Rosenberg VILLAGE STAFF: Christopher Bradbury, Village Administrator Greg Austin, Chief of Police Michel Nowak, Superintendent of Public Works Suzanne Volpe, Village Counsel Fred Seifert, Public Access Coordinator/IT Paula Patafio, Meeting Secretary Board of Trustees October 14,2014 Page 2 Mayor Paul Rosenberg called the October 14, 2014 Board of Trustees meeting to order. He noted that the Board held an Executive Session prior to the meeting on Personal Appointments and Firefighter Negotiations. He announced that the first item on the agenda, the report from the NYPA Energy Service Program was postponed at NYPA's request. This matter will be placed on the October 8th Board of Trustees' agenda. Mayor Rosenberg called for the first item on the agenda: PUBLIC HEARINGS: 1) Public hearing for a proposed local law to modify Chapter 235, Trees. Mayor Rosenberg noted that this is another attempt to streamline the Village Code. The changes allow for a suspension of the tree ordinance in the time of a severe storm, change some of the requirements, and allows for replanting. There is also some clean up and clarification within the Code. Mr. Christopher Bradbury, Village Administrator, noted that these changes will make the process a little less burdensome. The changes include comments from the Environmental Counsel and Village Staff. On a motion made by Trustee Epstein, and seconded by Trustee Heiser, the public hearing was declared open. Mr. Bradbury called the roll: Trustee Susan R. Epstein voting aye Trustee David M. Heiser voting aye Trustee Jason A. Klein voting aye Trustee Jeffrey Rednick voting aye Mayor Paul Rosenberg voting aye Trustee Klein commented on the temporary suspension granted as a result of an emergency. He felt that residents should have to submit the permits after the fact. Mayor Rosenberg noted that this suspension will only apply in the case of a natural disaster. This change deals with the trees that have fallen, as well as those that are leaning, or in danger of falling. The Board discussed trees that have had an application submitted to remove them but the application was denied then, during the suspension, they are removed. The question is how will anyone know if the tree was really compromised during the storm or if advantage was Board of Trustees October 14,2014 Page 3 taken and the tree was removed during the suspension. Mayor Rosenberg noted that this type of scenario would be very difficult to enforce. Trustee Klein made a motion to amend the resolution to include a requirement for residents to come in and file an application for tree removal if a tree permit was denied on the tree that was removed during a suspension. Trustee Rednick suggested that all residents be required to submit an Affirmation of what trees were removed and what necessitated the removal. The goal is to stop a resident who wanted to take a tree down, the application was denied, and they tree remained until the storm, at which time the resident removed the tree. Being required to come in after the fact also helps meet the planting requirements. Trustee Heiser noted that the knowledge of having to file an Affirmation would be a cause for `second thoughts.' Trustee David Heiser seconded Trustee Klein's motion. There being no further discussion, and no members of the public wishing to address the Board on this matter, Mayor Rosenberg called for a motion to close the public hearing. On a motion made by Trustee Heiser, and seconded by Trustee Klein, the public hearing was declared closed. Mr. Bradbury called the roll: Trustee Susan R. Epstein voting aye Trustee David M. Mr. Bradbury read the following resolution. Board of Trustees October 14,2014 Page 4 RESOLUTION CONSIDERING A PROPOSED LOCAL LAW MODIFYING VILLAGE CODE CHAPTER 235, TREES WHEREAS, the Village of Rye Brook Board of Trustees desires to make certain modifications to the Village Code concerning Chapter 235, Trees; and WHEREAS, in June 7, 2013 the Village Board discussed several recommendations made by the Advisory Council on Environmental Conservation (ACEC) to modify Village Code Chapter 235, Trees; and WHEREAS, a proposed local law amending Chapter 235, Trees, has been prepared incorporating the recommendations of the ACEC as well as other code modifications recommended by village staff and Village Board; and WHEREAS, on September 9, 2014 the Board of Trustees of the Village of Rye Brook determined that the proposed action is an Unlisted Action, pursuant to the State Environmental Quality Review Act ("SEQRA"); and WHEREAS, on October 14, 2014, the Board of Trustees opened a public hearing on the subject local laws, at which time all persons interested were given an opportunity to speak on behalf of or in opposition to said local laws, and the Board of Trustees closed the public hearing on October 14, 2014. NOW, THEREFORE, BE IT RESOLVED, that upon review of the information stated in the Environmental Assessment Form and all other information in the record, the Board of Trustees hereby determines that adoption of the subject local laws will not result in any significant adverse environmental impacts and hereby adopts the annexed Negative Declaration; and BE IT FURTHER RESOLVED, that the Board of Trustees hereby adopts the subject local law amending Chapter 235, Trees. Board of Trustees October 14,2014 Page 5 Trustee Rednick requested clarification, noting that each application is taken on a case-by-case basis. Ridge Street), to the Planning Board for a report and recommendation. Mr. Bradbury read the following resolution: RESOLUTION REFERRING AN APPLICATION FOR SPECIAL PERMIT AMENDMENT FOR PROPERTY AT 79 SOUTH RIDGE STREET (AKA 93 SOUTH RIDGE STREET) TO THE VILLAGE OF RYE BROOK PLANNING BOARD FOR REPORT AND RECOMMENDATION WHEREAS, the Board of Trustees is in receipt of an application by property owner Ridge Street Rye Brook, LLC for approval of an amendment to the existing Special Permit to change the hours of operation from 8:00a.m.-9:00p.m. to 6:00a.m.-9:00p.m. for the gasoline station located at 79 South Ridge Street (aka 93 South Ridge Street), at the intersection of South Ridge Street and Bowman Avenue, designated as Parcel ID 141.27-1-13 on the Town of Rye Tax Map and located in the Cl Zoning District; and Board of Trustees October 14,2014 Page 6 WHEREAS, the Board of Trustees is the Approval Authority for the application; and WHEREAS, the Board of Trustees, pursuant to the State Environmental Quality Review Act (SEQRA) determines the proposed action to be an Unlisted Action pursuant to SEQRA. NOW, THEREFORE, BE IT RESOLVED, that the Board of Trustees hereby refers the application for a proposed Special Permit amendment to the Planning Board for report and recommendation. BE IT FURTHER RESOLVED, that the Board of Trustees directs that, pursuant to General Municipal Law §239-m and Westchester County Administrative Code §277.61, the application shall be referred to Westchester County Department of Planning for comment no less than 30 days prior to the public hearing concerning the application. Attorney Volpe, Village Counsel from the firm of Keane & Beane, noted a relationship between her firm and Carey Wolf. A waiver letter has been prepared and executed, and signed by the Mayor. The letter was read into the record. Carey Wolf addressed the Board as the representative for the applicant. The modification being requested is to the hours of operation. The greater concern is to keep the gas station open for commuters and so it does not address the store. Mayor Rosenberg noted that this is a special use permit. He asked if a fire suppression system would be added to the pumps. Mr. Carey noted that there will be changes to the lighting and signage, and canopies over the pumps are being contemplated but these issues, and the fire suppression requirements, were not an issue at this time. The proposed changes at this time are solely to the house of operation. Trustee Rednick questioned if the hours would be extended at a later date. The representative responded that this is not the intent. On a motion made by Trustee Klein, and seconded by Trustee Epstein, the resolution was adopted. The roll was called: Trustee Susan R. Mr. Bradbury read the following resolution: RESOLUTION CONSIDERING THE TEMPORARY CLOSURE OF BOWMAN AVENUE FOR FILMING WHEREAS, Freeheld Productions, LLC has requested the use of Bowman Avenue between Ridge Street and Westchester Avenue on October 21, 2014 between the hours of 7:00 A.M. and 12:00 noon for the purpose of filming a motion picture titled "Freeheld"; and WHEREAS, Freeheld Productions, LLC has applied for several film permits from the Village of Rye Brook to prepare this film, and is working with the Rye Brook Police Department and Port Chester police departments to coordinate traffic control services on this day, which will involve interruptions and detours as part of the filming activities. NOW, THEREFORE BE IT RESOLVED, that the Rye Brook Board of Trustees authorizes Freeheld Productions, LLC to use Bowman Avenue between Ridge Street and Westchester Avenue on October 21, 2014 based upon the following conditions: 1) From 7:00 A.M. to 9:00 A.M., is it understood that this section of Bowman Avenue will need intermittent traffic control and will have service interruptions, but it will not be closed or detoured throughout this time frame; and 2) From 9:00 A.M. to 12:00 noon, this section of Bowman Avenue will be closed to traffic and vehicles will be detoured. AND BE IT FURTHER RESOLVED, that this approval is subject to Freeheld Productions, LLC representatives following the coordination and direction of the Rye Brook and Port Chester police departments at all times to minimize any traffic control problems at may arise. BE IT FURTHER RESOLVED,that the Board of Trustees approved the use of Village Hall on Friday, October 17, 2014 from lam to 6pm. Board of Trustees October 14,2014 Page 8 There will be some disruptions in this area during the filming, but the Port Chester and Rye Brook Police will be on location. Mr. Bradbury read the following resolution: RESOLUTION CONSIDERING AUTHORIZING USE OF VILLAGE STREETS FOR THE TAMARACK TOWER FOUNDATION THANKSGIVING DAY TURKEY TROT WHEREAS, the Tamarack Tower Foundation requests permission to hold its annual Thanksgiving Day Turkey Trot on Thursday, November 27, 2014 from 9:30 AM to 10:30 AM. NOW THEREFORE BE IT RESOLVED, that the Village of Rye Brook Board of Trustees hereby authorizes the use of Village streets on November 27, 2014 from 9:30 AM to 10:30 AM along the route described in the letter dated October 3, 2014 from Rosemarie Barone, Event Chairperson; and be it FURTHER RESOLVED, that Village streets shall be used in compliance with the terms and/or conditions established by the Village of Rye Brook Police Department. Board of Trustees October 14,2014 Page 9 Mayor Rosenberg noted that this is an annual event. Trustee Rednick noted that this is a great event. Mr. Bradbury read the following resolution: RESOLUTION CONSIDERING A BID AWARD FOR CONTRACT 14-08: "VARIOUS RECTREATIONAL SPORTS SHIRTS". WHEREAS, the Village of Rye Brook has solicited bids for Contract 14-08: "Various Recreational Sports Shirts"; and WHEREAS, a public notice was duly advertised in an official newspaper of the Village of Rye Brook on September 12, 2014; and WHEREAS, at 11:00 a.m., Monday, September 29, 2014, all received bids were opened and summarized below: BIDDER Bid Triple Crown Sports, Old Bridge NJ $6,566.00 Board of Trustees October 14,2014 Page 10 Buddy's All Stars, Burbank CA $12,224.02 Fusion Graphics, Montgomery NY $13,653.08; and WHEREAS, another bid from Woods Men's and Boy's Clothing of Brentwood NY was mailed to village offices in timely manner but the bid was not opened as it was not received by the Village Clerk prior to the bid opening; and WHEREAS, upon review of the bids, the Village Administrator and Superintendent of Public Works/ Engineer have determined that all of the bids that were opened either did not receive or complete the correct bid document or submitted incomplete bids. NOW THEREFORE BE IT RESOLVED, that based upon the aforementioned errors or problems that occurred with this bid, contract 14-08: "Various Recreational Sports Shirts", is hereby rejected in its entirety; and be it FURTHER RESOLVED that the Mayor and Administrator are hereby authorized to execute and deliver all documents necessary or appropriate to accomplish the purpose of this resolution. Mr. Bradbury noted that there was an assortment of issues. Two of the bids were incomplete, one was delivered over the weekend and never opened, and the bids received did not meet the requirements. The bidders will be notified. On a motion made by Trustee Epstein, and seconded by Trustee Heiser, the resolution was adopted. Mr. Bradbury called the roll: Trustee Susan R. Mr. Bradbury read the following resolution: Board of Trustees October 14,2014 Page 11 RESOLUTION CONSIDERING A BID AWARD FOR CONTRACT 14-09: "VILLAGE HALL HVAC REPLACEMENT". WHEREAS, the Village of Rye Brook has solicited bids for Contract 14-09: "Village Hall HVAC Replacement"; and WHEREAS, a public notice was duly advertised in an official newspaper of the Village of Rye Brook on September 12, 2014; and WHEREAS, at 10:00 a.m., Monday, September 29, 2014, all received bids were opened and summarized below: BIDDER Base Bid Alt. 1-5 Total Bid Macchi Heating LLC $45,994 $33,591 $79,585 Joe Lombardo Plbg & Htg $74,500 $66,200 $140,700 UAP Inc. $75,000 $96,000 $171,000 WHEREAS, upon review of the bids, the Village Administrator and Superintendent of Public Works/ Engineer have determined the lowest responsible bidder meeting the requirements of the contract document is Macchi Heating, LLC in the amount of $45,994 for the base bid plus $33,591 for Alternates 1-5 for a total bid price of$79,585. NOW THEREFORE BE IT RESOLVED,that contract Contract 14-09: "Village Hall HVAC Replacement", is hereby awarded to Macchi Heating, LLC in the amount of $45,994 for the base bid plus $33,591 plus Alternates 1-5 for a total bid price of $79,585; and be it FURTHER RESOLVED, that the Mayor and Administrator are hereby authorized to execute and deliver all documents necessary or appropriate to accomplish the purpose of this resolution; and be it FURTHER RESOLVED, that $1,000.00 be transferred from Contingency Account 91990.424 to this capital project account. Board of Trustees October 14,2014 Page 12 Mr. Michel Nowak, Superintendent of Public Works, addressed the Board. He reviewed the State requirements for efficient and noted that Rye Brook exceeds the requirements. As part of the budget every year, he noted that he reaches out obtains actual numbers. He has received the numbers from the manufactures. Trustee Klein noted that he was comfortable with the energy efficiency. On a motion made by Trustee Heiser, and seconded by Trustee Epstein, the resolution was adopted. Mr. Bradbury called the roll: Trustee Susan R. Epstein voting aye Trustee David M. NOW THEREFORE BE IT RESOLVED, that Contract 14-10: "Village-wide street tree removal, pruning & associated work" is hereby awarded to Central Tree Service in the amount of$29,861.00 for the base bid [plus $9,960 for Alternate B for a total bid price of$39,821.001; and be it FURTHER RESOLVED that the Mayor and Administrator are hereby authorized to execute and deliver all documents necessary or appropriate to accomplish the purpose of this resolution. Mr. Bradbury reviewed the bid. Normally many months after the pruning has taken place the cleanup work and seeding is done. This base bid includes the contractor doing all of the work. Village Staff feels that this is a good option. Mayor Rosenberg noted that removing a street tree should include cleanup and replanting. There are approximately 100 removed per year. This is a three year contract. The Village is thrilled over the number of bids that were received, and the interest in the bids in general. On a motion made by Trustee Epstein, and seconded by Trustee Rednick, the resolution was adopted. Board of Trustees October 14,2014 Page 14 Mr. Bradbury called the roll: Trustee Susan R. Mr. Bradbury read the following resolution: RESOLUTION CONSIDERING A TEMPORARY WEEKLY STIPEND FOR A VILLAGE EMPLOYEE NOW, THEREFORE BE IT RESOLVED, that in recognition of temporary additional responsibilities assigned, the Secretary to the Administrator shall receive a temporary weekly stipend in the amount of $125.00 retroactive to October 1, 2014; and be it further RESOLVED, that this stipend shall continue as long as there is a staff shortage in the Administrator's Office and Public Work's Office, but in no event shall it continue beyond December 31, 2014 without further Village Board approval. Mr. Bradbury noted that there is a shortage of staff. This employee has pitched in and helped during that shortage On a motion made by Trustee Klein, and seconded by Trustee Rednick, the resolution was adopted. Mr. Bradbury read the following resolution: RESOLUTION AUTHORIZING A DATE CHANGE FOR THE 2014 VILLAGE ELECTION WHEREAS,Village elections are usually held on the third Tuesday of March; and WHEREAS, the third Tuesday of March 2015 falls on March 170i, St. Patrick's Day. NOW, THEREFORE BE IT RESOLVED, that the Village Board of Trustees hereby amends the date of the 2015 Village election to be held on Wednesday, March 18, 2015. Mr. Bradbury noted that the election law moves the Election Day because of this holiday. On a motion made by Trustee Epstein, and seconded by Trustee Heiser, the resolution was adopted. Klein voting aye Trustee Jeffrey Rednick voting aye Mayor Paul Rosenberg voting aye Board of Trustees October 14,2014 Page 16 10) Considering the submission of an application to Solarize Westchester to participate in the Solarize Westchester Campaign to educate and encourage additional residential and small commercial solar installations in Rye Brook. Mr. Bradbury read the following resolution: RESOLUTION CONSIDERING THE SUBMISSION OF AN APPLICATION TO SOLARIZE WESTCHESTER TO PARTICIPATE IN THE SOLARIZE WESTCHESTER CAMPAIGN TO EDUCATE AND ENCOURAGE ADDITIONAL RESIDENTIAL AND SMALL COMMERCIAL SOLAR INSTALLATIONS IN RYE BROOK. WHEREAS, the village intends to submit an application to Sustainable Westchester to participate in a"Solarize Westchester" campaign funded through NYS Energy Research and Development Authority (NYSERDA); and WHEREAS, if the village is one of eight Westchester municipalities selected, the village, through the "Solarize Westchester" campaign, would provide educational information and encourage the growth of solar installations for residential and small business customers over an 18-week community outreach campaign; and WHEREAS, as part of the "Solarize Westchester" campaign, a solar vendor would be selected through a competitive process where residents and small businesses could voluntarily install solar at reduced rates. NOW, THEREFORE BE IT RESOLVED, that the Board of Trustees of the Village of Rye Brook hereby supports the submission of a competitive grant application to Sustainable Westchester to participate in a "Solarize Westchester" campaign funded through NYS Energy Research and Development Authority (NYSERDA); and be it further RESOLVED, that the Mayor and Village Administrator are hereby authorized to sign any documents that accomplish the purpose of this grant application. Board of Trustees October 14,2014 Page 17 Trustee Klein noted that this is an attempt to provide education to the residents. Mr. Bradbury noted that this is an intense process for a short period of time. Trustee Klein has been working on this matter. Mayor Rosenberg noted that this is a great opportunity. At the request of Mayor Rosenberg, and with the consensus of the Board, the review of minutes was adjourned to next meeting. ADMINISTRATOR'S REPORT: Mr. Bradbury noted that the paving of roadways in the Village is mostly complete. The next stage is the curbing and line striping. All the streets, other than High Street, are done. Beginning on October 1, 2014, the leaf collection program is underway and has been moving along well. Information is on the Village's website. Please keep the piles out of the roadways, and as tight as possible. For safety reasons, residents are asked to make sure that foreign objects are kept out of the pile. This is for safety issues and for the equipment. Rye Brook will be holding its annual Halloween in the Park event on October 17 and October 18 in Rye Hills Park from 6:00p.m. to 9:00p.m. This highly anticipated event will include a hayride along a haunted trail and is $2.00 per person per ride. Board of Trustees October 14,2014 Page 18 Refreshments will also be available. Please note that attendees must park in Crawford Park for this event. Please come and have a frighteningly good time! Mr. Bradbury announced that, as of today, the new street sweeper is now on the road. The leaf loader should be in within the next two weeks. Mayor Rosenberg noted that he and Trustee Epstein went to a grand opening of TD Bank on Ridge Street. It was a great event and the Bank surprised the Mayor with donation. Mayor Rosenberg also attended the grand Reopening of the Salon in Washington Park Shopping Center. He wished all good luck. The next Board meetings are scheduled for October 28 and November 10. Mayor Rosenberg called for comments or questions from members of the public. There being none, he called for a motion to adjourn and return to Executive Session.
