He noted that the Board held an Executive Session prior to the meeting on property acquisition. With the permission of the Board, resolution 93 was taken out of order. 3) Considering authorizing the use of Village Streets for the 2015 Pre-Prom events. Mr. Bradbury, Village Administrator, read the following resolution: RESOLUTION CONSIDERING THE USE OF VILLAGE STREETS FOR THE BBHS SENIOR CLASS PRE-PROM EVENT RESOLVED, that the use of Birch Lane on Thursday, June 11, 2015 from 5:OOPM to 7:30PM for the Blind Brook Senior Class Pre Prom event is hereby approved with the terms to be established by the Rye Brook Police Department. Board of Trustees Meeting May 12, 2015 Page 3 Mayor Rosenberg noted that this is done annually. The police department is aware of this event. On a motion made by Trustee Susan Epstein, and seconded by Trustee Jason Klein, the resolution was adopted. Heiser voting aye Trustee Jeffrey Rednick voting aye Mayor Paul Rosenberg voting aye Mayor Rosenberg called for the first item on the agenda: REPORUPRESENTATIONS: 1) Public Discussion regarding Street Lights in Byram Ridge Mayor Rosenberg noted that a number of months ago some residents requested street lighting in the Byram Ridge Area. About a month ago a survey was sent out and a high response rate was received. A total of 84 responses were received up until today. There were six (6) questions. Sarah Bledsoe, Assistant to the Village Administrator, reviewed the questions and the percentage of responses for and against each question. Mayor Rosenberg noted that the Board scheduled this discussion in order to receive input from the residents. The Board would not be taking action at this meeting. He asked that anyone wishing to address the Board on this matter come up to the podium and state their name and address. Board of Trustees Meeting May 12, 2015 Page 4 A resident from 46 Hillendale Road addressed the Board. He was curious as to the number of residents that were sent the survey. Ms. Bledsoe noted that 113 residents received the survey. Ten (10) were returned because of invalid addresses and the survey area included Little Kings, which already has street lights. Andrew Kaminsky requested statistics on the crime rate and accidents in this area. He noted that in this area of Rye Brook there are approximately 100 homes. If needed the statistics could be put together. Michael Druckman, 6 Loch Lane, noted that he filled out the survey. He simply put yes or no and did not elaborate. At this time he has no opinion, but he felt that the survey was good and will provide information, but that the Village should not base its opinion/decision based on the survey. He noted that he did not have an opinion for or against street lights at this time. Richard Abel addressed the Board, He noted that he grew up on Edgewood Drive. He did not fill out a survey but does not see a reason to have street lights in this area. He did some research and found five crimes committed in this area: graffiti, a burglary, a DWI, the theft of unlocked car, and email scam on Loch Lane. There isn't a massive crime spree going on in this area. Mayor Rosenberg felt that street lights should not be installed because of crime but he was willing to review the matter as the request came from the residents. Mr. Abel felt that the entire Village of Rye Brook should not have to pay for the street lighting in the Byram Ridge area. Where do you stop....sidewalks, striping on the roadways? Hope Klein of Hillandale addressed the Board. She noted that the recent burglaries in Rye Brook happened in daylight hours or at twilight. Usually, most houses have some sort of an alarm system. Almost all of the homes do have outside lighting. Street lights will change the character of this neighborhood. One of the joys of getting out of the city and going to the country was the `darkness' versus city lights. In this area most of the houses are occupied. Many of the residents of this area are people who have lived here for decades. She was opposed to street lighting. Mr. Don Moscato of Edgewood Drive noted that he was opposed to street lights for this area. These five streets are special to Rye Brook. They are unique. The character of the neighborhood is an important factor. What attracted people here was the beauty and character of the neighborhood. The Comprehensive Plan is Board of Trustees Meeting May 12, 2015 Page 5 now in place. During the months of meetings, the street lights in the Byram Ridge area did not come into play at all. Mr. Dick Ruthers a resident of 45 years noted that since the day he arrived in 1969 people talk about Hillendale as being the best area of Rye Brook. There are some reasons for that, and the main reason is the character of the neighborhood. The worst thing that anyone could do to the country-feel of this area would be putting in sidewalks and lighting. Lee Velvet addressed the Board. He noted that character of where you live cannot be increased by adding lighting. Safety is a different issue. Trustee David Heiser noted that the goal of the survey was to obtain the opinion of the residents. Leo Goldman of 10 Edgewood Drive noted that he was a resident of 55 years. He addressed the Board. He noted that he wrote a letter to the Westmore News. He thought that there would be residents at the meeting in support of street lighting. Mayor Rosenberg noted that there is some unease about being for street lighting. The survey offered the opportunity to be anonymous. Mr. Goldman felt that there was no need for street lighting in this area. Mr. Funtlighter, of 17 Beechwood, addressed the Board. He felt that this area is wonderful now, but he was in favor of lights. Maybe there is some compromise. Rebecca Oling of 2 Hillendale Road addressed the Board. She noted that every place in Rye Brook is special. She questioned whether this was a matter of safety. If that is the case then the area would need more than lights. Cars tend to speed on these and she suggested speed bumps. Mr. Abel felt that people drive slower when it is darker. He questioned cost, which Mr. Bradbury will review. It was noted that there would be the cost of installation and then an ongoing cost for maintenance. Lee Montana, 36 Woodland Drive, addressed the Board. He felt that there were very important points being brought up. The people who are interested in street lights are thinking of safety. Speeding cars are an issue. Speed bumps, stop signs, a police officer can make a difference. Rye Brook is changing and there are other issues to consider. The costs of street lighting is the cost of being a community. Mike Leaven of 33 Woodland Drive addressed the Board. He noted that he did not take a great stand one way or the other. No lights did not effect his decision to Board of Trustees Meeting May 12, 2015 Page 6 move into the neighborhood. He grew up in Vermont and does find it very dark here. This is a very dark street. People are deriving very fast through the neighborhood. Mr. Funtlighter reviewed a couple of points that were raised. He noted that the question was raised as to why all of Rye Brook would have to pay for the lights in this area. Most of Rye Brook has lights; and all residents should have the same rights. Leo Goldman felt there is a need to stop the speeders. The police should be informed. Mr. Kaminsky addressed the issue. The roads have taken a beating this winter. There are stop signs, but no one every stops. When money comes out of people's pockets for tickets it stops. More patrols would help. Controlling the speed could be a positive that could come out of this discussion. Mayor Rosenberg asked for comments from the Board. Trustee Jeffrey Rednick noted that he hadn't formed an opinion regarding lights or no lights. However, he has not heard a compelling reason to put in street lights. Trustee Heiser agreed with Trustee Rednick. He questioned the purpose of installing street lighting in this area. He noted that he was leaning against the installation of street lighting. Trustee Susan Epstein noted that it is dark in the area. The real issue is not the safety of the homes but rather the safety of the pedistrians. Speeding should be addressed. She asked all residents to wear reflective clothing or carry a light when out walking. Trustee Jason Klein noted that his opinion was split. Mayor Rosenberg noted that if there was interest this matter would be placed on an agenda. He thanked everyone for their input. Mayor Rosenberg noted that the Rye Brook Police Department is going through a New York State accreditation. This is a big deal for the police department, and he commended Chief Austin for his hard work. Considering a Special Permit and Site Plan Application by New York SMSA Limited Partnership DBA Verizon Wireless for an attached public utility wireless telecommunications facility at 965 Anderson Hill Road On a motion made by Trustee Heiser, and seconded by Trustee Epstein, the public hearing was declared open. Ms. Bledsoe called the roll: Trustee Susan Epstein voting aye Trustee Jason Klein voting aye Trustee David M. Heiser voting aye Trustee Jeffrey Rednick voting aye Mayor Paul Rosenberg voting aye Michael Sheridan of Schnieder & Schnieder, attorney for Verizon Wireless, addressed the Board. He noted that this is a stealth flag pole type installation, with no flag. The proposal constructs this facility on the roof of the building. Also on the roof of the building will be equipment; surrounded on three sides by a screened wall. The equipment will be away from the front of the building. The only piece of equipment that will not be located on the roof is the generator. The Planning Board has reviewed the application and all comments from the Planning Board, consultants, and staff have been addressed. Ms. Marilyn Timpone Mohamed, Village Consultant, gave a brief overview of the discussion at the Planning Board level. They addressed several aspects of this installation. The Board had the typical concerns regarding cell towers. This tower must meet the FAA requirements. An aeronautical study was done and this will not be a hazard and they provided some requirements for the tower. As long as the requirements are met the FAA is comfortable with the placement. The Village's consultant, Michael Musso, was also comfortable that the installation is following all of the requirements for the FCC. Visual impacts were reviewed and addressed. There is very limited impact. Board of Trustees Meeting May 12, 2015 Page 8 Mayor Rosenberg called for questions or comments from members of the public and/or Board members. As there were no comments, the Mayor called for a motion to close the public hearing. On a motion made by Trustee Epstein, and seconded by Trustee Klein, the public hearing was closed. Authorizing Frederick P Clark to prepare recreation properties' zoning amendments. Mr. Bradbury, read the following resolution: INSERT RESOLUTION # 2 HERE. This is a tangible result of the Comprehensive Plan. The matter has been referred to the Planning Board. Ms. Timpone Mohamed noted her firm will do an environmental review and analysis regarding impacts that the changes in the zone may cause. Keane & Beane will be drafting the changes. Mayor Rosenberg noted that this will preserve open space. The Blind Brook Country Club has no immediate intention of closing, however, a twenty-year agreement with the Village is now coming to an end. Requesting that the New York State Department of Transportation conduct a traffic warrant study at the intersection of King Street and Comly Avenue Mr. Bradbury read the following resolution: INSERT RESOLUTION # 4 HERE. Mayor Rosenberg noted that Sgt. Arnold submitted a letter which he read into the record. It was noted that King Street is a State Road. Any type of change or signalization would need to come from New York State. The Rye Brook Village Board must make a request to New York State. Mr. Abel noted that a quarter of a mile down the road a safety issue exists. Requests were made but the State said no. This was a few years ago. There were no comments or questions on this matter. On a motion made by Trustee Susan Epstein, and seconded by Trustee Jason Klein, the resolution was adopted. It was noted that Breaking Aides bike ride will take place on September 27th, and will last for approximately three hours. On a motion made by Trustee Susan Heiser, and seconded by Trustee Klein, the resolution was adopted. Resolution referring a local law concerning the permissible locations for professional office uses to the Village of Rye Brook Planning Board. Mr. Bradbury read the following resolution: INSERT RESOLUTION # 6 HERE. Board of Trustees Meeting May 12, 2015 Page 12 This matter is being addressed as a result of the Comprehensive Plan. Mr. Bradbury noted that the Village is moving ahead with the Comprehensive Plan and this matter will be reviewed by the Planning Board and then referred back to the Board of Trustees. On a motion made by Trustee Susan Epstein, and seconded by Trustee Rednick, the resolution was adopted. Considering authorizing an agreement between the Village of Rye Brook and the Westchester County Department of Corrections for prisoner transportation. Mr. Bradbury read the following resolution: INSERT RESOLUTION # 7 HERE. Mr. Bradbury noted that this is an annual contract and the County Sets the rates, but the payments do not cover the full cost for prisoner transportation. On a motion made by Trustee Susan Epstein, and seconded by Trustee Jason Klein, the resolution was adopted. Considering Consolidated Local Efficiency Plan certifications Mr. Bradbury read the following resolution: INSERT RESOLUTION # 8 HERE. A series of municipalities are submitting an efficiency plan. Basically the Village will provide information to the county showing that there have been programs introduced in order to qualify for the New York State Tax Freeze credit program. There will be a detailed analysis completed prior to the certification. On a motion made by Trustee Epstein, and seconded by Trustee Klein, the resolution was adopted. Considering the approval of an Inter-Municipal Agreement with Westchester County for the use of the Westchester County Firing Range Mr. Bradbury read the following resolution: INSERT RESOLUTION # 9 HERE. Rye Brook's Police Department will continue to use the Harrison Range. It is an indoor range. The County has a firing range located in Valhalla. It is a state-of-the-art range with an advanced targeting system. On a motion made by Trustee Susan Epstein, and seconded by Trustee Jason Klein, the resolution was adopted. Considering the approval of an Inter-Municipal Agreement with Westchester County to access booking records contained in the RICI system Mr. Bradbury read the following resolution: INSERT RESOLUTION # 10 HERE. Board of Trustees Meeting May 12, 2015 Page 15 RICI stands for Repository for Integrated Criminalistic Information. It is a Westchester County based central computer. It allows for transmission of data and the storage of information. This contract will run from June 1, 2015 through July 30, 2020. On a motion made by Trustee Susan Epstein, and seconded by Trustee Jeffrey Rednick, the resolution was adopted. Considering entering into an agreement with the Carver Center for the use of certain facilities by the Village Recreation Department Mr. Bradbury read the following resolution: INSERT RESOLUTION # 11 HERE. This agreement is between the Rye Brook Recreation Department and the Carver Center for the Rye Brook Day Camp. The Rye Brook Day Camp will have use of the Carver Center Pool and facilities, and the Carver Center will have use of Garibaldi Park for its sport camp. Considering the approval of Minutes from April 14, 2015 Mayor Rosenberg requested that this matter be adjourned to the next Board of Trustee meeting. With the consensus of the Board, the matter was adjourned. An additional resolution was added to the agenda: 13) 528 Ellendale Avenue Mr. Bradbury read the following resolution: INSERT RESOLUTION # 13 HERE. The resolution speaks for itself. The Village purchased the Highway Garage a few years ago. It needs to be taken down and reconstructed and the Village has been attempting to purchase this property without any luck The additional piece property would allow the Village to build a proper Highway Garage. On a motion made by Trustee Klein, and seconded by Trustee Epstein, the resolution was adopted. Heiser voting aye Trustee Jeffrey Rednick voting aye Mayor Paul Rosenberg voting aye ADMINISTRATOR'S REPORT Mr. Bradbury noted that the Carnival will start on Friday at 5:00 p.m. and will run thru Sunday. He noted that his office has done a lot of outreach to communities outside of Rye Brook. Everyone is looking forward to a great event. Rye Brook's Comprehensive Plan was chosen by the Westchester Municipal Planning Federation for an accommodation. Con Ed held a post-Sandy Training session. Done on a beautiful day, and Rye Brook was pleased to be select to participate in this event. There was a great event at the Possilipo Center — Elvis made an appearance and there was a nice turnout for Mother's Day. The next Board of Trustees meetings are scheduled for May 26th and June 9th.
