Mayor Paul Rosenberg called the Tuesday, June 9th meeting of Board of Trustees
meeting to order. He noted that the Board held an Executive Session prior to the
meeting on Board on property acquisition. He also noted that Christopher
Bradbury, Village Administrator, was absent. Sarah Bledsoe, Assistant to the
Village Administrator, would be assisting the Board this evening; reading the
resolutions and calling the roll.
Mayor Rosenberg began the meeting with the presentation of awards to the Rye
Brook 6th Grade Boys' Basketball Team.
REPORT/PRESENTATIONS:
1) 6th Grade Basketball Honors
Mayor Rosenberg announced that this is the second year in a row that the Rye
Brook 6th grade boys have won the competition at the Westchester County Center.
He read a proclamation prepared for the 85th Tournament Champions. He called
each of the players on this year's team and presented them with the proclamation
and then congratulated the Coaches on a well-played season. The trophy is
currently in the lobby at Village Hall.
The next item under Report/Presentations was called before the Board.
2) Denise Knauer, Town of Rye Assessor — presentation on tax
assessment process and tentative tax rolls
Ms. Diane Knauer gave a Power Point Presentation. She noted that the
assessments have been going up. This does not necessarily mean that the taxes
will increase. She suggested that residents review the information available on the
website. You can check assessments for neighboring homes, obtain information
on the grievance process, and print forms for the grievance process. Grievance
Day has been scheduled for June 16th.

Mayor Rosenberg thanked Ms. Knauer and stated that the presentation was very
informative. Trustee Rednick question what percentage Port Chester and Rye
Neck properties went up. Ms. Knauer noted that it was 10% for Port Chester and
14% for Rye Neck.
Trustee Epstein stated that the information and website is very user friendly. She
questioned the increase to commercial properties. Ms. Knauer stated that
properties are looked at by class. Coops went up, by not a significant amount, less
than 5%. Trustee Epstein noted that each home is not re-evaluated.
Ms. Knauer explained that the evaluations are done by using the neighborhood and
then given a neighborhood code. The sales in the neighborhood are reviewed and
the increase is applied. Factors that are looked at include the style of the home.
The increase is not across the Board.
Trustee David Heiser questioned how many houses were in each neighborhood.
Ms. Knauer noted typically there are 300 to 700 homes in each neighborhood.
Mayor Rosenberg pointed out that when grieving the taxes you need to compare
sales data for your neighborhood. There is a tax roll that can be reviewed. The
roll is in the New York State format. Municipalities use this format. The best
point of reference to start with is your street. You can also Google sales in Rye
Brook, New York.
Mayor Rosenberg stated that in some of the developments the homes are almost
exactly the same and yet the appraisals are not the same. Ms. Knauer responded
that if someone previously grieved their taxes, or did construction on their home,
then it could be different. Also if one was sold and one was not, there is more
information on the one that was sold. Valid sales are reviewed. Three analyses
were done this year and overall the numbers were the same. When doing a
comparable selection you need to choose homes that are similar to yours. If you
feel that there is an inequity, you can file a Grievance. The more information
provided the better it is. The Grievance Forms are due up to June 16th. There is
no cost to file a grievance. There is a nominal $30.00 fee to go to the next level. If
you file a grievance the Assessor's Office will not raise your assessment.
Lisa Dubin, a resident, had some questions about the website. There is a section
for improvements, but her home had no improvement. Mayor Rosenberg noted
that if you have done work on your home and you filed a building permit and
received a Certificate of Occupancy, then the improvements are added in the
calculations.

Mayor Rosenberg noted that when permits are pulled then the information
becomes available. We provide the information to the Town. Residents should
review the information and file a grievance if there are discrepancies.
A question was raised regarding the Village's Budget Process. Mayor Rosenberg
went over the process. He noted that residents are always invited. The 2014-2015
budget tax was done. Rye Brook is within the New York State Tax Cap. Ways to
help the residents in Rye Brook were discussed during the Budget process.
Newsletters regarding the budget are sent out every year. Hopefully next year
more residents will become involved. The Board tries to find ways to help
residents stay in Rye Brook.
Mayor Rosenberg thanked Ms. Knauer for her insightful presentation.
With the Board's permission, Mayor Rosenberg moved resolution #5 to the top of
the agenda.
5) Considering an appointment to the Airport Advisory Council
Ms. Sarah Bledsoe, Assistant to the Village Administrator, read the following
resolution:

CONSIDERING APPOINTMENTS
TO THE AIRPORT ADVISORY COUNCIL
BE IT RESOLVED, that Seth Pariser of 25 Fellowship Lane shall be appointed
to the Airport Advisory Council to fill a vacancy for a three year term that shall expire on
the first Monday of April 2018; and be it
FURTHER RESOLVED, that Stewart Simon of 9 Lawridge Dr. shall be
appointed to the Airport Advisory Council to fill the unexpired term of Nancy Ruskin for
a term that shall expire on the first Monday of April 2016; and be it
FURTHER RESOLVED, that Gerry DePinto of 1 Bayberry Close shall be
appointed to the Airport Advisory Council to fill the unexpired term of Dee Schmid for a
term that shall expire on the first Monday of April 2016.

Mayor Rosenberg thanked all of the volunteers that have served on the Airport
Advisory Council. Many residents have stepped forward and have been appointed
to various Village Boards.
On a motion made by Trustee Rednick, and seconded by Trustee Epstein, the

Mayor Rosenberg moved to the Public Hearing portion of the agenda. He called

Mayor Rosenberg noted that the affordable housing units at BelleFair are starting
to show their age. The residents would like to make some capital improvements,
such as new roofs, but they would not be able to get this money out at the point of
sale. This is unfair. People should want to live in these units. The local law will
now be revised to allow the seller to capture a portion of the repairs.

Mr. Bradbury, Village Administrator, discussed this matter with the General
Manager of BelleFair. Ms. Bledsoe noted that the numbers could be revised.
A resident addressed the Board. He felt that the numbers should reflect actual
versus estimated. Mayor Rosenberg noted that the numbers could be reviewed,
and he suggested approving the resolution at this meeting.

CONSIDERING A LOCAL LAW AMENDING CHAPTER 6 OF THE
VILLAGE CODE REGARDING MAJOR CAPITAL IMPROVEMENTS
FOR AFFORDABLE MIDDLE-INCOME UNITS AT BELLEFAIR
VILLAGE OF RYE BROOK BOARD OF TRUSTEES
WHEREAS, the Village of Rye Brook Board of Trustees desires to make
certain modifications to Chapter 6 of the Village Code to permit selling owners of
affordable middle-income units at BelleFair to recapture the cost of major capital
improvements, as defined by the local law, upon the sale of the unit; and

WHEREAS, a proposed local law was introduced on May 26, 2015 to amend
Chapter 6 of the Code of the Village of Rye Brook to implement the purpose set
forth above; and
WHEREAS, on May 26, 2015 the Board of Trustees of the Village of Rye
Brook determined that the proposed action to be a Type II Action pursuant to the
New York State Environmental Quality Review Act (SEQRA) and therefore no
further environmental review is required.
WHEREAS, the Board of Trustees of the Village of Rye Brook held and
closed a public hearing on June 9, 2015 to consider the proposed local law.
NOW, THEREFORE, BE IT RESOLVED, that the Board of Trustees of
the Village of Rye Brook hereby authorizes the proposed amendments to Chapter 6
of the Village Code regarding mayor capital improvements for affordable middle-
income units at BelleFair.
On a motion made by Trustee Heiser, and seconded by Trustee Epstein, the

Mayor Rosenberg called upon the applicant for a brief description of the Studio,
including days and times of operation, the number of employees, and traffic.
It was noted that parking will be off street, in the driveway. Photos of the
driveway have been submitted with the application. Most classes are individual
classes so a lot of traffic will not be generated. There are no employees, except
the owner. The classes are an hour to an hour and fifteen minute class and they
are set times. There are also some workshops. Days of the week were discussed.
There would be smaller group classes. Signage was also discussed.

2) Considering a Tier IH Home Occupation Permit for a Yoga Studio at

CONSIDERING A TIER IIII HOME OCCUPATION PERMIT
FOR A YOGA STUDIO AT 16 LINCOLN AVENUE
WHEREAS,Ms. Maegan Walton, owner of 16 Lincoln Avenue desires to
receive a Tier III Home Occupation Permit for the use of residence as a Yoga Studio; and

WHEREAS, Ms. Walton has submitted a Tier III Home Occupation Permit
Application to the Building Department; and
WHEREAS, Ms. Walton has outlined the hours of operations and number of
employees for the proposed Home Occupation in accordance with the Village of Rye
Brook Code.
WHEREAS, a public hearing was held on June 9, 2015 to consider the Tier III
Home Occupation Permit under the terms and conditions set forth in the Village Code
and was subsequently closed on June 9, 2015.
NOW, THEREFORE BE IT RESOLVED, that the Board of Trustees of the
Village of Rye Brook hereby grants a Tier III Home Occupation Permit to Ms. Maegan
Walton for a Yoga Studio at 16 Lincoln Avenue, Rye Brook, NY in accordance with the
Village Code and only for the hours of 7:00am to 8:00 pm on weekdays and 9:00am to
9:00pm on weekends.
The resolution was amended to include specific days and times of operation.
On a motion made by Trustee Rednick, and seconded by Trustee Epstein, the
resolution was adopted, as amended.

establish a Community Choice Aggregation Energy Program in
the Village of Rye Brook for June 23, 2015

RESOLUTION
SETTING A PUBLIC HEARING REGARDING CONSIDERATION OF A
LOCAL LAW TO ESTABLISH A COMMUNITY CHOICE AGGREGATION
ENERGY PROGRAM IN THE VILLAGE OF RYE BROOK
WHEREAS,the Village Board is interested in establishing a Community Choice
Aggregation Energy Program in the Village of Rye Brook in an effort to save money for
residents
NOW, THEREFORE BE IT RESOLVED, that the Board of Trustees of the
Village of Rye Brook shall hold a public hearing on June 23, 2015 at 7:30pm at Village
Hall, 938 King Street, Rye Brook, New York, to consider the proposed local law.
Mayor Rosenberg noted that Sustainable Westchester has made several
presentations. Trustee Klein noted that Sustainable Westchester is looking for
municipalities to join them. Currently the bills come from Con Ed but they are not
the producers of the energy. Sustainable Westchester will negotiate a lower rate
for electricity and a lower BTU for gas. If they cannot find a lower bidder they
will not proceed. If a resident in Rye Brook has not already switched, they will be
automatically enrolled in the program but they can opt out. Only 25% of people
have switched from Con Ed. Sustainable Westchester will be going out to bid.
Residents will be switched to whoever Sustainable Westchester negotiates the
lowest bid with and designates as the provider. The opt out option is offered
without any type of penalty. If a resident has problems with the transmission line,
they would still call Con Ed. Nothing changes.
Mayor Rosenberg noted that packets of information will be sent to the residents
explaining the process. The goal is to obtain lower rates for the residents.
Trustee Heiser suggested that all residents come to the public hearing to vote on
this matter. All questions can be answered at the public hearing.
Edward Beane, Esq., Village Counsel, noted that he will review this local law in
detail, as well as the resolutions passed by other municipalities.
On a motion made by Trustee Klein, and seconded by Trustee Epstein, the
resolution was adopted.

4. Considering a bid award for Contract #15-12: Recreation Bus
Transportation
Ms. Bledsoe read the following resolution:
RESOLUTION
CONSIDERING AWARDING THE BID FOR CONTRACT #15-12 "BUSES FOR
VARIOUS SUMMER CAMP TRIPS (COACH/SCHOOL BUSES)"
WHEREAS, the Village of Rye Brook has solicited bids for Contract #15-12,
"Buses for Various Summer Camp Trips (Coach/School Buses); and,
WHEREAS, the bid for Contract#15-12_was advertised in the Vestmore News as the
Official Newspaper of the Village of Rye Brook on May 1, 2015, and was also made available
on the Empire State Purchasing Group bid system;and
WHEREAS, at 11:00 am on Friday,May 22, 2015 the Village Administrator opened
one (1) sealed bid as summarized below:

J&R Tours $7.600.00 No Bid
AND WHREAS, although the Village of Rye Brook Procurement Policy requires
that purchase contracts over $10,000 and public works contracts over $20,000 are subject to
competitive bidding, since the village did not receive any bid response for school buses which
are urgently needed for the upcoming Rye Brook summer camps, the village solicited
multiple written quotes from bus companies for school buses; and
WHEREAS, four (4) responses were received from bus companies for school buses
and are summarized below:

NOW, THEREFORE BE IT RESOLVED that following review of the bids of
Contract #15-12 by the Village Administrator, the Superintendent of Public Works, and the
Parks and Recreation Superintendent, the Village Board of Trustees hereby determines that
the lowest responsible bidder for coacb buses is J&R Tours in the total estimated amount of
$7,600, and
BE IT FURTHER RESOLVED, that since the village did not receive any
responses to Contract #15-12 to provide scbool bus service which are urgently needed for the
upcoming recreation camp season, the Village of Rye Brook Board of Trustees hereby
waives the requirement in the village's Procurement Policy for a formal bid and authorizes
the selection of Town Bus Co. as the vendor who provided the lowest written quote to
provide scbool bus service for the Village of Rye Brook.
It was noted that the school buses are used much more than the recreation buses.
Mayor Rosenberg stated that there was a meeting with the Blind Brook School
Board last night, and shared services were discussed. Camp is starting in a few
weeks so there is not enough time to work with the school district for this year's
camp.
There were no additional comments or questions so Mayor Rosenberg called for a
motion to approve.

6) Considering the rejection of a bid for Basketball Court Resurfacing at
Pine Ridge Park.
Ms. Bledsoe read the following resolution:
RESOLUTION
CONSIDERING REJECTING THE BIDS FOR CONTRACT #15-10
PINE RIDGE COURT BASKETBALL COURT RESURFACING PROJECT
WHEREAS, The Village of Rye Brook has solicited bids for Contract#15-10; Pine
Ridge Basketball Court Resurfacing Project;and,
WHEREAS, at 11:00am on Thursday,May 28, 2015, two (2) bids were received and
opened as summarized below:

Sport Tech Construction $ 71,980
Thomas Hinding $ 74,500
WHEREAS,upon review of the bids, the Village Administrator and Village
Engineer have determined that the lowest bid amount of$71,980 exceeds the funding
available for the project.
NOW, THEREFORE BE IT RESOLVED, that all bids for contract#15-10
Pine Ridge Basketball Court Resurfacing Project are hereby rejected.
Mr. Michel Nowak, Superintendent of Public Works, addressed the Board. He
noted that this type of work is more specific than paving roads. It is not the type
of work that the contractor paving the roads could do. The bids received came in
too high. The next steps would be to hold a meeting to review this project. This
was a multiple approach project. There is a drainage issue and damage was done
to the court from the heavy equipment used to rebuild the wall. The project will
be put out to bid again.

7) Considering a contract extension with Central Tree Services, Inc.
Ms. Bledsoe read the following resolution.
RESOLUTION
CONSIDERING AN EXTENSION OF THE STREET TREE REMOVAL
CONTRACT
WHEREAS, on October 14, 2014 the Village Board of Trustees awarded a Street
Tree Removal bid to Central Tree Services, Inc.; and
WHEREAS, in the street tree removal bid it stated `the contract may be extended
at the same unit prices and conditions upon mutual agreement and approval of the Board
of Trustees for an additional fiscal year, term beginning June 1, 2015 ending May 31,
2016% and
WHEREAS, in a letter dated June 2, 2015 from Dan Greto, President of Central
Tree Services he states his desire to extend the contract for the ensuing fiscal year at the
same unit prices and conditions in the original contract; and
WHEREAS, the Superintendent of Public Works believes it is in the best interest
of the Village to enter into this extension.
NOW THEREFORE BE IT RESOLVED, the Village of Rye Brook Board of
Trustees hereby approves the extension to the Street Tree Removal bid for the ensuing
fiscal year, June 1, 2015 to May 31, 2016, at the same unit prices and conditions of the
original contract to Central Tree Services, Inc.
This is a standard contract that will be extended. Central Tree Services has done a
good job so far. They are local, responsive, and attentive to Rye Brook.
On a motion made by Trustee Epstein, and seconded by Trustee Heiser, the

RESOLUTION
CONSIDERING A REQUEST FOR THE USE OF HARKNESS PARK BY THE
BLIND BROOK-RYE FEDERATION OF TEACHERS FOR AN EVENT
WHEREAS, in an email dated June 8, 2015, Robin Willig, of the Blind Brook—
Rye Federation of Teachers requested the use of Harkness Park on Tuesday, September
1, 2015 from 4:OOpm to 6:OOpm to host the "Blind Brook-Rye Federation of Teachers
Meet and Greet."
NOW THEREFORE BE IT RESOLVED, the Board of Trustees of the Village
of Rye Brook hereby approves the use of Harkness Park on Tuesday, September 1, 2015
from 4:OOpm to 6:OOpm for the "Blind Brook- Rye Federation of Teachers Meet and
Greet."
Mayor Rosenberg noted that this is the fourth year for this event. It gives the
teachers an opportunity to meet the parents. It is an informal setting. The
addition of this resolution was noted on the Village's website.
On a motion made by Trustee Rednick, and seconded by Trustee Klein, the
resolution was adopted.

RESOLUTION

CONSIDERING AN AGREEMENT WITH THE TOWN AND VILLAGE OF
HARRISON FOR USE OF THE FIRE PREVENTION TRAILER FOR THE
ANNUAL RYE BROOK BIRTHDAY CELEBRATION
WHEREAS,the Village of Rye Brook wishes to use the Fire Prevention Trailer,
owned by the Town of Harrison, as an attraction for the Annual Rye Brook Birthday
Celebration;
NOW, THEREFORE BE IT RESOLVED, that the Village of Rye Brook Board
of Trustees hereby approves the agreement with the Town and Village of Harrison for use
of the Fire Prevention Trailer and authorizes the Mayor and Village Administrator to
execute and deliver all documents necessary and appropriate to accomplish the purposes
of this resolution.
The trailer will be at the Rye Brook Birthday Party on June 20th. This is a
simulated fire trailer which will teach children how to survive a fire. There are
firefighters inside and the children will be taught how to deal with a real fire.
On a motion made by Trustee Epstein, and seconded by Trustee Rednick, the
resolution was adopted.

Administrative Report
Ms. Bledsoe, Assistant to the Village Administrator, noted that Saturday, June
20th, is Rye Brook's 33rd birthday celebration. It will be held at Crawford Park
from 12:00 noon to 4:00 p.m. and everyone is invited. Information is on the
Village's website.
She also noted that Grievance Day has been scheduled for June 16th, from 2:00
p.m. to 4.00 p.m., and from 6:00 p.m. to 8:00 p.m., on a first come first serve
basis. Available information can be found on the Town of Rye's website.

Ms. Bledsoe noted that the Port Chester/Rye Brook Public Library drive is coming
up.
DISCUSSION ITEMS:
1) Countywide Plastic Bag Ban
Trustee Jason Klein noted that a few years ago he brought this matter before the
Board. Other municipalities have a plastic bag ban, and he asked the Board to
consider this type of ban for Rye Brook. On November 26th Legislator Katherine
Parker along with others, had introduced the possibility of a countywide ban.
Katherine Parker has informed the Village that the Country has prepared a
resolution to be signed and passed. Mayor Rosenberg noted that the Committee
was going to go out and talk to the stores within the Village to get their input.
Trustee Klein responded that the Committee was asked to hold off on this and wait
and see what the feelings of the Board of Trustees was.
Specific sizes of bags are included in the resolution. The question of enforcement
was raised by Ms. Bledsoe. Whose responsibility will this be? This matter would
need to be looked into.
Trustee David Heiser felt that this was fine. Rye Brook is being asked to lend its
support and help the environment. The Village will not be passing a resolution,
but has been asked for support.
Trustee Rednick noted that there were a lot of grey areas involved with this matter.
He suggested that the matter be put on the next Board of Trustees meeting
There being no additional business before the Board, the meeting was adjourned at
