Mayor Paul Rosenberg welcomed everyone to the Tuesday, November 10, 2015 Board of
Trustees meeting. He apologized for the late start and noted that the Board just came
from an executive session on litigation with Save the Sound.

It was noted that Trustee Jason Klein was at a special awards dinner accepting an award
for the Village. He would be a little late for the Board of Trustees meeting. Mayor
Rosenberg introduced Attorney Courtney McGowen from the firm of Keene and Beane
who was in attendance for Mr. Beane, Village Counsel.
Mayor Rosenberg called for the first item on the agenda:
REPORUPRESENTATIONS:
1) Hawthorne Avenue Traffic Study Report and Recommendation
This matter was brought to the Village's attention by the residents on this roadway.
There are two issues: safety of the residents waking this street and speeding on the
roadway that is often used as a cut-through from Ridge Street to Westchester Avenue.
A PowerPoint presentation was made by the consultant hired by the Village. It was noted
that both Port Chester and Rye Brook Fire and Police Departments were part of this
study. Hawthorne Avenue is a 30' wide straight street and the homes are set back from
the street giving it the appearances of open space. There is very little on-street parking,
and no sidewalks for the residents to walk on. Traffic studies were done during the peak
period of 3:00 p.m. to 6:00 p.m. Eighty vehicles traveled this roadway. The speeds went
from 26 MPH to 31 MPH. Possible solutions were discussed. They included speed
bumps, speed humps, a traffic circle, making the road a dead end, turning it into a cul de
sac, adding sidewalks, striping, adding a median, turn restrictions, installing an oasis --
which is planting trees in the roadway that would allow one car at a time to pass at a time,
and making the street one way. Each suggestion had its own set of pluses and minuses,
i.e.: speed bumps can be noisy, a dead end or one way is inconvenient.
Mayor Rosenberg noted that members of the public would be allowed to make
comments. He asked that anyone wishing to address the Board come to the podium, use
the microphone, and address their comments to the members of the Board.
The owner of 72 Hawthorne Avenue addressed the Board. He noted that walking or
jogging in the street is very dangerous. The goal is to increase the safety of the residents
that use this street.
Mr. Bradbury noted that the Fire Departments use this street and the roadway must be to
accommodate the truck the size of the trucks. Mayor Rosenberg noted that there is a
problem on this street and the Village is attempting to solve it. However, it seems like
many of the suggested solutions will simply push the traffic to other streets. No one
wants to fix one problem and then cause problems for other residents who are allowed to

use the street. He suggested that something be tested first, on a temporary basis. Mr.
Bradbury was instructed to try striping and speed humps. A plan will be drawn out and a
budget transfer will be prepared. The funding should be in place by December and
installation can be done during spring break.
Mayor Rosenberg called for the first item on the agenda.
AFFORDABLE HOUSING:
1) Public hearing and resolution considering a request for extension of FAH zoning
map amendment, application for subdivision approval and application for
amended site plan approval for property located at 80 Bowman Avenue.
Mayor Rosenberg noted that the public hearing was opened at a prior meeting. At
that meeting the Board and applicant discussed moving the parking to the opposite
side of Barber Place to maintain the number of parking spaces. Mr. Federico,
Architect for the applicant, noted that the parking plan accomplished the additional
spaces. Standard size parking spaces were used. He noted that some of the residents
have smaller cars and so more cars may be able to fit on the street.
Mayor Rosenberg called members of the public wishing to address the Board. The
resident of the corner of Barber and Bowman addressed the Board. He noted that the
new development was supplying 24 parking spaces for 16 units. If every owner has
two cars they are already over the number of parking spaces. Then you add in visitors
and there is insufficient parking on the property and the overflow spills out onto the
street. He suggested cutting back on the number of units.
Mayor Rosenberg called upon Marilyn Timpone Mohamed, Village Consultant, for a
response. Ms. Timpone Mohamed noted that the parking is per the Village Code. The
number of units and spaces has already been approved. The parking includes
handicapped parking space.
Mayor Rosenberg called for a motion and a second to close the public hearing. On a
motion made by Trustee Epstein, and seconded by Trustee Heiser, the public hearing
was closed.

members of the public. There being none, he called for a motion and second to
close the public hearing.

RESOLUTION
APPROVING A LOCAL LAW REGARDING PARKING RESTRICTIONS ON BARBER
PLACE
VILLAGE OF RYE BROOK BOARD OF TRUSTEES
WHEREAS, local law was introduced before the Board of Trustees of the Village of Rye
Brook to amend Chapter 240 of the Village Code, entitled "Vehicles and Traffic," to implement
certain parking restrictions on the east side of Barber Place; and
WHEREAS, on October 13, 2015, the Board of Trustees classified the proposed local
law as a Type II Action pursuant to the New York State Environmental Quality Review Act
(SEQRA), and therefore, no further environmental review is required; and
WHEREAS, on October 27, 2015, the Board of Trustees held a duly noticed public
hearing at Village Hall to consider the proposed local law, at which time all persons interested
were given an opportunity to be heard.
NOW, THEREFORE, BE IT RESOLVED, that the Board of Trustees hereby approves
the above-mentioned local law imposing parking restrictions on the east side of Barber Place
near the intersection of Barber Place and South Ridge Street.
On a motion made by Trustee Rednick, and seconded by Trustee Epstein, the resolution
was adopted.

BE IT RESOLVED, that Peter Schlactus of 80 BelleFair Road shall be appointed to the
Airport Advisory Committee to fill the unexpired term of Richard Goldstein which shall expire
on the first Monday of April 2016.
Mayor Rosenberg thanked both the current member for his service, and the new member
for stepping in.

Brook on October 23, 2015 and listings were posted online through MUNICIBID with an end date of

NOW THEREFORE BE IT RESOLVED, the following surplus equipment is hereby awarded

5) Considering a bid award for basketball court resurfacing at Pine Ridge Court
Mr. Bradbury read the following resolution:

CONSIDERING AWARDING THE BID FOR
CONTRACT #15-18: PINE RIDGE BASKETBALL COURT RESURFACING
WHEREAS, the Village of Rye Brook has solicited bids for Contract 415-18, Pine Ridge
Basketball Court Resurfacing; and,
WHEREAS, the bid for Contract 415-18 was advertised in the Westinore News as the
Official Newspaper of the Village of Rye Brook, and was also made available on the Empire
State Purchasing Group bid system; and
WHEREAS, at 10:00am on Thursday, November 5, 2015 the Village Administrator
opened sealed bids as summarized below:

Landi for the base bid amount of$23,000.00

AND BE IT FURTHER RESOLVED, that that the Village of Rye Brook Board of
Trustees hereby awards the bid for Contract 415-17 to Peter J. Landi in the total bid amount of
$23,000.00; and
BE IT FURTHER RESOLVED,that the Mayor and Village Administrator are hereby
authorized to execute and deliver any documents necessary and appropriate to accomplish the
purposes of this resolution.
This bid has been put out several times. Some of the work will be done in house. The
work will be done in the spring.

6) Considering a license agreement for a fence within the Village right of way on
Tamarack Road
Mr. Bradbury read the following resolution authorizing Rye Brook to enter into this
license agreement
RESOLUTION
AUTHORIZING THE VILLAGE OF RYE BROOK
TO ENTER INTO A LICENSE AGREEMENT WITH THE OWNERS OF
86 TAMARACK ROAD FOR THE USE OF VILLAGE PROPERTY
WHEREAS, Sue Weiss, owner of 86 Tamarack Road, designated on the Town of
Rye Tax Assessors Map as Section 135.52, Block 1, Lot 11, has requested a license from the
Board of Trustees to maintain a split rail fence with wire mesh and plantings currently located in
the Tamarack Road Argyle Road rights-of-way, which rights-of-way are owned by the Village of

Rye Brook ("Village Property"), and to enter upon that portion of said Village property to
maintain, restore and replace (in-kind) the fence and for no other purpose; and
WHEREAS, the Board of Trustees, pursuant to the State Environmental Quality Review
Act (SEQRA), determines the proposed action to be a Type II Action and, accordingly, no
further environmental review is required.
NOW THEREFORE BE IT RESOLVED, that the Board of Trustees, upon
consideration of the aforementioned request, hereby authorizes the Village to enter into a License
Agreement with Sue Weiss, as annexed to this Resolution as Exhibit "A", to maintain the split
rail fence with wire mesh and plantings within the Village rights-of-way on Tamarack and
Argyle Roads, subject to and in accordance with the terms set forth in the attached License
Agreement; and
BE IT FURTHER RESOLVED, that the Mayor is hereby authorized to execute the
License Agreement and deliver all necessary documents to accomplish its purposes.
The property owner noted that the fence exists and she is looking to add mesh wiring and
arborvitae. This is in the Village's right-of-way. Trustee Epstein questioned the type and
height of the arborvitae being planted. She was concerned about the line of sight for
people making the turn at this intersection. There are some existing trees in this area and
the arborvitae will be planting along side of the trees. The Village's staff will ensure that
the line of sight is clear.

was adopted.

7) Considering the approval of minutes from the meetings of October 13,
2015.
Mayor Rosenberg, with the consensus of the Board, held over the meeting
minutes to the next Board of Trustees meeting.
ADMINISTRATOR'S REPORT
Mr. Bradbury noted that the Village Offices are closed on Veteran's Day. He noted that
there were several upcoming events. The first is a Blood Drive, being coordinated by
Shari Melillo and Liz Rotfeld, in memory of Joey Touri at the AJP Center on November
18, 2015. Driving issues will be highlighted.
There is a commercial solar event to be held at Westchester Burger on November 19,
2015.
Mr. Nowak and Mr. Bradbury will be attending a meeting in Greenwich where wetlands
buffers will be addressed. The meeting is scheduled for November 23, 2015. The
purpose is to approve the work on Anderson Hill Road.
The Winter Festival and Lighting Event is scheduled for December 3, 2015. Everyone is
invited. There will be crafts and games, and a Polar Express ride around the park.
Sarah Bledsoe worked closely with Brian Dempsey regarding the traffic study on
Hawthorne. He thanked her for her hard work.
Mayor Rosenberg noted that there was a big turnout for the Solarize Rye Brook meeting.
If you have not heard from the vendor yet, please contact the administrator's office.
The Village of Rye Brook's Trustee Klein received a Certificate of Recognition for the
Village's work on solarizing Rye Brook.
The next Board meetings are scheduled for November 24 and December 15, 2015.
