He introduced Village Staff and Counsel, and welcomed the two new members to the Board: Joel Simon and Andrew Kaminsky. He noted that Mr. Don Moscato, Chairman, was excused from the meeting, which meant the Board was short one member. He also noted that Jeffrey Rednick was now a Village Trustee and the liaison to the Zoning Board. Mr. Berger offered the applicants the opportunity to adjourn Zoning Board of Appeals May 4,2010 to the another meeting when, possibly, there would be a full compliment of the Board. In order to have an application approved the applicants would need all four remaining members to vote aye. He noted that because of vacation schedules, it was already known that there would be one member short for the June meeting as well. Mr. Berger called for the first item on the agenda: 2) #10-590 WIN RIDGE REALTY 24 Rye Ridge Plaza Install two 17.34 square foot monument signs at the Bowman Avenue elevation. Mr. Berger noted that the applicant's counsel has requested an adjournment. With the consensus of the Board, the adjournment was granted. Mr. Berger called for the second item on the agenda: 2) #10-595 Mr. Bruce Kaliner 6 Meadowlark Road Expand a portion of the existing driveway The contractor for the applicant, Joe Primiano, of Primiano & Son Inc., addressed the Board. It was noted that all required forms and postings had been received by the Village. Mr. Primiano stated that Mr. Kaliner was looking to bump out the driveway 12' in width. This is a corner lot and the extension of the driveway does not meet the front yard setback, and would fall into the 25' setback. The existing driveway is constructed of cobblestones. Many of the neighboring homes have extended their driveways; removing cars from the street. There is an existing drain in the driveway that will be moved over, and the drywell will be approved by the Village's Engineer. It was noted that there are no issues of flooding on this property. Mr. Berger called for members of the public wishing to address the Board in support or opposition. There was no one wishing to address the Board, and no comments or questions from members of the Board. On a motion made by Andrew Kaminsky, and seconded by Michele Fredman, the public portion of the hearing was closed and the Board deliberated. Zoning Board of Appeals May 4,2010 Mr. Berger read the following resolution: RESOLUTION WHEREAS, application has been made to the Zoning Board of Appeals by Mr. Bruce Kaliner for an unenclosed off street parking front yard set back variance of sixteen feet six inches, in connection with the proposed driveway expansion on property located at 6 Meadowlark Road, located in an R15 Zoning District on the south side of Meadowlark Road and Eagles Bluff. Said premises being known and designated on the tax map of the Village of Rye Brook as Parcel ID # 135.27-1-36; and WHEREAS, a duly advertised public hearing was held on Tuesday, May 4, 2010, at which time all those wishing to be heard were given such opportunity; and WHEREAS, the proposed action is a Type II action pursuant to the New York State Environmental Quality Review Act and, accordingly, no further environmental review is required; and WHEREAS, the Board, from the application, after viewing the premises and neighborhood concerned, and upon considering each of the factors set forth at Section 250-13(G)(b)[2][a]-[e] of the Rye Brook Code, finds: 1) The proposed variance does not adversely affect the character of the neighborhood; 2) The benefit sought by the applicant cannot be achieved by some other feasible method other than the proposed area variance; 3) The requested area variance is substantial; 4) The proposed variance will not have an adverse effect or impact on the physical or environmental conditions in the neighborhood; and 5) The alleged difficulty is self-created. NOW, THEREFORE, BE IT RESOLVED that the said application is hereby granted. Zoning Board of Appeals May 4,2010 3) APPROVAL OF April 6, 2010 ZONING BOARD SUMMARY Amanda Kandel, Esq., Mr. Berger, and Ms. Fredman made changes to the April summary and submitted the revisions to the Board's secretary. On a motion made by Ms. Fredman, and seconded by Mr. Joel Simon, the summary was approved, as amended.
