Mayor Paul Rosenberg called the October 28, 2014 Board of Trustees meeting to order.
He noted that the Board held an Executive Session prior to the meeting on
Implementation of the Comprehensive Plan and Police Matters. He apologized on the
late start of the Regular Meeting. He announced that the first item on the agenda was the
report from the NYPA Energy Service Program.
REPORT/PRESENTATIONS:
1) NYPA Energy Service Program: LED Street Lights
Mr. Alemany from NYPA addressed the Board. Mr. Alemany gave a quick
background. The power authority provides low cost power to municipalities. The
other area that is supported is helping customers reduce energy usage. The Village
is eligible for the Energy Efficiency Program. The goal is to ultimately reduce the
energy consumption. Low cost financing is also provided. NYPA implements
projects on lighting retrofits, heating, street lighting. In order to participate in
these programs there is a two stage approach. If there is an interested party a
program agreement is executed. The next step is the contract itself; which outlines
the details of the specific project. The contract includes the scope of work, energy
savings and the costs.
Mayor Rosenberg noted that the Board has discussed a change in street lighting in
order for the Village so it can be much more energy efficient. The Village lights
were changed eight years ago. If the Village decides to move forward, Mayor
Rosenberg asked what the commitment would be. Mr. Alemany noted that the
first step is a standard agreement. This agreement essentially says if you are
interested in doing `anything' then these are conditions that both parties are
agreeing to. It is non-committal. The Village of Rye Brook has expressed an
interest in replacing the street lighting throughout the Village. This is part of the
Westchester Countywide Street Lighting initiative. An inventory will be taken to
determine how many fixtures will be needed. The goal is to come up with a
number of Villages and a number of fixtures to be replaced so that everyone can
benefit. There are multiple types of fixtures in Westchester County. It is not a
`one-size-fits-all.'
Mr. Christopher Bradbury, Village Administrator, noted that a master agreement is
before the Board. NYPA noted that there is another contract that is much more
project specific that comes later. Village Counsel is reviewing this contract. Not
modification seems to be happening and there is a bit of a `leap of faith.' There is
some risk, but the upside is obtaining cost effective lighting. There are stop points
in the project; opt out areas. This is a good thing. The drawback is that if the

Village opts out any costs that have been incurred during that phase must be
reimbursed.
Mr. Alemany noted that costs are disclosed upfront. The power authority will bear
these costs unless the Village opts out or until the project is complete. Mayor
Rosenberg noted that the Village is in the middle of an energy audit.
Mr. Alemany stated that NYPA can use the audit, but must analyze it to make sure
that it is consistent and that it contains all of the information that is needed.
Mr. Bradbury noted that the Village is doing a full community audit. The database
may not be 100% correct. Street lights are not based on actual usage. The cost
savings includes the history of the street lighting.
Mayor Rosenberg noted that the service agreement will be signed, and then the
audit, when complete, can be turned over to NYPA. The next step would be to
review the lighting that needs to be replaced. Then the bidding comes next.
Mayor Rosenberg asked at what point does it start to cost the Village money?
Mr. Alemany noted that a solicitation for the fixtures will go out. Then there is the
feasibility portion of the project. If the projects goes to the end, then all of these
costs are rolled in.
Trustee David Heiser asked if there is a minimum number of municipalities that
need to participate. The response was that there is no minimum number, but at
this time there are six municipalities interested in participating. Mr. Bradbury
noted that the timeframe has been extended.
Trustee Susan Epstein asked if there was an idea of what type of discount would
be offered. Mr. Alemany noted a conservative discount of 10% on the purchase
price is being looked at. You must also consider the favorable interest rates and
the savings that will be seen with the new fixtures. There are two solicitations.
The first is for the fixture and the second is the labor.
Mr. Bradbury noted that the staff has questions such as what happens if they do
not like the design of the lighting. There are some other municipal consortium
programs out there. There are programs for municipalities that do not want to put
out funds upfront. These programs have lower risks.
Trustee Epstein noted that the costs are standard. Mr. Alemany noted that NYPA
is a state agency. A standard rate has been approved. Mayor Rosenberg called for
the consensus of the Board. Mr. Bradbury was given direction to continue the
process.

Mayor Rosenberg called for the first public hearing on the agenda:
On a motion made by Trustee Rednick, and seconded by Trustee Heiser, the
public hearing was declared open.

Mr. Bradbury noted that the Village has been collecting and receiving applications
electronically. This helps staff internally when processing of applications. There
are two local laws that have been drafted. These local laws were reviewed by the
Planning Board and it recommended approval.
Mayor Rosenberg reviewed applications that would be completed electronically.
Some applicants would still need to submit applications electronically and as a
hard copy. The applications can be scanned and sent to the Village via email as a
PDF. Mr. Bradbury noted some applications are longer than others, but the
applications are all on line. The applicants need to have some documents
notarized, and there are notaries on staff. Mayor Rosenberg noted that the
Planning Board prefers paper applications. Large scale plans are easier to review
and make notes on. Mayor Rosenberg noted that electronic submission should be
able easy and perhaps the Village can offer scanning at $.25 per page.
Mr. Bradbury noted that the Village can only scan standard sized paper.
Trustee Epstein noted that this would be an accommodation. If someone requests a
FOIL, they are charged for the copies. Charging for scanning would be in the
same line.
Mr. Michel Nowak, Superintendent of Public Works, addressed the Board. He
noted that the Village is changing software. An original signature is needed and it
must be the signature of the homeowner. The permit is emailed to the applicant.

Some departments need one copy, some departments need two or three. The
Village is trying to cut back on the number of copies needed. The Village is now
in the middle of a major project. Mayor Rosenberg suggested a change as of
January, 2016. Mr. Bradbury noted that original signatures are needed.
Mr. Nowak noted that operationally if an application is before the Planning Board,
the documents must be posted online on the Village's website. Information is
uploaded in laser-fiche. Changing the Code now will cut back on the amount of
time the Village spends on scanning documents. The ability to ask the applicants
to submit documents electronically is a big help. Mayor Rosenberg noted that
there are some applications, with larger copies, that can be handed in as
hardcopies. The wider, architectural drawings cannot be scanned. Making this
change would create the need to purchase additional computers.
Mayor Rosenberg called for members of the public wishing to address the Board.
There being no one, Mr. Bradbury was directed to review this matter further.

RESOLUTION
CONSIDERING LOCAL LAWS TO AMEND VARIOUS CHAPTERS OF THE
VILLAGE CODE REGARDING ELECTRONIC SUBMISSION OF LAND USE
APPLICATIONS AND ADMINISTRATIVE PERMIT APPLICATIONS
WHEREAS, the Village of Rye Brook Board of Trustees desires to make certain
modifications to the Village Code to require electronic submission of land use
applications and administrative permit applications; and
WHEREAS, a proposed local law was introduced to amend various Chapters of the
Code of the Village of Rye Brook, as set forth in the local law, to require electronic
submissions of application materials for administrative permits; and
WHEREAS, a second proposed local law was introduced to amend various Chapters
of the Code of the Village of Rye Brook, as set forth in the local law, to require electronic
submissions of land use application materials; and
WHEREAS, on August 19, 2014 the Board of Trustees of the Village of Rye Brook
determined that the proposed action to be a Type II Action pursuant to the New York
State Environmental Quality Review Act (SEQRA) and therefore no further
environmental review is required; and
WHEREAS, on August 19, 2014 the Board of Trustees referred the proposed local
laws to the Planning Board for report and recommendation and such report and
recommendation was adopted by the Planning Board on September 11, 2014; and
WHEREAS, the local laws were referred to the Westchester County Department of
Planning pursuant to New York General Municipal Law §239-m and the Westchester
County Administrative Code and a response was received on October 14, 2014 which
stated the action is a matter for local determination; and
WHEREAS, on October 15, 2014 the local laws were referred to the Town of Rye,
Town/Village of Harrison, Village of Port Chester, Town of Rye, Town of Greenwich,
CT, Port Chester Rye Union Free School District and the Blind Brook Union Free School
District, pursuant to New York General Municipal Law §239-nn and the Westchester
County Administrative Code; and
WHEREAS, on October 28, 2014, the Board of Trustees opened a public hearing on
the subject local laws, at which time all persons interested were given an opportunity to

speak on behalf of or in opposition to said local laws, and the Board of Trustees closed
the public hearing on October 28, 2014.
NOW, THEREFORE, BE IT RESOLVED, that the Board of Trustees hereby
adopts the two subject local laws amending various chapters of the Village Code to
require electronic submission of land use applications and administrative permit
applications.
There was no more discussion on this matter.

2) Considering a request for the removal of a significant tree at 19 Berkley
Drive.
Mr. Bradbury read the following resolution:
RESOLUTION
CONSIDERING A REQUEST FOR THE REMOVAL OF A
SIGNIFICANT TREE AT 19 BERKLEY DRIVE
WHEREAS, the property owner of 19 Berkley Drive has submitted a tree
removal application to the Village of Rye Brook; and
WHEREAS, under section 235-21 of the Village of Rye Brook Village Code no
Significant Tree over 36" DBH shall be removed without the approval of the Village
Board of Trustees; and
WHEREAS, said tree is considered a Significant Tree.

NOW, THEREFORE BE IT RESOLVED, the Board of Trustees hereby
[approves/denies] the Tree Removal Permit application made by the property owner of
19 Berkley Drive for the removal of the following:
One (1) Oak tree approximately 38" in diameter (DBH) [;
AND BE IT FURTHER RESOLVED, the property owner of 19 Berkley Drive
shall replant two (2) trees as required by code in consultation with the Village
Superintendent of Public Works.]
Mayor Rosenberg noted that Mr. Nowak has submitted his comments and opinion. After
a review the application was approved.

3. Authorizing the Village of Rye Brook to enter into an inter-municipal
agreement with the Town of Rye regarding tax liens.
Mr. Bradbury read the following resolution:
RESOLUTION
AUTHORIZING THE VILLAGE OF RYE BROOK TO ENTER
INTO AN INTER-MUNICIPAL AGREEMENT WITH THE TOWN
OF RYE REGARDING TAX LIENS

WHEREAS, the Village of Rye Brook (the "Village") and the Town of Rye (the
"Town") are municipal corporations duly organized and existing under the laws of the
State of New York; and
WHEREAS, the Board of Trustees of the Village of Rye Brook and the Rye
Town Council are desirous of entering into an Inter-Municipal Agreement (the
"Agreement") pursuant to which the Town of Rye (the "Town") will assist the Village in
collecting (a) Property Maintenance Code and other charges due and owing to the Village
from property owners within the Village; and (b) escrow fees due and owing to the
Village for outside professional services rendered to the Village in connection with the
Village's review of land use applications for real properties located within the Village;
and
WHEREAS, the Town Council has authorized the Town to enter into the
Agreement and the Town has signed the Agreement on October 21, 2014; and
WHEREAS, the Board of Trustees wishes to authorize the Village to enter into
said Agreement.
NOW, THEREFORE, BE IT RESOLVED, that the Board of Trustees of the
Village of Rye Brook hereby authorizes the Village to enter into the Inter-Municipal
Agreement with the Town of Rye.
BE IT FURTHER RESOLVED, that the Mayor is hereby authorized to execute
this Agreement and all documents necessary to accomplish its purposes.
Mr. Bradbury noted that when a property is in dire need of maintenance, this local law
will allow the Village to do the work and then recover the costs. This happens after all
other areas have been exhausted. This resolution puts in place a process where the
Village can receive reimbursement via tax liens. This is something that will be done
when all other options have been expired. Edward Beane, Esq., Village Counsel, noted
that this agreement has to do with foreclosures. The Town Board has been very
cooperative working with the Village on this agreement.

4. Setting a public hearing for a local law to amend Chapter 240 of the
Village Code regarding parking restrictions for Talcott Road.
Mr. Bradbury read the following resolution:
RESOLUTION
SETTING A PUBLIC HEARING FOR A LOCAL LAW TO AMEND CHAPTER
240 OF THE VILLAGE CODE REGARDING PARKING RESTRICTIONS FOR
TALCOTT ROAD
VILLAGE OF RYE BROOK BOARD OF TRUSTEES
WHEREAS, the Village of Rye Brook Traffic Commission has requested certain
modifications to the Village Code regarding parking restrictions for Talcott Road; and
WHEREAS, a proposed local law was introduced to amend Chapter 240 of the
Village Code entitled "Vehicles and Traffic," to implement certain parking restrictions
for Talcott Road.
NOW, THEREFORE, BE IT RESOLVED, that the Board of Trustees of the
Village of Rye Brook determines that the proposed action is a Type II Action pursuant to
the New York State Environmental Quality Review Act (SEQRA) and therefore no
further environmental review is required.
BE IT FURTHER RESOLVED, that the Board of Trustees of the Village of Rye
Brook shall hold a public hearing on November 25, 2014 at 7:30p.m. at Village Hall, 938
King Street, Rye Brook, New York, to consider the proposed local law.

Mr. Bradbury noted that this is clean-up of the local law. Most of the signage is already
up.

5. Considering authorization of commencement of a lawsuit pursuant to NY
Village Law §7-714 to enforce provisions of the Zoning Code of the Village
of Rye Brook, including injunctive relief.
Mr. Bradbury read the following resolution:
RESOLUTION
CONSIDERING AUTHORIZATION OF COMMENCEMENT OF A LAWSUIT
PURSUANT TO NY VILLAGE LAW §7-714 TO ENFORCE PROVISIONS OF
THE ZONING CODE OF THE VILLAGE OF RYE BROOK, INCLUDING FOR
INJUNCTIVE RELIEF
WHEREAS, the Board of Trustees of the Village of Rye Brook has determined to
institute a legal action in the Supreme Court of the State of New York, County of
Westchester, against the owner of a parcel of real property located in the Village of Rye
Brook, to enforce the provisions of its Zoning Code and the New York State Residential
Building Code and to remediate a cure of violations of these Codes by said property
owner;
NOW, THEREFORE, BE IT RESOLVED that the Village of Rye Brook is
hereby authorized to commence legal action in the New York Supreme Court, County of
Westchester, against the owner of the property located at 109 North Ridge Street, Rye
Brook, New York, referenced as Section 135.67, Block 2, Lot 4 on the Village of Rye
Board of Trustee Meeting

Brook Tax Map for injunctive and other relief requiring said owner to comply with the
Village of Rye Brook Zoning Code and New York State Residential Building Codes, to
remediate certain conditions at said property that are in violation of these Codes, and for
other and further relief, and
BE IT FURTHER RESOLVED, that the Mayor, Administrator, Building
Inspector and Assistant Building Inspector, are hereby authorized to sign any and all
documents related to, necessary and for the specific purpose of instituting and
prosecuting such legal action; and
BE IT FURTHER RESOLVED, that the Village Attorney is hereby authorized to
commence this litigation on behalf of the Village.
Edward Beane, Esq., Village Counsel, gave a general background. When you win a
criminal case there is a fine. A civil action must be brought and it is the only way to
obtain full financial relief.
Mayor Rosenberg requested typographically corrections to the resolution.

AUTHORIZING A FOOD SERVICE AGREEMENT WITH A
CATERER AT THE AJP COMMUNITY/SENIOR CENTER

WHEREAS, the Board of Trustees of the Village of Rye Brook and Hubbard's
Cupboard LLC are desirous of entering into a two (2) year Catering Agreement in which
Hubbard's Cupboard LLC will provide catering and related services to the seniors at the
Rye Brook senior center located at 32 Garibaldi Place, Rye Brook, NY.
WHEREAS, the Board of Trustees wishes to authorize the Village to enter into
said Catering Agreement.
NOW, THEREFORE, BE IT RESOLVED, that the Board of Trustees of the
Village of Rye Brook hereby authorizes the Village to enter into a Catering Agreement
with Hubbard's Cupboard LLC, subject to modifications of the Village Counsel.
BE IT FURTHER RESOLVED, that the Mayor is hereby authorized to execute
this Catering Agreement and all documents necessary to accomplish its purposes.
Mayor Rosenberg thanked Villa Rustica who has been catering for the Senior Center.
The Village is grateful.

RESOLVED, that voting machines owned by the County of Westchester shall be
used at the next Village Election to be held Wednesday, March 18, 2015; and be it further
RESOLVED, that if said voting machines are not available, the Westchester
County Board of Elections has the authority to change to the use of paper ballots; and be
it further
RESOLVED, that the polls in each of the nine Election Districts in the Village of
Rye Brook shall be opened at 6:00 AM in the morning and remain open until 9:00 PM in
the evening of said day; and be it further

have been used in prior elections. Everything went smoothly.

NOW, THEREFORE BE IT RESOLVED, that the Village of Rye Brook Board of
Trustees hereby certifies the approval of the minutes for the meetings held on September
9, 2014, September 23, 2014 and October 14, 2014

On a motion made by Trustee Heiser, and seconded by Trustee Epstein the resolution was
adopted:

Mayor Rosenberg noted that with the consensus of the Board an additional resolution was
added.
9) Authorizing an Agreement with CGI Communications, Inc to
participate in a community showcase video program
Mr. Bradbury read the following resolution.
RESOLUTION (ADDED)
AUTHORIZING AN AGREEMENT WITH CGI
COMMUNICATIONS, INC TO PARTICIPATE IN A
COMMUNITY SHOWCASE VIDEO PROGRAM
WHEREAS, the Board of Trustees of the Village of Rye Brook and CGI
Communications Inc. are desirous of entering into an Agreement in which CGI
Communications Inc. will provide community-based videos for the Village of Rye Brook
web site at no cost to the village.
NOW, THEREFORE, BE IT RESOLVED, that the Board of Trustees of the
Village of Rye Brook hereby authorizes Village to enter into an Agreement with CGI
Communications Inc. to Participate in a Community Showcase Video Program to provide
the community-based videos for the Village of Rye Brook at no cost to the village,
subject to modifications of the Village Counsel.
BE IT FURTHER RESOLVED, that the Mayor and Administrator are hereby
authorized to execute this Agreement and all documents necessary to accomplish its
purposes.

This company provides videos for municipality websites. This is a cost-free project for
the municipalities. The Village has a lot of input regarding advertisers that are used on
the videos. These videos will help promote some of the good things done in the Village.
The Village does not make any recommendations, positive or negative, for advertisers.

Mayor Rosenberg asked the permission of the Board to read a statement. He noted that
there have been a few robberies in the Village recently, and as a result an email blast has
been sent out. He read a portion of the email sent to the residents, and noted that
additional information could be reviewed on the Village's website.
Mayor Rosenberg noted that Tuesday is Election Day. It is not a Village election but it is
an election in terms of State elections. There is a referendum on the ballet for the Town
of Rye changing the positions of Superintendent of Highways and Receiver of Taxes
from an elected position to an appointed position.
Mayor Rosenberg called for the Administrator's Report:
ADMINISTRATOR'S REPORT:
Mr. Bradbury reminded everyone that Halloween is Friday and he wished everyone a
happy and safe holiday. The parks are closed at dusk. Police will be patrolling and any
eggs or shaving cream or the like will be confiscated.
This weekend is Rye Brook's intergenerational fall clean up. Liz Rotfeld has been
working on this project. A one-time fall yard clean up is offered to seniors who need this
type of assistance. Information is on the Village's website. This is a great event.

Mayor Rosenberg noted that Liz Rotfeld was recently honored by the Port Chester/Rye
Brook Chamber of Commerce. There was a great turn out, and Rye Brook is very proud
of her.
Mayor Rosenberg reminded everyone that the next Trustee meetings were scheduled for
November 10 and November 25.
Mayor Rosenberg called for questions or comments from members of the public. There
being none, the meeting was adjourned at 9:02 p.m.
