He noted that the Board held an Executive Session prior to the meeting on Police and Fire Contract Negotiations. Board of Trustees Meeting April 22,2014 Page 2 of 16 Following the Pledge of Allegiance, Mayor Rosenberg called for the first item on the agenda: REPORUPRESENTATIONS: 1. Recognizing the 6TH Grade Westchester County Center Basketball Championship Team. Mayor Rosenberg called the roll for the Westchester County Boy's Basketball team. Each player was presented with a Certificate and congratulate. Mayor Rosenberg presented the coaches Certificates and congratulated all on winning the 84th Championship at the Westchester County Center. He noted that the boys for the team that play at the County Center are chosen by the Rec. Department and their coaches. 2. Presentation on Draft Village of Rye Brook Comprehensive Plan Mayor Rosenberg called for the next item on the agenda. He noted that the Comprehensive Plan Advisory Committee consisted of the following members: Carol Goodman, Chair Dominic Accurso, Jr. Joe Fiscella John Grieco Sari Jablon Toby Marrow Marcia Rogull Jamie Schutzer Tania Vernon Jeffrey Rednick, Board of Trustee Liaison Chris Bradbury, Village Administrator Joan Feinstein, former Mayor ex officio Susan Favate of BFJ Planning gave a PowerPoint Presentation of the Comprehensive Plan. She noted that the proposed draft plan is available on the Village's website PlanRyeBrook.org. Compilation of this draft plan included a survey and four (4) work sessions. Recommendations and comments were reviewed and included in this draft. The Plan follows Westchester County's baseline and has fifteen (15) chapters. Reviewed Board of Trustees Meeting April 22,2014 Page 3 of 16 were land use and zoning Ms. Favate thanked everyone for their hard work and input. Mayor Rosenberg thanked everyone for their time spent over the past year working on putting together this plan. The next step is for the Board of Trustees to declare itself Lead Agency. Mayor Rosenberg called for questions from the Board. Mr. Bradbury noted that this document will be circulated to other municipalities and the County. He thanked the Council for addressing the Blind Brook Club, and thanked the Board for addressing this open space. Mr. Bradbury noted that comments for keeping the area for recreation and/or less dense housing if it comes to that has been received by the Village. Mayor Rosenberg pointed out that there is a lot to absorb. Although not a public hearing, he called for members of the public wishing to address this matter. There being no comments, Mayor Rosenberg called for the resolution on this matter. RESOLUTIONS: 1) Considering the designation of lead agency and setting a public hearing on the draft Village of Rye Brook Comprehensive Plan Mr. Bradbury read the following resolution: WHEREAS, the Rye Brook Comprehensive Plan Advisory Committee has submitted a draft Comprehensive Plan to the Rye Brook Village Board; and WHEREAS, said Comprehensive Plan has been prepared in accordance with NYS Village Law and provides a guide for land use and development decisions, the adoption of municipal regulations and the investment of public funds for infrastructure; and WHEREAS, the adoption of a Comprehensive Plan is classified as a Type I action under Part 617 of the State Environmental Quality Review Act ("SEQR"); and WHEREAS, the Village Board directed its planning consultants, BFJ Planning, to complete an Environmental Assessment Form ("EAF") pursuant to SEQR, and said EAF was submitted to the Village Board dated April 15, 2014; and Board of Trustees Meeting April 22,2014 Page 4 of 16 WHEREAS, there are no other known involved agencies pursuant to SEQR, and the Village Board therefore intends to be Lead Agency for completing the environmental review and making the required Determination of Significance on the proposed action; and WHEREAS, the proposed Comprehensive Plan must be referred to the Westchester County Department of Planning for review; and WHEREAS, the Rye Brook Village Board must conduct a public hearing on the proposed Comprehensive Plan. NOW, THEREFORE, BE IT RESOLVED, that the Rye Brook Village Board hereby declares itself as Lead Agency to coordinate the environmental review of the proposed action; and BE IT FURTHER RESOLVED, that the Rye Brook Village Board does hereby schedule a public hearing on the proposed Comprehensive Plan to be held at 7:30 p.m., May 13, 2014, and May 27, 2014, at the Rye Brook Village Hall, 938 King Street, Rye Brook,New York, 10573; and BE IT FURTHER RESOLVED, that the Rye Brook Village Board directs that the draft Comprehensive Plan be referred to the Westchester County Department of Planning for review and comment pursuant to General Municipal Law §239-m. Rosenberg voting aye Mayor Rosenberg called for the next resolution on the agenda: 2) Referring an application for site plan amendment at Rye Ridge Shopping Center to the Planning Board for report and recommendation Board of Trustees Meeting April 22,2014 Page 5 of 16 Mr. Bradbury read the following resolution: WHEREAS, the Board of Trustees is in receipt of an application by property owner Win Properties, Inc. for approval of an amended site plan for the Rye Ridge Shopping Center located at 100-150 South Ridge Street, 1-34 Rye Ridge Plaza, 158- 204 South Ridge Street, at the intersection of South Ridge Street and Bowman Avenue, designated as Parcel ID 141.27-1-7, 141.27-1-6 and 141.35-2-36 on the Town of Rye Tax Map and located in the C1-P Zoning District; and WHEREAS, the Board of Trustees is the Approval Authority for the application; and WHEREAS, the Board of Trustees, pursuant to the State Environmental Quality Review Act (SEQRA) determines the proposed action to be an Unlisted Action pursuant to SEQRA. NOW, THEREFORE, BE IT RESOLVED, that the Board of Trustees hereby refers the application for a proposed site plan amendment to the Planning Board for report and recommendation; and BE IT FURTHER RESOLVED, that the Board of Trustees authorizes the Village Planning Consultant to circulate Notice of Intent to Declare Lead Agency, pursuant to SEQRA, to all known Involved Agencies on behalf of the Board of Trustee; and BE IT FURTHER RESOLVED, that the Board of Trustees directs that, directs that, pursuant to General Municipal Law §239-m and Westchester County Administrative Code §277.61, the application shall be referred to Westchester County Department of Planning for comment no less than 30 days prior to the public hearing concerning the application and further directs that, pursuant to General Municipal Law §239-nn, notice of public hearing shall be sent to the Village of Port Chester for comment no less than 10 days prior to the public hearing concerning the proposed site plan amendment. Rosenberg voting aye Mr. Jim Ryan of John Myers Consulting addressed the Board on behalf of the applicant. Also in attendance was Richard Pierson of John Myers Consulting. The idea is to simplify the process and make it easier for applicants coming in, as well as make it easier for the owners of the shopping center to rent out open space. The Planning Board has reviewed this matter. Mayor Rosenberg noted that the Village is trying to be a good neighbor. The shopping center is very important to the Village. This gives the shopping center a little more certainty when leasing space. Trustee Rednick noted that he would like to see additional information on the parking spaces and times and months for peak parking. There are times when it is a little tougher to park and you cannot park in front of the store you are going to, but there are plenty of open spaces within the shopping center's parking lots. Some of the spaces in the shopping center are utilized by the neighbors and by the school. Considering this usage, it was found that there are still parking spaces available. The goal is to make sure there are parking spaces for patrons. The third resolution was called before the Board. 3) Considering adoption of the Village of Rye Brook 2014-2015 Annual Budget Mr. Bradbury read the following resolution: WHEREAS, the Village Administrator filed the Tentative Budget on March 20, 2014; and Board of Trustees Meeting April 22,2014 Page 7 of 16 WHEREAS, the Board of Trustees held two budget work sessions on March 25 and April 1, 2014; and WHEREAS, the Board of Trustees held a public hearing on April 8, 2014 pursuant to the notice of Public Hearing regarding the Tentative Budget, at which time all those wishing to be heard on behalf of or in opposition to the proposed budget were given the opportunity to be heard and the public hearing was closed at that time; and WHEREAS, on January 25, 2005 the Board of Trustees adopted a local law allowing for homestead base proportions, and on March 25, 2014 the Board of Trustees adopted a resolution establishing base proportions of 72.051834% for homestead properties and 27.948166% for non-homestead properties for the purposes of the 2014-15 tax levy; and WHEREAS, the total taxable assessed value for Village tax purposes is $2,481,651,350 and based upon the amendments made by the Village Board and discussed at the budget work sessions and public hearing, would result in a homestead tax rate of$5.06 and a non-homestead tax rate of$7.98 per $1,000 of assessed valuation ($5.64 tax rate blended overall); and WHEREAS, the Village Board authorizes the Receiver of Taxes to collect the property taxes necessary to raise the required $13,987,981 tax levy based upon the most updated Assessment Roll provided by the Assessor. and be it FURTHER RESOLVED, that the amounts listed therein for payment of principal and interest on indebtedness, and that maintenance account charges identified in the budget be paid, and that the salaries, wages, benefits and other terms and conditions of employment for all employees, including those not represented by a bargaining unit, shall be paid such salaries and benefits as have been determined by the Board of Trustees; and be it FURTHER RESOLVED, that the Village Board does hereby authorize the tax levy for the sum of $13,987,981 for general, capital, and special maintenance account funds, which based upon the Town of Rye tax roll of $2,481,651,350 for the Village of Rye Brook and applying the approved homestead base proportions to determine the tax rates, would result in a homestead tax rate of$5.06 and a non-homestead tax rate of$7.98 per thousand of assessed valuation. A lot of work went into this budget. The Village could have increased the tax cap by over 7.59%. Mayor Rosenberg noted that this is a great budget and he thanked everyone for their hard work. There are several capital projects and a lot of street paving in the budget. All Department Heads were thanked for being so realistic with their budget requests. Mr. Bradbury noted that staff asked for only what they need. On a motion made by Trustee Heiser, and seconded by Trustee Klein, the resolution was adopted. The roll was called: Trustee Susan R. Rosenberg voting aye Board of Trustees Meeting April 22,2014 Page 11 of 16 4) Considering the authorization of funds for the 2014 Memorial Day and Veterans Day ceremonies to be paid to the American Legion Mr. Bradbury read the following resolution: WHEREAS, the American Legion, Port Chester Post 93, will host the 2014 Memorial Day Ceremony; and WHEREAS, the Village of Rye Brook Village Board would like to assist the American Legion with this event. NOW, THEREFORE BE IT RESOLVED, that the Village of Rye Brook will pay one thousand dollars ($1,000.00) to the American Legion for its 2014 Memorial Day Ceremony and for any potential 2014 Veterans Day Ceremony. On a motion made by Trustee Kleine, and seconded by Trustee Epstein, the resolution was adopted. It was noted that this donation is made annually. The roll was called: Trustee Susan R. Rosenberg voting aye 5) Considering appointment of the Chair of the Ethics Board Mr. Bradbury read the following resolution: CONSIDERING APPOINTMENT OF THE CHAIR OF THE ETHICS BOARD RESOLVED,that Andrew Zeitlin is hereby appointed Chair of the Ethics Board Board of Trustees Meeting April 22,2014 Page 12 of 16 At the request of the chairman of the Ethics Board, a replacement chairperson was chosen. Rosenberg voting aye 6) Considering an Equitable Sharing Agreement with the US Department of Justice and participation in the NYS Office of Attorney General's Community Overdose Program (COP) Mr. Bradbury read the following resolution: WHEREAS,the Village of Rye Brook Police Department desires to participate in an Equitable Sharing Program with the US Department of Justice; and WHEREAS, through this program, the Department of Justice distributes an equitable share of forfeited property and proceeds to participating state and local law enforcement agencies that directly participate in an investigation or prosecution that result in a federal forfeiture; and WHEREAS, local communities enrolled in the Equitable Sharing Program may participate in the NYS Office of Attorney General's Community Overdose Prevention (COP) program, which was established to fund the training and equipping of eligible law enforcement agencies throughout NYS with nasally-administered naloxone that can save the life of a person in the midst of an acute opioid overdose. Board of Trustees Meeting April 22,2014 Page 13 of 16 NOW, THEREFORE BE IT RESOLVED, the Village of Rye Brook and Rye Brook Police Department are hereby authorized to participate in the US Department of Justice Equitable Sharing Program through the Equitable Sharing Agreement; and be it FURTHER RESOVED, the Village of Rye Brook Police Department is hereby authorized to participate in the NYS Office of Attorney General's Community Overdose Prevention (COP) program; and be it FURTHER RESOVED, the Mayor, Administrator and Chief of Police are hereby authorized to sign and execute all documents necessary to accomplish the purpose of this resolution. Chief Gregory Austin addressed the Board. He noted that because of the Heroine epidemic taking over Hudson Valley, this project has been funded. The funds are coming from the U.S. Department of Justice. The first step is to sign an agreement. There is training. Every officer will have access to the Maloxon. Rosenberg voting aye 7) Considering authorizing the renewal of a Westchester County Department of Health Food Service Permit application to operate a food service establishment at the Anthony J. Posillipo Community Center Mr. Bradbury read the following resolution: Board of Trustees Meeting April 22,2014 Page 14 of 16 WHEREAS, the Westchester County Department of Health Sanitary Code requires that a food service permit be obtained from the Department of Health to operate a food service establishment; and WHEREAS, the Anthony J. Posillipo Community Center serves and operates a food service establishment and would like to renew their application for such permit in order to comply with all rules and regulations of the Westchester County Department of Health. NOW, THEREFORE, BE IT RESOLVED, that the Village of Rye Brook Board of Trustees hereby authorizes the Deputy Village Clerk and Mayor to apply for a renewal of a food service permit for the Anthony J. Posillipo Community Center and to execute and deliver to the Westchester County Department of Health, for and on behalf of the Village, a renewal application for a permit to operate a food service establishment and to execute and deliver any and all additional documents which may be appropriate or desirable in connection therewith. Mr. Bradbury noted that this is a renewal of the Food Service Permit for the AJP Community Center. On a motion made by Trustee Rednick, and seconded by Trustee Epstein, the resolution was adopted. Rosenberg voting aye ADMINISTRATOR'S REPORT Mr. Bradbury began his report by noting that Westchester County has installed two additional ventilators in the detention ponds to help with the smell of the deicing chemicals used at the airport. They are examining the outflow pipe. The Village is continuing to follow this issue. Board of Trustees Meeting April 22,2014 Page 15 of 16 The second Carnival for the Village of Rye Brook is scheduled for May 2nd through the 4th. There is a lot of information out there about the carnival, and residents can find times and dates on the Village's website. Mr. Bradbury noted that there are other community events on the Village's calendar, including a benefit concert for the Ambulance Corp. More information can be find on the Village's website. This Friday, April 25th, there will be an Arbors Day ceremony held at Pine Ridge Park. Jennifer Gray, Village Consultant, from the Firm of Keane and Beane has been selected by the Westchester Business Council as a rising star. Congratulations to Attorney Gray and Keane & Beane. Attorney Beane noted that she is very deserving of this award. The Police Department will be having a prescription drug take back day sponsored in conjunction with Blind Brook car wash. Some sidewalks on Westchester Avenue near Bowman are being repaired. Additional information can be found on the Village's website. Mayor Rosenberg called for members of the public wishing to address the Board. There being no one, he noted that the next Board of Trustees meetings were scheduled for May 13 and May 27, 2014. The Arbor's Day ceremony starts at 9:00 a.m. at Pine Ridge Park on April 24, 2014.
