundation of the house. The root zone of the tree is one and a half times of the diameter of the tree. Tree roots can grow under a house's foundation. There is a website that lists certified arborists in the area. This is the first step. Mayor Rosenberg suggested that the recommendations from the Council be accepted. He thanked everyone for their work on this issue. Mayor Rosenberg called for the next item on the agenda: RESOLUTIONS: 1) Considering referring proposed amendments to the Village Code regarding referrals to the Planning Board for report and recommendation Mr. Christopher Bradbury, Village Administrator, read the following resolution: Board of Trustees Meeting June 11, 2013 Page 3 NOW, THEREFORE, BE IT RESOLVED, that the Board of Trustees hereby refers the proposed amendments to the village code to the Planning Board for report and recommendation. Mr. Bradbury noted that this was a discussion item. On a motion made by Trustee Jeffrey Rednick and seconded by Trustee David Heiser, the resolution was adopted. Mr. David Burke, Assistant to the Village Administrator, called the roll: Trustee Susan Epstein Voting Aye Trustee David Heiser Voting Aye Trustee Jason Klein Voting Aye Trustee Jeffrey Rednick Voting Aye Mayor Paul Rosenberg Voting Aye 2) Considering an extension of the Street Tree Removal contract Mr. Bradbury read the following resolution: WHEREAS, on January 10, 2012 the Village Board of Trustees awarded a Street Tree Removal bid to Central Tree Services, Inc.; and WHEREAS, in the street tree removal bid it states `the contract may be extended at the same unit prices and conditions upon mutual agreement and approval of the Board of Trustees for an additional 2 fiscal years, ending May 31, 2014% and WHERAS, on June 12, 2012 the contract was extended for the 2012-2013 fiscal year; and WHEREAS, in a letter dated April 1, 2013 from Dan Greto, President of Central Tree Services he states his desire to extend the contract for the ensuing fiscal year (2013-2014) at the same unit prices and conditions in the original contract; and WHEREAS, the Superintendent of Public Works believes it is in the best interest of the Village to enter into this extension. Board of Trustees Meeting June 11, 2013 Page 4 NOW THEREFORE BE IT RESOLVED, the Village of Rye Brook Board of Trustees hereby approves the extension to the Street Tree Removal bid for the ensuing fiscal year, June 1, 2013 to May 31, 2014, at the same unit prices and conditions of the original contract to Central Tree Services, Inc. Mayor Rosenberg noted that Central Trees has done a very good job so far. This contract is being extended at the price it was two years ago. On a motion made by Trustee Jeffrey Rednick and seconded by Trustee Susan Epstein, the resolution was adopted. Mr. Burke read the following resolution: Trustee Susan Epstein Voting Aye Trustee David Heiser Voting Aye Trustee Jason Klein Voting Aye Trustee Jeffrey Rednick Voting Aye Mayor Paul Rosenberg Voting Aye 3) Considering support of the proposed income and expense legislation in the Town of Rye Mr. Bradbury read the following resolution: WHEREAS,the Town of Rye has proposed Income & Expense legislation that would require certain income producing properties and the owner or representative that files a grievance with the Board of Assessment Review, to submit an income and expense statement or be subject to penalties. NOW, THEREFORE BE IT RESOLVED, that the Board of Trustees of the Village of Rye Brook hereby supports the proposed Town of Rye legislation requiring Income & Expense statements from income producing properties when filing a grievance with the Board of Board of Trustees Meeting June 11, 2013 Page 5 Assessment Review, and establishing penalties if Income & Expense statements are not submitted. Mr. Bradbury noted that the Village was asked for a resolution in support by the Town of Rye. This resolution puts more teeth into the legislation. Mr. Rosenberg noted that this will stop commercial entities from filing for a tax cert. This is a good piece of legislation. On a motion made by Trustee Heiser and seconded by Trustee Rednick, the resolution was adopted. If there were no other significant changes, then the summaries could be approved as submitted. He called for a motion to adopt. On a motion made by Trustee Heiser and seconded by Trustee Rednick, the resolution was adopted. The roll was called: Trustee Susan Epstein Voting Aye Board of Trustees Meeting June 11, 2013 Page 6 Trustee David Heiser Voting Aye Trustee Jason Klein Voting Aye Trustee Jeffrey Rednick Voting Aye Mayor Paul Rosenberg Voting Aye ADMINISTRATOR'S REPORT Mr. Bradbury noted that the 31st Rye Brook Birthday Parry was scheduled for Saturday, June 15th. Everyone is invited. The Ridge Street Bridge is closed. The website contains updates. There are detour signs and local traffic has increased, but trucks and delivery personnel follow the State route. People are getting used to the detours. The Village held their first Comprehensive Plan. There was a good turnout. Residents can give their input. A survey will be sent out during the summer. The Village will give notification of new issues as they are added to the website. The sluice gate is not up and running. The Ribbon Cutting Ceremony is scheduled for June 19th. Mayor Rosenberg note that the next Board of Trustees meeting are schedule for June 25th and July 9, 2013. He called or members of the public wishing to address the Board. There being no one he asked for a motion to go into executive session.
