Present: Smith, Ferris, Ililas & wuigel, of the Board. The Public Ectice was read and filed, alon; with an affidavit of mailing and affidvit of publication. Applicant, Charles D. Patton, paid the publication fee of 06.Q plus the mailing fee of 51 cents. Er. Patton_ outlined to the members of the Board what he did to his house since tahinC occupancy. That in his plans there is contemplated the erection of a garage to be attached to the house. That the present -rage is on the rear lot l.'_ne anc that it hardly lends itself to aesthetic standards and is on the rear lot line. That in order to build a garage on the side of his house, ig6orTormity wth the Building Code as well as the Zonin` Code, he would need a variance as to the minimum side yard requirement as set forth in the application. Asked by Mr. ('dui:el what his lot size was, he replied that it had =17 a fifty foot front. That at present he had a side yard of 131 east and 131 west. He presented a sketch and plot plan for the Board to examines which would be submitted to the Building Inspector in thn event he be permitted to build as applied for. In the discussion it was shown that a verb small shack is right next to his lot line or the southeast corner; that it should discourage the applicant' s interest in mcakin7 his place as attractive as he was doing. That no one is objecting to it and that all his abutting neighbors are highly in favor of it. It is noted that not one of the Ixgxtomb persons legally qualified$ to be objectors appeared in opposition despite notice mailed to them. That no other person appeared in opposition, The Board, after an executive session, decided that in view of the unique cirxeunstances, the spirit ob the letter or the over-all _purpose of zoning would not be iiaI.aired by granter a variance in this case.
